MALICHI RICE Maryland State Archives Wills - Allegany County, Maryland Microfilm CR- 31 Book N Folio 2 I, Malachi Rice of the City of Cumberland Maryland being of sound and disposing mind memory and understanding, do make and publish this my last Will and Testament in manner following, viz: After all my just debts and funeral expenses are paid and satisfied by my executor hereinafter named, I give, devise and bequeath my estate as follows: Item 1: I direct my executor to erect a suitable tombstone at my grave. Item 2: To my daughter Fannie A. Rice, I give, devise and bequeath an undivided two third interest, in and to all my estate, real, personal, and mixed wherever situate at the time of my death. Item 3: To my daughter, Therese E. Brotemarkle, I give devise and bequeath an undivided one third interest, in and to all my estate, real, personal and mixed, wherever situate at the time of my death. Lastly, I constitute and appoint Tilden Brotemarkle, Executor of this my last Will and Testament, and direct that he shall not be required to give a bond, and hereby revoke and annul all former wills and testaments made by me, ratifying and confirming this and none other to be my last will and testament. In witness whereof I hereby set my hand and seal this 22nd day of January 1916. Wilson State of Maryland Allegany County to wit: On the 9th day of February 1923, came Tilden Brotemarkle, the Executor named in the aforegoing Last Will and Testament of Malachi Rice, late of Allegany County, Maryland, deceased, and made oath in due form of law, that after the death of Malachi Rice, the testator, he found said will among the private effects of the said testator in his late home. And the said Tilden Brotemarkle, further made oath, that the aforegoing instrument of writing is the true, whole, last Will and Testament of the said Malachi Rice, deceased, that hath come to his hands or possession and does not know of any other will and testament of the deceased aforesaid. Test Hervey W. Shuck Register of Wills State of Maryland Allegany County to wit: On the 9th day of February 1923, came George D. Landwehr and A. A. Wilson, the two subscribing witnesses to the aforegoing last will and testament of Malachi Rice, late of Allegany County, Maryland, deceased, and made oath in due form of law; that they did see Malachi Rice, the testator, sign and seal said will; that they heard him publish, pronounce, and declare the same to be his last will and testament; that at the time of his so doing he was to the best of their apprehensions, of sound and disposing mind, memory and understanding, capable of executing a valid deed or contract, and that they respectively subscribed their names as witnesses thereto at the request of Malachi Rice, the testator, in his presence and in the presence of each other.
