Witnesseth that the said John Hancock as well for and in consideration of the natural love and affection which he the said John Hancock hath and beareth unto the said Orlando Hancock as also for the better maintenance support livelihood and preferment of him the said Orlando Hancock hath given granted aliened enfeoffed and confirmed and by these prescrits doth give grant alien enfeoff and confirm unto the said Orlando Hancock his heirs and assigns all that tract of land known by the name of “Hickory Bottom” lying and being in Anne Arundel County containing two hundred and seventy five acres more or less also all that part of a tract of land known by the name of Green Spring lying and being in the county aforesaid containing fifty acres more or less together with all and singular the houses building advantages enrolment here attainments and appartenancy whatsoever to the said tracts of land and premises hereby mentioned or intended to be granted and confirmed unto the said Orlando Hancock as aforesaid or any part or parcel thereof belonging or in anywise appertaining or therewithal commonly held used occupied or enjoyed or accepted reputed taken or known as part or parcel of or belonging to the same and the reversion and reversions remainder and remainders rents issues and profits of all and singular the said premises with their appurtenances and all the estate rights title interests property claim and demand whatsoever of him the said John Hancock of in and to the said tracts of land and premises and of in and to every part and parcel thereof with their and every of their appurtenances to have and to hold the said tracts of land and all and singular other the premises hereby granted and confirmed or mentioned or intended so to be with their and every of their appurtenances unto the said Orlando Hancock His being and assigns to the only proper use and behoof of him the said Orlando Hancock his heirs and assigns forever. And this indenture further witnesseth that the said John Hancock for and in consideration of the said premises hath given and granted and by these presents doth give and grant unto the said Orlando Hancock his executing administrators and assigns all the negroes stock household and kitchen furniture and farming utensils herein after particularly mentioned that is to say one negro woman named Kate one other negro woman named Charity one negro boy named James one bay house one cow one sow and nine pigs one bureau one cupboard and cupboard furniture. One mahogany table and chairs two beds two chests one trunk two ovens three pots one kettle one pot rack one pair of and irons one pair of fire tongs one cart and gear two ploughs three hoes three axes three guns two brass candlesticks. To have and to hold all and singular the said negroes stock household and kitchen furniture and farming utensils and other the premises hereby given and granted or intended so to be to the said Orlando Hancock his executing administrators and assigns forever and the said John Hancock for himself his heirs executors and administrators doth covenant grant and agree to and with the said Orlando Hancock his heirs executing administrators and assigns that he the said Orlando Hancock his heirs executing administrators and assigns shall and lawfully may from time to time and at all times hereafter peaceably and quietly have had use occupy possess and enjoy the said tracts of land and premises hereby granted and confirmed or mentioned or intended to be hereby granted and confirmed with the appurtenances thereunto belonging and all the negroes stock household and kitchen furniture and farming utensils aforesaid free clear and fully discharged. Or well and sufficiently saved kept harmless and indemnified of from and against all former and others gifts grants bargins sales jointures feoffments dowers estates entails rents rent charges arrearages of rents judgements executions and of from and against all former and other titles troubles charges and incumbrances whatsoever had done or suffered or to be made had done or suffered by him the said John Hancock his heirs or assigns or any other person or persons lawfully claiming or to claim by from or under him them or any of them In Witness where of the said John Hancock hath hereunto subscribed his name affixed his seal the day and year first herein before written signed sealed and delivered in presence of us Henry Maccubbin? TRANSCRIPT OF CHANCERY COURT RECORD Chancery Case 8694 To the Honorable Theodorick Bland Esquire Chancellor of Maryland. The petition of Orlando Hancock respectfully states that it will appear by the auditor report and account distributing its proceeds of the estate of John Hancock that after satisfying its claims and all the costs, the auditor reports a balance due to your petitioner of the sum of four hundred and seventy three dollars and forty one cents. Your petitioner states that the whole of the purchase money hath been paid by the Trustee in this court and that the claims and costs as stated by the auditor have been paid and there now remains in the court the sum of one hundred and eight dollars and seventy five cents which is payable to your petitioner your petitioner therefore prays your Honor to direct a check to be drawn in his favor for this said sum so remaining in this court. TRANSCIRPT OF CHANCERY COURT RECORD Chancery Case 8694 Petition Filed 31 Dec 1825 Order 31 Dec 1825 To the Honorable Theodorick Bland Esq Chancellor of Maryland. The petition of Francis Hancock and Louis Gassaway respectfully states that by a Decree of this court passed on the 20 of April 1825 in the cause of Francis Hancock [illeg] of John Jacob against John Hancock. Orlando Hancock and John Gardner your petitioner Gassaway was appointed Trustee to make sale of the property under the said decree and filed his bond for the faithful discharge of the trust reposed in him – That he was informed by James Boyle Esquire of the City of Annapolis that a judgement had been obtained in Ann Arundel County Cout at April Term 1822 by a certain William Smith use of the said James Boyle against the said John Hancock upon which judgement an execution was issued and the Land of this said John Hancock (being the same Land which was directed by the Decree above mentioned to be sold) was offered at public sale by the Sheriff of Anne Arundal County and the said James Boyle became the purchaser of the same but obtained no deed from the Sheriff for the said Land – your petitioner Gassaway states that discovering he could not make an advantageous sale of the said property under the said Decree on account of the said judgement and the execution thereon and the sale made under the [illeg] (the said judgement being a lien on said land) he at the insistance of the petitioner Francis Hancock and with money received from the said Hancock paid to the said James Boyle the sum of ninety one dollars and forty seven cents. Being the amount of said judgement. Interest and costs and obtained from said Boyle an assigment of all his rights title and interest to the said judgement and any right he had acquired by virtue of any execution issued on the said judgement or any sale under the same as will more fully appear by a coy of the said judgement with the assignment thereon. Herewith filed marked A which is prayed may be taken as part of this petition Your petitioner states that [illed] this said assignment of the said judgement the Land directed to be sold under the said decree hath been sold by your petitioner Gassaway as Trustee under said decree and a part of the proceeds of said sale hath been brought into their court. Your petitioner Francis Hancock therefore prays your Honor to pass an Order directing the auditor to allow him out of the proceeds of said sale the money so paid by him to said Boyle on account of said judgement and [great?] he will pray[?]. Louis Gassaway Francis Hancock In Chancery 31 Dec 1825 The Auditor is hereby directed to state an account in this case and to change the amount of the said judgement as prayed by this foregoing petitioner and to make report subject to the further order of this court.
