First, I give and devise to my well beloved wife Susanna Witwright all my property. Real, personal and mixed during her natural life and after her death, I will and devise as follows to wit. Item, I give and devise to my daughter Mary Hyde the wife of George W. Hyde and her heirs forever one hundred and seventy acres of land on which I now reside including the dwelling house, garden, tan yard, barn and all the other out houses. Item, I give and devise my said daughter Mary Hyde and her heirs forever fifty acres of the woodland to be selected by her from any of my woodland, which she may think proper. The said fifty acres is not included nor is it to be considered a part of the devise of one hundred and seventy acres as aforesaid. Item, I give and devise the rest and residue of my said farm to my two Grandchildren Philip Wesley Witwright and Mary Eizabeth Witwright, when they shall arrive at age, the said land to remain in the possession of my said wife Susanna Witwright until(l) my said grandchildren shall arrive at age as aforesaid and in case of the death of my said wife, then the land devised to my two Grandchildren as aforesaid shall go into the possession of my said daughter Mary Hyde and be held by her until the said children shall arrive at the age aforementioned when it is my will and desire that the said supposed two hundred acres of land shall be equally divided between my said two Grandchildren, having regard to quality and quantity. I would wish to be destinctly understood, that is to say, I leave the support and education of my said Grandchildren Philip Wesley Witwright and Mary Elizabeth Witwright to the discretion of my said daughter Mary Hyde not making it by any act or word at the least obligatory on her, but entirely at her discretion feeling however well assured that she will never act unkind, but as far as her abilities will admit, I know she will act as a kind and generous Aunt. Item, I give and devise to my said Grandchildren Philip Wesley Witwright and Mary Elizabeth Witwright and their heirs forever two Negro slaves that is to say to Philip Wesley Witwright a negro boy named Adam and to Mary Elizabeth Witwright a negro boy named Peter, to remain in the possession of my said wife and in case of her death to remain in the possession of my daughter Mary Hyde until they arrive at the age aforesaid. Item, I give and devise to my said daughter Mary Hyde and her heirs forever after the death of my said wife aforesaid the following Negro slaves. Viz. Ben, Harry, Jim, Betty and Eliza and her infant child and the same of the said Betty and Eliza. Item, I give and devise to my said daughter Mary Hyde and her heirs forever after the death of my wife aforesaid all the rest, residue and remainder of my Estate Real Personal and mixed of every kind and description whatsoever. Item, I will and desire that in the event of the death of either of my Grandchildren aforesaid that the property heretofore devised shall descend to the survivor and in the case of the death of both without issue, then it shall descend to my daughter Mary Hyde and her heirs forever. Lastly, I hereby constitute and appoint my said wife Susanna Witwright and George W. Hyde my Executrix and Executor of this my last will and testament, hereby revoking and and annulling all former Wills by me heretofore made ratifying and confirming this and none other to be my last will and testament. In Testimony where of I have here unto set my hand and affixed my seal this sixteenth day of February in the year of our Lord one thousand eight hundred and twenty eight. Thomas W. Hyde, James Tucker, Daniel T. Hyde. Anne Arundel County The 25th day of September 1832 Then came Thomas W. Hyde and Daniel T. Hyde two of the subscribing witnesses to the aforegoing last will and testament of Philip Witwright late of Anne Arundel County deceased and made oath on the Holy Evangely of Almighty God that they did see the testator therein name and sign and seal this will and that they heard him publish, pronounce and declare the same to be his last will and testament, that at the time of his so doing, he was to the best of their apprehensions of sound and disposing mind, memory and understanding, and that they together with James Tucker the other subscribing witness who is since dead, respectively subscribed their names as witnesses to this will in the presence and at the request of the testator and all in the presence of each other. Hyde and made Oath on the Holy Evangely of Almighty God, that the aforesaid instrument of writing is the true, whole and Last Will and Testament of Philip Witwright late of Anne Arundel County deceased, that hath come to his hands and possession and that he does not know of any other. I Susanna Witwright, widow of Philip Witwright, late of Anne Arundel County, deceased, do hereby refuse to administer on the Estate of the deceased, and do therefore renounce all right, title and claim to said Administration, desiring at the same time that the letters of administration may be granted to George W. Hyde, of the County aforesaid, as witness my hand on this 3rd day of September 1832. her Test.
