All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Susan King susanking@carolina.rr.com May 8, 2005, 4:09 pm One acre above Old Town/house near Daniel Lantz's Written: November 8, 1819 Recorded: January 6, 1820 The following Deed was recorded the 6th day of January 1820 This Indenture made this Eighth day of November in the year of our Lord Eighteen hundred and Nineteen, Between Isaac Waggoner and Elizabeth Waggoner, his wife, of the County of Allegany and State of Maryland of the one part and Crispin Oglebe of the same County and State of the other part, witnesseth that the said Isaac Waggoner and Elizabeth Waggoner, his wife, for and in Consideration of the Sum of Twenty five Dollars Current money to them in hand paid the said Crispin Oglebay, the Receipt whereof they do hereby acknowledge and themselves therewith fully satisfied and paid, Have given, granted, bargained and sold, and by these presents do give grant bargain and sell unto the said Crispin Oglebay his heirs and assigns forever, all these, the said Isaac Waggoner’s and Elizabeth Waggoner’s right, title, interest and claim, both in law and Equity of, in, and by a certain house, and one acre Lot of ground lying and being in Allegany County aforesaid just above Old Town, and the first house on the main road above the hatters shop of the Late Daniel Lantz, which said Lot of ground containing one acre, was purchased from James M Cresap by James Oglebe the father of the aforesaid Crispin and Elizabeth, his Sister, now Elizabeth Waggoner, and the said Lot with the house now standing on the same becomes the joint property of all the children of the said James Oglebe now deceased, share and share alike To Have and to Hold, all the said Isaac Waggoner’s and Elizabeth Waggoner’s right, title, interest, and claim both in Law and Equity of, in, and to the aforesaid house and Lot of ground as before described for further description reference being had to James M Cresap Dec’d. to James Oglebe Dec’d. they will fully appear unto the said Crispin Oglebe his heirs and assigns forever, to and for his and their only use and behoof Forever and to and for no other use and ___ whatsoever, And the said Isaac Waggoner and Elizabeth Waggoner, his wife, for themselves and their heirs their Exrs and adms. do covenant and agree to and with the said Crispin Oglebe his heirs Exrs ____ or assigns that they will forever warrant and defend the aforesaid bargained and sold premises to him and them from and against all persons claiming by from or under them the said Isaac Waggoner and Elizabeth Waggoner, his wife. In Witness whereof the said Isaac Waggoner and Elizabeth Waggoner, his wife have hereunto set their hands and seals the day and year first within written Signed Sealed and Del’d. Isaac Waggoner [Seal] In the presence of Elizabeth Waggoner [Seal] Lenox Martin, R Newman State of Maryland Allegany County to wit On this 8th day of November, AD 1819 came Isaac Waggoner and Elizabeth his wife before the subscribers two of the Justices of the peace in and for the County and State af’d. and acknowledged the aforegoing instrument of writing to be their act and Deed and the property therein mentioned and intended to be conveyed and sold to be the right, title and Estate of the said Crispin Oglebee his heirs and assigns forever according to the true intent and meaning of the same, and the acts of Assembly in such cases made and provided -- at the same time came before us Elizabeth the wife of the said Isaac Waggoner who being examined by us apart from and out of the hearing of the said husband renounced all her right of Dower of, in, and to, the within mentioned house and Lot in favor of the aforesaid Crispin Oglebay his heirs and assigns and declared she did the same freely without being thereto induced by the threats of her said husband or from fear of his displeasure.
