These electronic pages may NOT be reproduced in any format for profit or presentation by other organizations. ************************************************************************ David Rice Maryland State Archives - Microfilm CR 29-1 Liber E, Page 287 In the name of God, Amen, I David Rice of Allegany County in the State of Maryland being in poor health but of sound disposing mind and memory calling to mind the fragility and uncertainty of human life and being desirous of settling my worldly affairs, and directing how the estates with which it has pleased God to bless me, shall be disposed of after my decease, while I have strength and capacity so to do, do make and publish this my last will and testament by me heretofore made. And first I commend my immortal being to Him who gave it, and my body to the earth, to be decently buried by my executor hereinafter names. And as to my worldly estate, and all the property, real and personal of which I shall die seized and possessed, or to which I shall be entitled at the time of my decease, I devise, bequeath and dispose thereof in the manner following to wit: Imprimis: My will is that all my just debts and funeral charges shall by my executor hereinafter named. Be paid out of my estate, as soon after my decease as shall by him be found convenient. Item: I give and bequeath to my son Alfred Rice the farm on which he now lives containing about one hundred and five acres which is to constitute his sole legacy from my estate. Item: I give and bequeath to my son George Rice the farm on which he now lives containing about one hundred acres which is to constitute his sole legacy from my estate. Item: I give and bequeath to my beloved wife Sarah Rice all the rest and residue of my estate real and personal or mixed of which I shall die seized or possessed or to which I shall be entitled at the time of my death to have and to hold the same to her for and during her natural life and at her death whatever is left of my estate shall be sold and the money arising from said sale shall be equally divided among my six remaining children viz: Robert N. Rice, Thomas B. Rice, Anna Newell, John M. Rice, Oliver E. Rice and the heirs of my daughter Harriet Ann Twigg. Lastly I do nominate and appoint my son Thomas B. Rice to be the executor of this my last will and testament. In testimony whereof I the said David Rice have to this my last will and testament contained on one sheet of paper subscribed my name and affixed my seal this (blank) day of (blank) in the year of our lord one thousand eight hundred and eighty four. David Rice The above instrument of writing consisting of one sheet of paper was now here subscribed by David Rice, the testator, in the presence of each of us, and was at the same time declared by him to be his last will and testament, and at his request, in his presence and in the presence of each other, sign our names hereto as witnesses. Oliver Wilson Benjamin F. Middleton George A. Robinette State of Maryland Allegany County to wit: On the 24th day of January 1888 came Thomas B. Rice, the executor named in the aforegoing last will and testament of David Rice late of Allegany County, deceased, and made oath in due form of law, that the aforegoing instrument of writing is the true whole last will and testament of said deceased, that has come to his hands or possession, and that he does not know of any other. Dowden, Register State of Maryland Allegany County to wit: On this 24th day of January 1888 came Oliver Wilson and Benjamin Middleton two of the subscribing witnesses to the aforegoing last will and testament of David Rice, late of Allegany County, deceased and made oath in due form of law that they did see the testator therein named sign and seal said will, that they heard him publish, pronounce and declare the same to be his last will and testament, that at the time of his so doing, he was to the best of their apprehensions of sound and disposing mind, memory and understanding, capable of executing a valid deed or contract, and that they together with George A. Robinette the other subscribing witness to said will respectively subscribed their names as witnesses thereto at the request of the testator, in his presence and all in the presence of each other.
