A formatted version can be Viewed at http://www.usgwarchives.net/md/anne/wills/maccubbin-j1.pdf John Maccubbin (d1752) Will Anne Arundel County, MD Maryland Hall of Records Liber 28, folio 297 (Microfilm SR 4422) Also copy located at 1/11/1/35 Also copy located at 3/68/10/18 Written 2 December 1745 Proved 7 May 1752 Maryland In the Name of God Amen I John Mackubin of Annarundel County Being Aged But of Sound disposing Mind and Memory Pras be God for it doe make this my Last Will and Testament in Manner following Viz Imp{rs} I Give and Bequeath my Soul to God in hopes to Receive Pardon for my Sins Thro the merits of my Blessed Redeemer Jesus Christ and my Body I Comit to the Earth to be Buried by the Directions of my Executrix hereafter Named Item I Give and Bequeath to my Daughter Elizabeth Lusby five shill Cur{t} Money in full of her part of my Estate Which I Will to be Paid her in Three Months after my Decease Item I Give and Bequeath to my Son Samuel Mackubin five shill Cur{t} money in full of his part of my Estate Which I Will to be Paid him in Three Months after my Decease Item I Give and Bequeath to my Daughter Deborah Wilkins five Shillings Cur{t} money in full for her Part of my Estate which I Will to be paid her in three months after my Decease Item I Give and Bequeath to my Daughter Ann Peerman one Negro man Named Tom Item I Give and Bequeath to my Daughter Rachel Mackubin one Negro man named Sampson Item I Give and Bequeath to my Daughter Ruth Mackubin one Negro Girle Named Cate Item I Give and Bequeath to my Dearly Beloved Wife Ann Mackubin the Plantation I Now Live on and all the Lands and appurtenances thereto Belonging Being Brampton, Timber Neck, and Thirty Acres thereto Adjoyning for and Dureing her Natureal Life (in Case she doth not Marry) and after her Decease To my Son Richard Mackubin and to his heirs forever and That my Daughter Rachel and Ruth Mackubin shall live on the Plantation af{d} with my said Son Richard Till They are Marryed Item I Give and Bequeath to my Dearly Beloved Wife Ann Mackubin The use and Bennefit of all my Personall Estate (after my Debts paid and Legacies herein Given Deducted) for and Dureing her Natureal Life and after her Decease to my Seven Children hereafter Named Viz Ann Peerman, William Mackubin Rachel Mackubin, Zacharia Mackubin, Moses Mackubin, Ruth Mackubin, and Richard Mackubin to be Equally Divided amongst my said Seven Children Shair and Shair alike Part and Part alike But if it Please my Wife to Marry then Tis my Will that she have no more of my Estate Either Real or Personal use of Bennefit thereof then one Third Part of Both Real and Personal any thing heretofore mentioned in any wise to the Contrary Notwithstanding But that my son Richard and his Heirs Emediately on the Marriage of my Wife Enter, Take, hold, Posses, and Injoy, two third of my Real Estate and that my Seven Children af{d} have paid to them in Equal Proportion Emedicately after the Marriage of my Wife af{d} The Remainding Two thirds of my Personal Estate according to the amount of the appraisment thereof after the Deduction of the Legacies hering Given are Deducted therewith Lastly I doe hereby Constitute make and Ordain my Dearly Beloved Wife Ann Mackubin my sole Executrix of this my Last Will and Testament hereby Revoking all former Wills by me made and this only to be Taken as and for my Last Will and Testament John Mackubin (Seal) In Witness Whereof I have hereunto set my hand and Seale this 2{nd} day of Decemb{r} 1745 Signed Sealed Published Pronounced and Declared by the said John Mackubin to be his Last Will and Testament in the Presence of us who Subscribed as witnesses at the Testators Request and in his Presence George Payne, Tho{s} Whitman, John Hall, Rich{d} White To the aforegoing Will was annext the following Probat Viz On the 7{th} day of May 1752 George Payne John Hall and Richard White three of the subscribing Witnesses to the aforegoing Will Being duly and Solemnly Sworn on the holy Evangels of Almighty God depose and Say that they saw the Testator John Mackubin sign and seal and heard him Publish and declare the Said Will as his Last Will Testament That at the Time of his so doing he was to the best of their knowledge and apprehension of sound disposing mind and memory and that they Subscribed their Respective Names as Witnesses to the said Will in the Presence of the said Testator and at his Request Sworn Before D Dulany Comsy
