All Rights Reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ********************************************************* The Last Will and Testament of Daniel Bush I, Daniel Bush, of Carroll County in the State of Maryland, being in good health of body and of sound disposing mind, memory and understanding; wishing to make some disposition of my property before it shall please God in his providence to call me hence, do therefore make this my last Will and Testament, as follows Towhit: In the first place I commit myself into the merciful hands of Almighty God who gave it. And my body to the earth to be decently buried by my family and friends, and after my just debts, funeral expenses including tombstones at my grave, and expenses of administration are paid. I dispose of all the property I may have at my death as follows Towhit: I will order and direct that my Executor herein after appointed shall as soon after my death as convenient sell and dispose of at public or private sales, to the best advantage and the best terms, all the real estate, or leaseholder estate, I may own at my death, and convey the same to the purchase thereof as soon as the purchaser money is all paid, or abundantly secured; also to sell at public sale all my moveable property; also to collect as soon as possible my debts or closed in action due andowing to me, or to become due; to sell, transfer and dispose of any stocks I may own or hold at my death; also to take charge of any ready money I might leave at my death;and the whole amount of my estate in the hands of my said executor, after paying their just expenses as aforesaid, I will and direct shall be disposed of in the manner following Towhit: To my present beloved wife, Sophia M. Bush, ex- clusive of the property she had at her marriage or has since acquired by her by her own means and which is to be considered as her own, I give and bequeath the sum of twelve hundred dollars to be paid her out of my estate, if she survives me, which is to be in full and in lei of any claim of hers to dower in my real estate and thirds, or distributive share by law in my personal estate. Next, I give and bequeath to my son, John M. Bush and my son William A. Bush, each the sum of two hundred dollars, to be paid to each of them over and above their equal shares of my estate herein after mentioned. All the rest and residue of my estate then remain-ing, real personal or mixed, on the net proceeds thereof as aforesaid, I give devise and bequeath,to all my following named children, to be divided among them equally, to them and their respective heirsand assigns as follows Towhit: To my son Jarbez A. Bush, one eighth thereof. To my daughter, Mary Elizabeth Woods, wife of Peter Woods, one eighth thereof. To my daughter, Sarah Jane Caples, wife of Hezikiah Caples, one eighth thereof. To my son John Murray Bush, one eighth thereof. To my son William Agustus Bush, one eighth thereof. To my daughter Cecelia Orndorff, wife of George Orndorff, one eighth thereof. To my daughter Alice Virginia Schaffer, wife of Jeremiah Schaffer, one eighth thereof. To my daughter Agnes Melvin Bay, wife of Nathan Bay, and only child of my said present wife, one eighth thereof. It is my will and also to order and direct that the shares of my estate herein given to my said daughters Sarah Jane Caples, and Cecelia Orndorff they shall take as their separate estate, free from any control of their respective husbands therein. With full power to release my executor therefor by any receipt or release in writing signed by them respectively without their husbands joining therein; and I enjoin it upon them to have their said share so invested during life as to secure what remains at their respective deaths to their respective children or issues. It is also my will that if any of my said children should die before me that their respective shares shall go to their respective children, or issues, in legal manner. Lastly, I constitute and appoint my son Jabez A. Bush to be sole executor of this my last Will and Testament, and authorize him to do all that is necessary to settle my estate, hereby revoking all other wills heretofore made, ratifying this and no other as my last Will and Testament. In testimony whereof I hereto set my name and Affix my seal this 24th day of June A.D. 1878. He married 1st Margaret Emily ARMACOST on 18 Dec. 1832, the couple had 10 children; he married 2nd Sophia M. CAPLES, the couple had one child.
