I, Henry Leinhart of the City of Baltimore, in the State of Maryland, being at this time in a sick and low state of bodily health, but possessing a sound disposing mind, memory and understanding, for which I desire to return my sincere thanks to Almighty God for his numerous blessings; do hereby make, publish and declare this instrument of writing as my last Will and testament in manner and form following, that is to say, I order and direct[?], after my decease, that my body be interred in a plain and decent manner; and also, all my just debts and funeral expences be paid by my executrix herein after named, as soon as practicable. Item I give and bequeath all my estate both personal [one to three illegible words] situate [?] lying and being in the said City of Baltimore, to my dear Wife Anne to be by her freely possessed for and during the term of her natural life; and from and immediately after her decease, I will, order and direct that all my estate situate, lying and being within the said City of Baltimore, shall be sold by my said Executrix, either at public or private sale; and she is hereby authorised and impowered to execute and acknowledge all deeds of assignment to the purchaser or purchasers, their executors, administrators and assigns, in as full and ample a manner as I might or could do; and that the proceeds thereof be divided in manner herein after mentioned, that is to say: Item, I give and bequeath unto my daughter Elixabeth [sic] Horne wife of Abraham Horne of Pittsburgh, an equal share of the nett proceeds of all my personal Estate, upon this express condition, that all advances heretofore made either to her, or her Husband, shall be allowed and considered as a part of my personal Estate. Item, I give and bequeath unto my son Jacob Leinhart an equal share of my personal Estate, upon the same terms and conditions as last above expressed, and not otherwise. Item, I give and bequeath unto my son Henry Leinhart an equal share of my personal Estate, upon the same terms and conditions as last above expressed, he the said Henry Leinhart having received a Credit of Five hundred dollars for house rent and which is entered in my book, all of which charges against him is by me intended to be considered as a part of my personal Estate, and accounted for as such upon a final distribution of the same among the Legatee's herein before and herein after named, and that he the said Henry pay unto his Sister Nancy all such sum or sums of money as he may now stand justly due and owing unto her, for monies heretofore advanced to him. Item, I give, devise and bequeath unto my daughter Mary Everson wife of Richard Everson of the state of Ohio, all that plantation or Tract of Land on which they now or lately resided, to her the said Mary Everson and her heirs and assigns forever, and also my account against her said Husband, which shall be in full of her share of my Estate. Item, I give and bequeath unto my daughter Susanna Shaw wife of Samuel Shaw of the said City of Baltimore, an equal share of my personal Estate; and I order and direct that the Mortgage which I have on his property and also one hundred dollars loaned him shall be accounted in my personal Estate and make a part thereof and payable at the decease of my said wife, or sooner at his option; Item, I give and bequeath unto my daughter Nancy Leinhart nine hundred dollars in which sum is included Four hundred dollars, which she paid toward the purchase money of a House and Lot on the North side of Mulberry Street, in said City, which said sum of nine hundred dollars is by me intended to be exclusive of her equal share in my personal Estate, also my eight day Clock, and one feather bed, bedstead, and bedding of her own choice. Item, I give and bequeath unto my daughter Sarah Councellor of New Orleans, an equal share of my personal estate, she allowing my Account against her for advances heretofore made, and also on the express condition that she pay unto her sister Nancy the amount of a Note with Interest dated the twelfth day of August, in the year eighteen hundred and eleven. And lastly, I do hereby nominate, constitute and appoint my dear daughter Nancy, to be my whole and sole Executrix of this my last will and testament; hereby revoking and annulling all former and other wills, and declaring this to be my last will and testament. In Testimony whereof I have hereunto set my hand and seal this tenth day of April, in the year eighteen hundred and twenty three. Signed, sealed, published, pronounced and declared by Henry Leinhart the testator, to be his last will and testament in the presence of us, whoat his instance and request, in his presence and in the presence of each other have hereunto subscribed our names as witnesses-- David Morrison, Charles H. Kurtz, Susan Kurtz his Henry X Leinhart { seal } mark Baltimore County, Ss[?]:-- On the 23rd, day of April 1825 came Charles H. Kurtz and on the 25th day of the same month in the year aforesaid came Susan Kurtz -- two of the subscribing witnesses to the aforegoing last will and testament of Henry Leinhart late of said County deceased and made oath on the holy evangely of Almighty God, that they did see the Testator sign and seal this will that they heard him publish pronounce and declare the same to be his last will and testament; that at the time of his sodoing that he was to the best of their apprehensions of sound and disposing mind memory and understanding, and that they together with David Morrison the other subscribing witness thereto subscribed their names as witnesses to this will in his presence, at his request, and in the presence of each other.
