Hinkle In the name of God, Amen. I, Clarence M. Hinkle, of Allegany County, in the State of Maryland, being of sound and disposing mind, memory and understanding, and being aware of the certainty of death and the uncertainty of the time thereof, do make this my last Will and Testament, in manner following, that is to say: After the payment of all of my just debts and funeral expenses, I give, devise and bequeathe my estate as follows: Item (1) I give and bequeathe to the four children of my deceased brother, William M. Hinkle, late of the city of Cumberland, Allegany County, Maryland, namely Thomas Hinkle, Joseph Hinkle, Victor H. Hinkle, and Ethel (Hinkle) Coleman, wife of George Coleman, Akron, Ohio, the sum of $10.00 each. Item (2) I give and bequeathe to my brother George P. Hinkle, of Cumberland, Maryland, the sum of $100.00. Item (3) I give and bequeathe to my sister Mrs. Bessie M. Gurley, my diamond ring, which is now at the home of my mother on the Williams Road, in Allegany County, and my piano which is now at the home of my cousin Mrs. Lester Boward, on South Harrison Street, in Cumberland, Maryland, the same having been left there by me for the temporary use of my cousin Mrs. Lester Boward. Item (4) All the rest and residue of my property, real, personal and mixed, of whatever kind and wherever situate, I give, bequeathe and devise in equal shares to my brother, Francis R. Hinkle, of the Town of McKeesport, in the State of Pennsylvania, and my sister Mrs. Bessie M. Gurley, the wife of Charles R. Gurley, of Allegany County, in the State of Maryland. Item (5) I hereby constitute and appoint my brother- in-law Charles R. Gurley, to be the executor of this my last Will and Testament, hereby revoking all other Wills and Codicils heretofore made by me, without Bond. I make no provision in this Will for my mother, Mrs. Harriet L. Hinkle, because she has an estate of her own, and I have taken out and maintained by payments, a Policy of Life Insurance in the Modern Woodmen of America, which is payable to her upon my death. That he received the said will for safekeeping from the hand of Clarence M. Hinkle, the testator on the 8th day of June 1914, the dat of the signing and sealing thereof. And on the 18th day of June 1915 it was proved by George A. Pearre and Charles F. Hinkle, of Allegany County, Maryland, do make and publish this my last will and testament as follows: After all my just debts and funeral expenses are paid and satisfied by my executrix hereinafter named, I give, devise and bequeath my estate as follows to wit: Item 1. To my daughter Bessie M. Gurley all my household and kitchen furniture. I give and bequeath, absolutely. Item 2. I give and bequeath to my grand-daughter Ethel Mathis the sum of five dollars in cash. Item 3. I give and bequeath to my son George P. Hinkle for and during his natural life one acre of land situated at the gate adjoining J. Wolverton’s land and bounded by the old William’s Road, reserving however over said acre of ground a roadway to and from my farm, and upon his death the said acre of ground I give devise and bequeath to the children of my said son George P. Hinkle, absolutely. Item 4. I give and bequeath to my grandson Charles Gurley the sum of fifty dollars in cash. Item 6. I give devise and bequeath to my daughter Bessie M. Gurley, the land lying near Mt. Hermon Church in Allegany County conveyed to me by Walter Dicken and others by deed lately recorded among the land records of Allegany County. Item 7. All the rest and residue of my estate real personal and mixed whatsoever and wheresoever situate at the time of my death I give, devise and bequeath to my daughter Bessie M. Gurley and my son Frank R. Hinkle, share and share alike, and in case of the death of either of my said daughter Bessie M. Gurley or my son Frank R. Hinkle before my death, the interest of such deceased to go to and become vested in his or her children share and share alike. Lastly I hereby appoint my said daughter Bessie M. Gurley executrix of this my last will and testament, without bond, and I hereby revoke and annul any and all wills and testaments heretofore made by me ratifying and confirming this and none other to be last will and testament. Wilson the first subscribing witness thereto, who made oath in due form of law; that he received the said will for safe keeping from the hand of Hattie L. Hinkle, the testatrix, on the 6th day of May, 1929, the date of the signing and sealing thereof. And on the 9th day of January, 1930, said will was proven by A. A. Wilson and E. R. Johnston, the two subscribing witnesses thereto. And it was exhibited for probate and record and record and there being no objections filed, nor any caveat entered thereto (the near relatives of said testatrix having been notified that same would be offered for probate) said will was by the Orphans’ Court on the 10th day of January, 1930, admitted to probate and record. Test. Hervey W. Shuck, Register of Wills Recorded Liber P, Folio 85&c.