SM16-32 Written 3 July 1738 Proved 4 September 1738 In the name of God Amen. I Joshua Howard of Baltimore County in the Province of Maryland Planter being sick & weak of body but of sound Sense & memory Do make & Ordain this to be my Last Will & Testament in manner & form following that is to say First I give my Soul to God who gave it me & hope through the merits of my beloved Saviour & God Mercy to be Saved and as to my Body I desire it may be buried in Christian & Decent manner at the Discretion Execr hereafter named as to my Estate in this World I Give the same as followeth Vizt Item I give and Bequeath unto my beloved son Francis Howard a Tract of Land called Howards Inheritance Containing One Hundred Acres to him & the heirs of his Body Lawfully begotten for ever & one Shilling Sterling & no more. Whereas my son Francis is now abroad & should not make his Personall Appearance with a design to Settle & Enjoy the foresaid Track of Land Then it is my Will & Desire that the foresaid Track of Land called as above said be my Loving Son Cornelius Howards & the Heirs of his Body lawfully Item I Give & Bequeath to my Loving Son Edmund Howard one pair of Handmill Stones & Irons & one Shilling Sterling & no more. Item I Give & Bequeath to my Loving Daughter Sarah Gist one Shilling Sterling & no more. Item I Give & Bequeath to my Loving Daughter Mary Gist one young Cow & Calf & one Shilling Sterling & no more. Item I Give & Bequeath unto my Loving Daughter Elizabeth Wells one Cow & Calf & one Shilling Sterling & no more. Item I Give & Bequeath unto my Loving Daughter Violate Gist one Cow & Calf & one Shilling Sterling & no more. Item I Give & Bequeath unto my dear & well beloved Son Cornelius Howard my now Dwelling Plantation & a Track of Land Containing One Hundred & fifty Acres called Howards Square to him & the Heirs of his Body lawfully begotten for ever. Item I Give & Bequeath unto my said beloved Son Cornelius Howard after all my just debts & Legacies are paid all my whole Personall Estate of what nature or kind soever(?) it be to him & his Heirs Executors Administrators & Assigns for ever. Item I appoint my said Loving Son Cornelius Howard to be whole & sole Exect of this my last Will & Testament In Witness of the truth hereof I have hereunto sett my hand & Seal this third day of July 1738. On the back of the aforegoing Will was thus written Vizt George Ogg & Jos Murray junr two of the Subscribing Witnesses to the above & foregoing Will being duly Sworn Depose on the holy Evangelists That they Saw Joshua Howard the Testator Sign the foregoing Instrument & heard him Publish & Declare it to be his last Will Testament That at the time of his so doing he was of sound & desposing mind & memory to the best of their Judgement & Apprehension & that they Subscribed their names as Witnesses in the Presence of the Testator and Josephus Murray being one of the people called Quakers upon his Solemn Affirmation doth Affirm & Declare That he saw the Testator Sign the foregoing & heard him Publish & declare it as his last Will & Testament That at the time of his so doing he was of sound & disposing mind & memory to the best of his Judgement & Apprehension And that this Affirmant Subscribed his name as a Witness to the said Will in the Presence of the Testator.
