ABSTRACT Davis, Ebenezer Nov. 18, 1793. Jan. 13, 1794. Wife: Sarah Davis. Sons: Ebenezer Davis, Joseph Davis, Levi Davis, Stephen Davis. Daughters: Tabitha, Rachel, Mary, Susanna, Jenny. Exrs.: Wife Sarah Davis and son Ebenezer Davis. Wit.: Patrick Murdock, Susanna Brain. Will Book A, p 10-11, Allegany Co., MD. I Ebenezer Davis of the County of Allegany County and State of Maryland being of sound and disposing mind and memory do make and publish this my last will & testament. Imprimis - having already advanced my sons Joseph, Levi, & Stephen, & my daughters Tabitha & Rachel by giving each of them a just and reasonable part of my estate, I hereby give and bequeath them and each of them five shillings. Item. I give and devise to my son Ebenezer the land & plantation in which I now live to him and his heirs forever, subject to the burthens after mentioned. Item. I give and devise to my three daughters Mary, Susanna, and Jenny my land in Monongalia County Virginia to them and their heirs forever to be equally divided between them. Item. I give and bequeath to my beloved wife Sarah my horse, saddle and bridle, two cows and two calves such as she shall choose from my flock and all my household furniture and stock of sheep. Item. My will and desire is that my said three daughters Mary, Susannah, and Jenny be maintained and brought up out of the profits of the lands bequeathed to them in Virginia, and that if the same shall prove deficient the deficiency shall be made up by my said son Ebenezer out of the profits of the plantation herein above devised to him until they arrive respectively at the age of 16 years compleate. Item. My will and desire is that my said wife shall be supported out of the rents and profits herein above devised to my son Ebenezer, as long as she shall remain my widow. Lastly, all the rest and residue of my estate of what nature or kind soever, I devise to be sold for the payment of my just debts, and if there shall be anything left I bequeath it to my Executors to be applied towards the support of my three younger children Mary, Susannah, & Jenny, that my son Ebenezer's plantation may not be burthened more than is necessary. And I hereby appoint my said wife Sarah and my son Ebenezer Executor and Executrix of this my last will and testament & Guardians of all my infant children, hereby revoking all former wills and testaments by me made. In witness whereof I have hereunto set my hand and affixed my seal this eighteenth day of November one thousand seven hundred & ninety three. Might be Brown altho there is a dot over the middle of the name] Allegany County, January 15, 1794 Then came Patrick Murdock, one of the subscribing witnesses to the above last will & testament of Ebenezer Davis late of Allegany County and made oath as that he did see the testator therein named sign and seal the same and that he heard him publish, pronounce and declare the same to be his last will and testament that at the time of his so doing he was to the best of his apprehension of sound & disposing mind, memory & understanding and that he with the other witness respectively subscribed their names as witnesses to this will in the presence and at the request of the testator & in the presence of each other. Allegany County, 15 Feb 1794. Then came Sarah Davis and Ebenezer Davis Executors of the last will & testament of Ebenezer Davis deceased and made oath that the aforegoing Instrument of writing is the true and whole will and testament of Ebenezer Davis, late of Allegany County. The Inventory of the estate was made by Patrick Murdock, Evan James, and Peter Devermon on 26 Mar 1794.