-- Last Will & Testament Mary Robey Hinkle I, Mary Hinkle (widow of George P. Hinkle), of Allegany County in the State of Maryland, do make, publish and declare this to be my last will and testament in manner following: I give, devise and bequeath unto Dewane (?) H. Reynolds, my executor, hereinafter named, all of my property, real, personal, and mixed, and wheresoever the same may be situated, in trust, with power and authority unto the said Dewane H. Reynolds, as such executor, to sell and dispose of either at public or private sale, for the best priced obtainable, and after the payment of my funeral expenses, and all claims for which my estate may be in any manner liable or responsible the net proceeds then remaining, I dispose of as follows: 1st. To Nellie A. Hinkle, and Mary H. Hinkle, the two invalid daughters of my son James O. S. Hinkle, I give and bequeath one fourth of such net proceeds, to be divided equally between them. 2nd. To my son, Charles A. Hinkle, now residing in the State of Kansas, I give and bequeath one fourth of such net proceeds. 3rd. To the children of my deceased son, Edward M. Hinkle, of Allegany County Maryland, I give and bequeath one fourth of such net proceeds, to be divided equally between them. 4th. To the children of my son, William A. Hinkle, now said to be residing in the State of Texas, I give and bequeath one fourth of such net proceeds, to be equally divided between them. And whereas it is my present intention to remove the remains of my late husband, George P. Hinkle, from their place of burial, on the Malamphy Farm, on Evitts Creek in Allegany County, to a lot of ground which I intend to purchase in Rosehill Cemetery, Cumberland, Maryland, if I should not be able to accomplish this in my lifetime, it is my wish and desire that my said executor shall as soon after my decease as practicable, provide for the removal of the remains of the said George P. Hinkle, and for their internment alongside of my remains, which I desire to be buried in Rosehill Cemetery and if I shouldn’t be able to select such lot before my decease, I do hereby authorize my said executor, along with my son, James O. S. Hinkle, to select such lot, and all costs and charges connected with carrying out the provisions of this paragraph, I direct to be paid out of my estate. I do hereby appoint Dewane H. Reynolds of Cumberland, Md., executor of this my last will and testament, and do hereby authorize and empower him to sell any of my real estate, either at public or private sale, in his discretion, without first obtaining an order for that purpose from the Orphans Court for Allegany County, and to execute and deliver such deeds and conveyances, as may be necessary, to pass the proper titles thereto. Hinkle, of the County of Allegany Maryland. I, Alpheus B. Hinkle, considering the uncertainty of this mortal life, and being of sound mind and memory do make and publish this my last will and testament in manner and form following: First, I give and bequeath unto my beloved wife, Anna Maria Hinkle, all the money that is in my house which shall remain after my funeral expenses are paid, together with all the furnishings in the house–also two cows that are now in my possession. I give and bequeath, to my son George P. Hinkle, to my daughters Lucy Gephart, Melvina Baker, Charlotte Zevely, Caroline Gross, to each one of them share and share alike. It is also my desire that George P. Hinkle is to be my executor, and that the land property is not to be sold until two years after my death. In witness whereof, I have hereunto set my hand and seal the twenty ninth day of February, in the year of our Lord, one thousand eight hundred and sixty. I, George P. Hinkle of Allegany County in the state of Maryland being sick and weak in body, but of sound disposing mind, memory and understanding, considering the certainty of death and the uncertainty of the time thereof, and being desirous to settle my worldly affairs and thereby be then better prepared to leave this word when it shall please God to call me hence, do therefore make and publish this my last will and testament in manner and form following, that is to say: First, and principally, I commit my soul into the hands of Almighty God, and my body to the earth to be decently buried at the discretion of my executrix, hereinafter named, and after my debts and funeral expenses are paid, I devise and bequeath as follows: I give and bequeath to dear wife Harriet during her natural life, all my estate whether it be real, personal or mixed, by whatever name the same may be called to have and enjoy the same in whatever manner she may think best. I give and bequeath to my oldest son, Alpheus B. Hinkle, one third part of all the land I now own (with the exception of a tract of land on Evitt’s Creed containing thirty three acres) to be laid off adjoining and most convenient to his house which the said Alpheus B. Hinkle now lives saving and excepting a public road to be sixteen feet wide to and from the turnpike, commencing and locating said road from the point and on the ground, the road leading from the turnpike through my land to Williams Road was in eighteen hundred and thirty four and extending the said road was far as my land now extends towards Nichols mountain, and which I desire shall be kept open as a public road forever. I give and bequeath also to my said son Alpheus B. Hinkle one third part of my personal estate which may be in possession or remaining at the death of my wife with the exception of the personal property hereafter