I Robert Shipley of Anne Arundel County in the State of Maryland being weak in body but of sound disposing mind memory and understanding considering the certainty of death and the uncertainty of the time thereof and being desirous to settle my wordly affairs and thereby be the better prepared to leave this world when it shall please God to call me hence do therefore make and publish this my Last Will and Testament in manner and form following that is to say First and principally I commit my soul into the hands of almighty God and my body to the earth to be decently buried at the discretion of my executor herein after named and after my debts and financial charges are paid I devise and bequeath as follows Item it is my will and desire that my wife Rachel Shipley shall have a home at my dwelling and be gently supported by my executor during her life & I also give my said wife Rachel Shipley a legacy of five hundred Dollars to be paid by my executor which bequests I give to her in lieu of her thirds which she would be entitled to in my real and personal Estate Item I give and bequeath to my son Edward Shipley all that part of a tract of Land called the Willow Spring contained within the following metes and bound beginning at a Stone Standing under a Peach tree in the West side of my lane it being also at the end of the twenty ninth line of the whole tract aforesaid and running from thence with a straight line to a stone marked with the figure five standing near the (over) Edge of the road on the west side of the lane aforesaid and running from said stone in with the road until it crosses the branch then on with the left hand road into the hill by a row of wild cherry trees still on with said road until it intersects the seventh line of the land called Willow Spring near the end of said line. Then with the line to the end thereof then still bounding on the outlines of said tract until it come home to the first beginning all of which land lays on the South West side of the before mentioned road. The above named land and premises I give to my son Edward Shipley his heirs and assigns forever also I give to my son Edward Shipley one thousand Dollars to be paid by my executor herein after named. Item I give to my daughter Eleanor Hobbs one thousand dollars as a legacy to be paid by my executor. Item I give to my daughter Ruther Gaither on thousand Dollars as a legacy to be paid by my executor. Item all the rest and residue of my estate both real and personal I give and devise to my son William Shipley to him his heirs and assigns forever And lastly I do hereby constitute my beloved son William Shipley to be the sole executor of this my last Will and Testament revoking and annulling all former wills by me heretofore made ratifying and confirming this and none other to be my last Will and Testament. In Testimoney whereof I have hereunto set my hand and affixed my seal this twenty third day of June in the Year of our Lord one thousand Eight hundred and twenty three. Thomas Hood Benjamin Hood Daniel Warfield Anne Arundel County the 6th day of Januaray 1824 Then came Thomas Hood and Daniel Warfield two of the subscribed witnesses to the aforegoing Will of Robert Shipley late of said County acceaded and made oath on the Holy Evangely of Almighty God that they did see the Testator therein named sign and Seal this will and that they heard him publish pronounce and declare the same to be his last Will and Testament that at the time of his so doing he was to the best of their apprehensions of sound and disposing mind memory and understanding and that they together with Benjamin Hood the other subscribing witness respectively subscribed their names as witnesses to this Will in the presence and at the request of the Testator and all in the presence of each other. Thos H Hall Thos Chills a a (sic) Anne Arundel County 6 January 1824, Then Came William Shipley and made an oath on the Holy Evangely of the Almighty God that the afore giving instrument of writing is the true whole and last Will and Testament of Robert Shipley late of said County deceased that hath come to his hands or possession and that he doth not know of any other.
