This Indenture made this Second day of March in the year of our Lord Seventeen hundred and Ninety two Between Jacob Sapp of Allegany County of the one part Christopher Wagoner of the other part of the Same County of the other part Witnesseth that he the Said Jacob Sapp for and in consideration of the Sum of twenty pounds Current money of Maryland to him in hand paid by the Said Christopher Waggoner at or before the Sealing and Delivery of these presents the receipt whereof the Said Jacob Sapp doth hereby Acknowledge and thereof and therefrom acquit and Discharge the Said Christopher Waggoner his heirs Executors Administrators and Assigns and Every of them by these presents Hath given granted and bargained Sold Aliened Released Enfeoffed and Confirmed and by their presents Doth give grant bargain Sell Alien release enfeoff and Confirm unto him the Said Christopher Waggoner his heirs and Assigns All that part of a Tract or parcel of Land lying and being In Allegany County being part of White Oak Swamp originally granted Jacob Sapp. Beginning at the beginning Tree of the whole Tract and running thence with the Lines thereof North fifty t___ Degrees West thirty Six perches South forty five Degrees West twenty two perches South thirty Degrees East Eighteen perches South forty three Degrees East twenty perches South Sixty five Degrees East fifteen And one half perches then by a Straight Line to the beginning containing Eight Acres More or Less together with all and Singular the Houses out Houses Edifices Buildings Gardens Water Ways and Easements Profits Commodities Advantages and appurtenances whatsoever to the Said Land hereby granted and Sold or meant or intended so to be belonging or in any wise appertaining and the reversion and reversions Remainder and Remainders Rents Issues and profits of the Said Land hereby granted Bargained and Sold or Meant Mentioned and intended so to be belonging and every part and parcel thereof And all the Estate Right Title Interest use trust property Claim and Demand Whatsoever of him the Said Jacob Sapp of into and out of the Same Land hereby granted Bargained and Sold Aliened Released Enfeoffed and Confirmed and the premises with the Appurtenances and of into and out of every part and parcel thereof To have and to hold the Said Land here__ and hereby granted bargained and Sold Aliened released Enfeoffed and Confirmed and the premises with the appurtenances and every part and parcel thereof unto him the Said Christopher Waggoner his heirs and Assigns to the only proper use and behalf of him the Said Christopher Waggoner his heirs and Assigns for ever and to and for no other Use Intent or purpose Whatsoever And the Said Jacob Sapp for himself and his heirs doth hereby Covenant grant and agree to and with the Said Christopher Waggoner and his heirs in manner and form following that is to say that he the Said Jacob Sapp and his heirs and all and every other person and Persons and his and their heirs any thing having or Claiming In the Said Land hereby given granted Bargained Sold aliened released Enfeoffed and Confirmed and premises with the appurtenances by from or under him the Said Jacob Sapp Shall and Will at all times hereafter at the reasonable request proper cost and charges of him the Said Christopher Waggoner his heirs and assigns make do Suffer execute and acknowledge or cause or procure to be made done Suffered and acknowledged all and every Such further and other Lawful and reasonable Acts Deed or Deeds thing or things Devises Conveyances and assurances in the Law Whatsoever for the further and better and More perfect granting conveying and assuring the Said Land hereby granted bargained Sold Aliened released Enfeoffed and Confirmed and premises with the appurtenances And every part and parcel thereof unto him the Said Christopher Waggoner his heirs and assigns as by the Said Christopher Waggoner his heirs and assigns or this or their Council Learned in the Law Shall be reasonably devised advised or required And that he the Said Jacob Sapp and his heirs the Said Land hereby granted bargained bargained Sold aliened released enfeoffed and Confirmed and every part and parcel thereof unto him the Said Christopher Waggoner his heirs and assigns against him the Said Jacob Sapp and his heirs and all manner of person or persons Whatsoever Shall or Will Warrant and for ever Defend And by these presents In Witness whereof I have hereunto Set my hand and affixed my Seal the Day and Year above Written Jacob Sapp [his mark] Signed Sealed and Delivered In Presence of _______ Thos. Beall of Saml. James Prather On Which Deed were the following Endorsements, To wit Received this Second Day of March 1792 the Contents in full of the within mentioned consideration I Say received by me Thos. Beall of Saml. James Prather Jacob Sapp [his mark] On the Second Day of March in the year of our Lord One Thousand Seven hundred and Ninety two came before us two of the Justices of the peace for Allegany County the within named Jacob Sapp And acknowledged the within Instrument of writing to be his Act and Deed and the Land and premises therein mentioned with the appurtenances to be the right and Estate of the within named Christopher Waggoner his heirs and assigns for ever On the same Day and Year Came Cristinor Sapp wife to the aforesaid Jacob Sapp and She being privately Examined by us a part from and out of the hearing of her Said Husband did release and Relinquish all her right Title and Interest of Dower of in And to the Said Tract or parcel of Land and premises with the appurtenances and She also acknowledged and Declared that She did the Same Voluntarily and freely within being Induced thereto by fear or threats or ill usage from her Said Husband or thro’[?] fear of his Displeasure according to the true Intent and meaning of the Same Deed and the Act of Assembly in Such Case Made and provided.
