JOSHUA RICE Maryland State Archives Wills - Allegany County, Maryland Microfilm CR29-1 Liber D, Folio 267 In the name of God Amen, I Joshua Rice of Allegany County State of Maryland being in ill health and of a sound and disposing mind and memory, calling to mind the frailty and uncertainty of human life and being desirous of settling my worldly affairs, and directing how the estates with which it has pleased God to bless me, shall be dispose of after my decease, while I have strength and capacity so to do, do make and publish this my last will and testament hereby revoking and making null and void, all other last wills and testaments by me heretofore made, And first I commend my immortal being to him who gave it, and my body to the earth to be buried with little expense or ostentation by my executor herein named. And as to my worldly estate, and all the property, real, personal or mixed, of which I shall die seized and possessed, or to which I shall be entitled at the time of my decease, I devise bequeath and dispose thereof in the manner following to wit: First my wish is that all my just debts and funeral charges shall by my executor hereinafter named, be paid out of my estate, as soon after my decease, as shall by him be found convenient. Item - I give devise and bequeath to my beloved wife Mary Catharine Rice and to my three sons George Wesley Rice, Horace Restly? Rice, and Samuel Elsworth Rice all my estate both real and personal to be held by them jointly. Lastly, I do nominate and appoint my son George Wesley Rice to be the executor of this my last will and testament. In Testament whereof, I the said Joshua Rice, have to this my last will and testament (contained on one sheet of paper) subscribed my name and affixed by seal this twenty seventh day of September in the year of our Lord one thousand eight hundred and seventy two. Joshua Rice (Seal) The above instrument, consisting of one sheet of paper was at the date thereof, declared to us by the testator Joshua Rice to be his last will and testament and he then acknowledged to each of us, that he had subscribed the same and we at his request sign our names as attesting witnesses. Robinette State of Maryland State of Maryland Allegany County to wit: On this 28th day of March 1876 Came George Wesley Rice the Executor named in the aforegoing last will and testament of Joshua Rice, late of Allegany County, deceased and made oath in due form of Law, that the aforegoing instrument of writing is the true whole last will and testament of said deceased that hath come to his hands on possession, and that he does not know of any other. Test. Jno. Rhind, Register State of Maryland Allegany County to wit: On this 28th day of March 1876 Came John W. Newell and G. A. Robinette two of the subscribing witnesses to the aforegoing last will and testament of Joshua Rice late of Allegany County deceased and made oath in due form of law that they did see the testator therein named sign and seal said will, that they heard him publish pronounce and declare the same to be his last Will and Testament, That at the time of his so doing he was to the best of their apprehensions of sound and disposing mind memory and understanding capable of executing a valid deed or contract, and that they together with Amon Twigg the other subscribing witness to said Will, respectively subscribed their names as witnesses thereto at the request of the testator, in his presence and all in the presence of each other.
