These electronic pages may NOT be reproduced in any format for profit or presentation by other organizations. ************************************************************************ Last Will and Testament of Anthony HAINES Signed 17 Dec 1783 - Proved 26 Feb 1791 I Anthony Haines of the County of Baltimore farmer being in perfect health and of sound and disposing mind and memory do make this last Will and Testament in manner and form following, that is to say. Impromise It is my will and desire and I do hereby order and direct that all my Just debts and funeral charges be first paid and satisfied out of my Estate by Executors herein after named. Item. It is my will and I do hereby give devise and bequeath unto my son Michael Haines the sum of one Shilling money the same to be in full of his part of my estate both real and personal. Item. It is my will and I do hereby give devise and bequeath unto my son George Haines the sum of one Shilling money the same to be in full of his part of my estate both real and personal. Item. It is my will and I do hereby order and direct that my Executors herein after named shall as soon as conveniable may be set up expose to public sale and sell at public sale unto the highest bidder or bidders all and singular all my estate both real and personal of what hind sower and I do further order and direct that all money arising from such sale shall by my Executors herein after named be equally divided between my seven children herein after named - Jacob, Catherine the wife of Peter Baile, Barbara the wife of Michael Waggoner, John, Elizabeth, Joseph and Mary Magdalin, the same to be equally divided between them share and share alike. And I do hereby order and direct that in case either of my said seven children - Jacob, Catherine, Barbara, John, Elizabeth, Joseph or Mary Magdalin should die before such sale and division of my said estate issue or having dispose of the same then it is my will that in case of any such death, I do devise and bequeath the part devised to such child so dying to be equally divided among the survivors of my said seven children or their legal representatives share and share alike to hold to them respectively their heirs and assigns forever. Item. It is my will that after the sale of my estate as aforesaid that the parts or shares of such of my children as shall be under age and unmarried shall be let out and upon interest for the use of such child or children the same to be at the discretion of the Orphans Court of Baltimore County And lastly, I do hereby constitute nominate and appoint the Aforesaid Peter Baile and Michael Waggoner Exexcutors of this my last Will and Testament hereby ratifying and confirming the same and making null and void all other and former wills bequests and bequeathments by me heretofore made meant or mentioned to be made. In testimony whereof the said Anthony Hains hath hereunto set his hand and affixed his seal this seventeenth day of December Seventeen Hundred and Eighty Three. Anthony Hains Signed sealed published and declared by the testator as his last will and testament in presence of: George Nace Andrew Hooke Wm Spencer Baltimore County To Wit on the 28th day of February 1791 came George Nace one of the subscribing evidences to the aforegoing last Will and Testament of Anthony Haines late of said County deceased and did solemnly declare and affirm that he did see the Testator sign and seal this will that he heard him publish and pronounce and declare the same to be his last will and testament that at the time of his sodoing he was to the best of his apprehensions of sound disposing mind memory and understanding that he subscribed his name as a witness to this Will in his presence at his request and in the presence of the other subscribing witnesses sworn before me Register of Wills for Baltimore County. William Buchanon Having been appoionted an Executor of the Will of Anthony Haines of balt. County, I hereby inform you that it is out of my power to act and after this information you will know how to proceed should application be made by any person wishing to administer. Peter Baile
