These electronic pages may NOT be reproduced in any format for profit or presentation by other organizations. ************************************************************************ Catherine Rice Maryland State Archives - Microfilm CR 28-1 Liber C, Folio 44 In the name of God, Amen, I Catherine Rice of Allegany County in the State of Maryland being weak in body but of sound and disposing mind, memory and understanding, considering the certainty of death and the uncertainty of the time thereof and being desirous of settling my worldly affairs before it shall please God to call me hence do therefore make and publish this my last will and Testament in manner and form following that is to say: First and principally I commend my spirit to the keeping of its merciful author and body I commit to the earth to be decently buried at the discretion of my executor hereinafter named and after my debts and funeral expenses are paid I give and devise as follows: Item: I give and devise unto my sister Susannah Paxton and her husband Nelson Paxton all my Estate both real and personal for and during their natural lives and the life of the survivor of them, and after the death of the said Susannah and Nelson I give and devise all the said Estate to the children of the said Susannah Paxton and Nelson I give and devise all the said Estate to the children of the said Susannah Paxton their heirs and assigns forever share and share alike. And lastly I do hereby constitute and appoint the said Nelson Paxton to be the sole Executor of this my last will and Testament revoking and annulling all former wills by me heretofore made testify and confirming this and none other to be my last will and testament. In testimony whereof, I have hereunto subscribed my name and affixed my seal this first day of July in the year of our Lord eighteen hundred and sixty four. Widener Maryland Allegany County to wit: On this 8th day of December 1864 came Nelson Paxton Executor, and made oath in due form of law that the foregoing instrument of writing is the whole last Will and Testament of Catharine Rice late of said County deceased that has come to his hands or possession and that he does not know of any other. Test. Geo. W. Hoover - Register Maryland Allegany County to wit: On this 8th Day of December 1864 came Thos. Wilkinson, Henry Valentine, John Rice and J. B. Widener the subscribing witnesses to the foregoing last Will and Testament of Catharine Rice, late of said County deceased and made oath in due forms of law that they did see the testatrix therein named sign and seal said will - that they heard her publish pronounce and declare the same to be her last Will and Testament - that at the time of her so doing she was to the best of their apprehensions of sound and disposing mind memory and understanding capable of executing a valid deed or contract, and that they respectively subscribed their names as witnesses to said will at the request of said testatrix in her presence and in the presence of each other.
