I Joshua Kemp of Baltimore County in the State of Maryland being of Sound and disposing mind memory and understanding considering the certainty of death and the uncertainty of the time thereof and being desirous to settle my wordly affairs and thereby be the better prepared to leave this world when it shall please God to call me hence, do therefore make and publish this my last will and testament in manner and form following, that is to Say: First and principal. I commit my soul into the hands of Almighty God and my boddy to the earth to be decently Buried at the discretion of my Executors hereaf named and after my Debts and funeral charges are paid I devise and bequeath as follows, that is to say. I give and Devise unto my three sons and six daughters herein named that is to say, to my Sons William Kemp, Lewis Kemp, Kinsey Kemp and my daughters Julianna Fowble wife of Joseph Milchor Fowble, Mary Ellen Kemp, Henrietta Kemp, Penelope Kemp, Lucrecy Kemp and Missoury Kemp all my land and real Estate known by the following names. One tract called the Second Cost: containing one hundred and twenty one acres and one half acre of land more or less. One other tract in two lots Called Caples habitation, the two containing ninety three acres of land more or less. Two other tracts called by the names good luck and Hookers prospect, the two containing ninety nine and three quarters of an acre of land, mroe or less. one other tract called Deerpark containing thirty seven acres and one half acre of land, more or less, all lying and being in Baltimore County, with all the rest of my Estate Whether personal real or mixt, or whatsoever it may be that I now hold or may hereafter hold to them the within named Nine Children to them or to the survivor of them, their heirs or assigns forever, to be equally Divided between them shear and shear alike whether by sale or Division as they or a majority of them may agree upon between themselves. And lastly, I do hereby constitute and appoint my Dutiful and Effectionate Sons William Kemp, Lewis Kemp, and Kinsey Kemp my Sole Executors of this my last Will and testament revoking and annuling all former wills by me heretofore made, Ratifying and Confirming this and none other to be my last Will and Testament. In Testimony whereof I have hereunto Set my hand and affixed my Seal this twenty Eight Day of February in the year One thousand eight hundred and Sixty. Allan and Shadrack Kemp Jr. Subscribing Witnesses to the aforegoing last Will and Testament of Joshua Kemp late of Said County deseased. And made oath on the Holy Evangely of Almighty God that they did see the Testator Sign and Seal this Will that they heard him publish pronounce and declare the Same to be his last Will and Testament that at the time of his sodoing he was to the best of their apprehension of sound and disposing mind memory and understanding and that they subscribed their names as Witnesses to this will in his presence, at his request and in the presence of each other.
