Recorded: October 18, 1828 In the name of God, Amen. I Walter Perdue of Baltimore County, in the State of Maryland, being weak of body but of sound mind and memory considering the certainty of death and the uncertainty of the time thereof and being desirous to settle my worldly affairs and thereby being the better prepared to leave this world when it pleases God to call me home do therefore make and publish this my last Will and Testament in manner and form following; First and principally I commit my soul into the hands of God Almighty and my body to the earth to be decently buried at the decesion of my Executor hereinafter named and after my debts and funeral charges are paid. I devise and bequeath as follows; I give and bequeath unto my eldest son Laban the farm where he now lives on containing one hundred and seventy five acres more or less also one negro boy named Milser which is to be the right title and estate of my son Laban his heirs and assigns forever, for his full share of my estate. Item. I give to my second son William the farm where he now lives and all the lands adjoining said farm that belongs to me and also one negro boy named Adam to him the said William and his assigns forever for his full share of my estate. Item, I give and bequeath to my two daughters, Rachel and Elizabeth all the land I own on Gunpowder Falls (except five acres being part of a tract called "Young Mans Choice" and also ten acres being part of a tract called Abraham reserved regulated which said acres I will to George Roberts which is to be laid off at a corner next to his, the other five acres I will to Ann Dorsey colored woman to be laid off around her house where she now lives to be the right of them their heirs and assigns forever) be be equally divided between the said Rachel and Elizabeth, share and share alike to them their heirs and assigns forever and also I give and bequeath to my daughter Rachel the negro girl named Sophia and one negro boy named Harry and one horse worth sixty dollars two cows one of which she shall make choice of for her full share of my estate, Also I give and bequeath to my daughter Elizabeth one negro boy called Sam and one Negro Girl called Lusa and one horse worth sixty dollars two cows one of which she shall make her choice of and also one bed and bedding and one spinning wheel for her full share of my estate. Item - I give and bequeath to my third son Walter the place where I now live on known by Lot No. 92 being part of my Lady's Manor. Item - I give and bequeath to my fourth son John Lot No. 90 being also part of my Lady's Manor with the exception hereafter mentioned. Item - I give and bequeath to my fifth son Thomas Lot No. 91 also being part of my Lady's Manor and the eleven acres I purchased from James Bosley and as much land taken off of Lot No 90 as will make the lands of John and Thomas Equal in Value the part of land that is to be taken off of Lot No. 90 to begin at the beginning of Lot No. 90 and laid out in as near a square as will be advantagious to each farm and also I give and bequeath unto my three sons namely Walter, John and Thomas all the remaining part of my Estate both real and personal to be equally divided between them the said Walter, John and Thomas to share and share alike to them their heirs and assigns forever I further Will that if one or more of the aforesaid Walter, John or Thomas should die without a lawful begotten heir that the survivor or survivors of the aforesaid shall inheret the parts or part left by the deceased. Also it is my will that the said Walter, John and Thomas shall live together as they now are and all their property shall remain in the present situation for the term of three years from this day and at the expiration of the aforesaid three years each of my three sons namely Walter, John and Thomas to have full possession of their respected shares of my property both real and personal agreeable to the foregoing Will. I further will that Elizabeth shall have a home with my three sons namely Walter, John and Thomas so long as she remains single and lastly I do hereby Constitute and appoint my son Walter Perdue to be my sole Executor of this my last Will and Testament revoking and annuling all former Wills made by me heretofore ratifying this and none other to be my last Will and Testament. In testimony whereof I have hereunto set my hand and affixed my seal this 15 day of July 1828. Henry Kidd On the 18 day of October 1828 came Joseph Joseph Brian Brian and Francis Sparks two of the Frs Sparks subscribing witnesses to the aforegoing last Will and Testament of Walter Perdue late of said county deceased and made oath on the Holy Evangely of Almighty God that they did see the testator sign and seal this Will that they heard him pronouce publish and declare the same to be his last Will and Testament that at the time of him so doing he was to the best of their apprehensions of sound and disposing mind memory and understanding that they togehter with Henry Kidd other subscribing witness thereto subscribed their names as witnesses to this Will at his request and in the presence of each other.