divised to my granddaughter Mary Jane Selby. I give and bequeath to my second son, David Hinkle, one third part of all the land I now own with the same exception contained in the diviso above to Alpheus B. Hinkle to be laid off adjoining and most convenient to the house where the said David Hinkle now lives. I give and bequeath also to my second son, David Hinkle, one third part of my personal estate which may be in possession and remaining at the death of my wife with the same exception on reservation to Mary Jane Selby aforesaid. I give and bequeath to my third son, Jesse Hinkle the remaining third part of all the land I own with the reservation aforesaid. I give and bequeath to my third son Jesse Hinkle one third part of my personal estate which may be in possession or remaining at the death of my wife with the reservation aforesaid to Mary Jane Selby. I give and bequeath to my two granddaughters, Mary Jane Selby and Elizabeth Ann Selby my tract of land on Evitts Creed containing thirty three acres share and share alike. If I should sell the same before my decease it is my will and desire that my said granddaughters shall receive two hundred dollars each on their arriving at sixteen years of age. I give and bequeath to my granddaughte3rs Mary Jane Selby my negro slave called “Mary” and also one feather bed and bedding. I hereby constitute and appoint my dear wife, Harriet my sole executrix of this my last will and testament and in case my wife Harriet should decline to act as executrix or it should please God to call her off before my decease, then and in that event I constitute and appoint my eldest son, Alpheus B. Hinkle of Allegany County, have made and duly executed my last will and testament in writing, bearing date the eleventh day of May in the year of our Lord One Thousand Eight Hundred and Thirty Five, which said last will and testament and (?) bequest and devised therein contained, I do hereby ratify and confirm save and except such bequest and devio therein mentioned, as is by me herein after revoke and made void, and being desirous to alter some part thereof and making and addition thereto, do therefore hereby declare this present writing to be as codicil which I will and once to (?) be taken and held as part of said last will and testament in manner and form following: that is to say, whereas by my said will, I go give and bequeath unto my granddaughter, Mary Jean Selby my negro slave called Mary. Now, I do hereby revoke the said legacy and do hereby (?) it and set free the said salve Mary at the death of my wife Harriet Hinkle. Hinkle, of Allegany County, in the State of Maryland, being sick and weak in body, but of sound and disposing mind, memory and understanding, considering the certainty of death and the uncertainty of the time thereof, and being desirous to settle my worldly affairs, and thereby be the better prepared to leave this world when it shall please God to call me hence, do therefore, make and publish this, my last will and testament, in manner and form following, that is to say: First and principally, I commit my soul into the hands of Almighty God, and my body to the earth to be decently buried at the discretion of my executor hereinafter named, and after all my just debts and funeral charges are fully paid and satisfied, I devise and bequeath as follows: I give, devise and bequeath until my dear wife, Mary Hinkle, all my property, of every kind and nature, real, personal and mixed, - or such portion thereof as may remain after the payment of my said debts and funeral expenses, - for and during her natural life, and after the death of my said wife it is my will that all that then remains of my said property, real and personal, be sold by my executor hereinafter named and out of the proceeds thereof, I give, devise and bequeath unto my son, William A. Hinkle, who now resides in the state of Texas, the sum of Ten Dollars. To my son, James O. S. Hinkle, I give, devise and bequeath the sum of One Thousand Dollars. And all the rest and residue of the proceeds of the sale of my said real and personal property, I devise and bequeath to be equally divided among my three sons, Charles A. Hinkle, Edward M. Hinkle, and James O. S. Hinkle, in equal portions, share and share alike. It is my will and I hereby authorize and direct my executor, hereinafter named, to sell such part of my real estate as he may deem best, during the lifetime of my said wife, in case he finds it necessary to make such sale for the purpose of paying off my indebtedness, but in no other case is such sale to be made during the lifetime of my said wife. It is my will that my executor sell the property, hereinbefore directed to be sold, at either public or private sale, as he may deem best, and it is also my will that in making sale of a part or the whole of my real estate, as hereinbefore directed, that preference be give to any one of my said three sons, Charles A. Hinkle, Edward M. Hinkle or James O. S. Hinkle, who may desire to purchase. And lastly, I do hereby constitute and appoint my said son James O. S. Hinkle to be sole executor of this my last will and testament, revoking and annulling all wills by me heretofore made, ratifying and confirming this and none other to be my last will and testament.
