June 7 9 ˝ JS In the Name of God Amen I John Ashpaw of Annearundal County Farmer being very sick and week in body but of perfect mind and memory thanks be given unto God Calling unto mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my last will and Testament That is to say principally and first of all I give and recommend my soul into the Hand of Almighty God that gave it and my Body I recommend to the Earth to be buried in decent Christian Burial at the Discretion of my Executors nothing douting but at the general Resurrection I shall receive the same again by the power of God and as touching such worldly estate wherewith it pleased God to Bless me in this life I give devise and dispose of the same in the following manner and form. First I give and bequeath to my well beloved son John Ashpaw one hundred and twenty five acres of Land being part of a tract of Land called- Gosiling Chance lying and being in Annearundal County to him and his heirs for ever Also I give and bequeath unto my son John Ashpaw one horse and one cow and two heifers two old plows harness and all my black smiths tools waggon and three chains and of my flatt and know more of my Estate/ Also I give and bequeath to my son in law John Rolles one hundred and twenty five acres of land being part of the above tract of land called Gosiling Chance to him and his heirs forever on conditions that the said John Rolles do pay or cause to be paid unto my heirs or Executors the just sum of sixty pounds- current money and payments to be made at ten pounds pr. year and upon conditions the above mentioned John Rolles doth not pay or cause to be paid by him his heirs or assigns the above mentioned sum of sixty pounds at the expiration of six years then the above named one hundred and twenty five acres is to be sold at Publick sale and the sixty pounds to be equally divide between my seven children namely Frederick Jacob Margett Catron Henry George and Elizabeth and to their heirs and assigns— Also I give to my well beloved son George Ashpaw one hundred and fifty acres of land lying in the county aforesaid called Crouches Forrest to him and his heirs forever on conditions aforementioned- And also my Will and Desire is that my land lying in the province of Pennsylvania (??) New Hanover Township shall be sold at publick sale by my Executors and the money equally divided amongst my seven children or their heirs- Also it is my will and Desire that my son Jacob Ashpaw shall make over unto my son Henry Ashpaw or his heirs one hundred and fifty acres of Land part of a tract of land lying in Piney Groves and my meaning is that my son Henry Ashpaw shall have that hundred and fifty acres of land that by agreement by me and him was for my son John Ashpaw and on condition the above mentioned Jacob Ashpaw or his heirs doth not make over the above mentioned one hundred and fifty acres of land unto my son Henry Ashpaw and his Heirs my will is that he shall have but one shilling sterling of my Estate and no more/ My will also is that my son Henry Ashpaw shall pay unto my Estate the sum of nineteen pounds, current money which is due upon the above mentioned land which my son Jacob Ashpaw shall make over to my son Henry Ashpaw/ And lastly I constitute make and ordain my beloved wife Elizabeth Ashpaw and my son John Ashpaw, and also my son George Ashpaw to be joyntly and severally my Executricks and Executors of this my last will and Testament and I hereby utterly Disallow, Revoke and Disannull all and every other former will by me in any wise before named and willed and do bequeath Ratify and Confirm this and know other to be my last Will and Testament In witness hereof I set my hand and seal this twenty fourth day of March in the year of our Lord one thousand seven hundred and sixty six~ John his x mark Ashpaw (Seal) Signed sealed published pronounced and declared by the said John Ashpaw as his last will and testament in presence of us who in his presents and in the presents of each other have hereunto prescribed our names Daniel Smith David Stewart Elijah Robosson Anne Arundel County On the day seventh (????? crossed out) Day of June (April crossed out) Anno Domini 1766 came David Stewart and Elijah Roboson two of the subscribing Evidences to the aforegoing last Will and Testament of John Ashpaw deceased and made oath on the Holy Evangels of Almighty God that ^they did see the Testator make his mark to said Will and heard him publish and declare the same to be his last Will and Testament that at the time of his so doing he was to the best of their apprehension of a sound disposing mind & memory and that they did see Danl. Smith the other subscribing witness to said will sign his name as witness thereto in the presence of the Testator and in the presence of each other Sworn before, James Dixon, Deputy Comry of Ann Arundel County On the seventh (????? crossed out) day of (April crossed out) June 1766 Came George Ashpaw one of the Exer appointed for the execution of the foregoing will made Oath on the Holy Evangels of Almighty God that he did not know of any other Will + Testament made by the Testator since the date of this said will Sworn before, James Dixon, Depy Comry of Ann Arundel County Ann Arundel County ss On the 23d day of May 1766 came Danl. Smith one of the witnesses to the aforegoing Last Will & Test?(illegible) of John Ashpaw deceased and made oath on the Holy Evangels of Almighty God that he did see the Testator make his mark to said will but does not remember he saw him seal it and that he heard him publish and declare the same to be his Last Will and Testament & that at the time of his so doing he was to the best of the apprehens ion of a sound disposing mind and memory and that he subscribed as a witness to said will with David Stewart and Elijah Roboson the other two sub scribing Evidences to said will in the presence of the Testator and in the presence of each other.
