Dated April 2, 1838. Francis Earlougher buying from Charles Timanus. Document at Maryland State Archives, microfilm CR 39,536-2. This Indenture made this second day of April in the year Eighteen hundred and thirty eight between Charles Timanus of Anne Arundel County in the State of Maryland of the one part and Francis Earlougher of the County and State aforesaid of the other part. Witnesseth that for and in consideration of the sum of twenty dollars to the said Charles Timanus by the said Francis Earlougher in hand paid at and before the sealing and delivery of these presents the receipt of which he doth hereby acknowledge and in further consideration of the love and affection which he the said Charles Timanus bear towards Mary I. Timanus his wife and in consideration of the natural love and affection to those others to whom the Estate herein after mentioned are limited. The said Charles Timanus hath given granted bargained and sold aliened enfeoffed assigned conformed and conveyed and by these presents doth give grant bargain and sell alien enfeoff assign conform and convey unto the said Francis Earlougher his Executor and administrator the ___ and lot of ground situated in ___ Church Street in the City of Baltimore now belonging to the said Charles Timanus and purchased by him from John Dun and ___ the following Lot piece or parcel of ground lying and being in Anne Arundel County being part of a tract of Land called Mount Misery and is known ___ Lot number Twenty four ___ distinguished on a plat of Division lately made amount the Ellicotts including also all of that part of Mount Misery on which the said Charles Timanus has improved and which are contained within the miles and bound courses and distances following Beginning for the same at the ___ of the first line of Lot number Seventy three it being a part on the South side of the Turnpike Road ninety five feet North forty nine degrees and fifteen minutes West from the North West corner of Caleb Merrymans new frame building and running thence ___ upon the turnpike road North forty nine degrees and fifteen minutes West forty four feet one inch to the north west corner of said Charles Timanus stone house then parallel to the line dividing between Browns and Ellicotts South forty four degrees and twenty minutes West one hundred and fifty five feet more of less to a line drawn North fifty degrees West along and coursing with the back lines of Lots numbers seventy three and Seventy four then ___ on said line to drawn ___ly South fifty degrees East fifty two feet and seven tenth to Lot number seventy three then binding on the said lot North forty degrees East one hundred and fifty feet to the place of beginning together with all the improvements thereon made ways easements and privileges to the said Lots pieces or parcels of ground belonging or on any wise appertaining To Have and To hold the said Lots and houses pieces or parcels of land and premises above described and thereby conveyed with all and ___ the appurtenances thereto belonging to the said Francis Earlougher his Executors and administrators from the day next before the day of the date of these presents for and during and ___ the full ___ and ___ of ninety nine years from thence next ensuring and fully to be complete and ended in trust to and for the used intended and purposes following that ___ that the said Mary I. Timanus during the ___ lives of herself and the said Charles Timanus may receive and take the rents profits and issues of the above conveyed House Lots and parcels of Land and premises to and for her own separate use and maintenance to that the said rents profits and issues shall be accounted reckoned and taken as a separate and distinct Estate of and from the Estate of the said Charles Timanus and being ___ ___ liable and subject to him or to the payment of his debts and in Trust further that upon the death of either the said Charles Timanus or his said wife to hold the above described premises to and the use of his infant child now being and such child or children of him the said Charles Timanus as may be living at that time and further in trust that the said Francis Earlougher his Executors or administrators shall reconvey the said Lots pieces or parcels of Land and premises above described at any part thereof to the said Charles Timanus provided the said Mary I. Timanus should so order or direct during her life time by deed or other instrument of writing signed by her or ___ in any manner to request or direct. In witness whereof the said Charles Timanus hath hereunto set his hand and seal on the day and year first herein above written. Signed Sealed and delivered In the presence of Stevenson Archer Charles Timanus At the foot of the aforegoing was ___ written to wit: State of Maryland Baltimore County Court Be it remembered and it is hereby certified that on this 4th day of April in the year Eighteen hundred and thirty eight before the subscriber Chief Judge of the Sixth Judicial District personally appear Charles Timanus he being known to me from the testimony of Edwan Hammond under oath to be the person whose names and described as and professing to be the party grantor to the foregoing deed and indenture and doth acknowledge the said Deed or Instrument of writing to be his act and deeds.
