These electronic pages may NOT be reproduced in any format for profit or presentation by other organizations. ************************************************************************ Last Will and Testament of DAVID THOMAS, Jr., of Baltimore Co., dated 6 February 1769, proved 16 Feb 1769 The sixth day of February in the year of our Lord and Saviour One thousand seven hundred and sixty nine I David Thomas of Baltimore County in the Province of Maryland being weak and low in Body but in perfect Disposing mind and memory and calling to mind the uncertainty of this Transitory life make and Ordain this my Last Will and Testament in manner and form Following. Imprimis I give and bequeath to my Dear and Loving Wife Hannah Thomas the following articles and should I have any of the kind more than is here mentioned she is to have her choice. The sum of twenty five pounds of Pensilvania currency. Nine pounds of Worsted. One white mare called Folly, One cow and calf, Two Ewes and lambs if they have any at the time of my Death, One Feather Bed and furniture with Bedstead and Cord half a xoz Pewter plates all the knives and forks. I am Pofsest with two pewter Basons One Pewter Dish, One Sittled painted Trunk one Deal chest One Diaper Table Cloth One Iron Pott and Hooks One Tea Kettle and Cannister al my Tea Ware all my Flax One woolen and one Linnen Spinning Wheel and no more of my Estate of what nature or kind soever. Item My Will and mind is that my Wife shall have no third in my Land. Item My Will and mind is that my Land that I now live on being part of a Tract of Land called the three sisters Containing one hundred and fifty acres be sold by Publick auction or private Sale at [end page 8] the Discretion of my Executors hereafter named and my whole Estate after my Wife is paid of and my just Debts are paid then the remaining part of my Estate be put out to Interest for the Benefit of my son. Item which remaining part I give and bequeath to my Son Giles Thomas his Heirs and Afsigns forever. Item My Will and mind is that if my son Giles Thomas Should die before he comes to the age of twenty one years or at that age or under should have no Lawfull ifsue then my whole estate that I have given to my son shall go to my sister Elizabeth Green’s children that she has at this present time but so as her son Leonard Green shall have twice as much as any of the Rest of the said Children and they to have equal shares. Lastly I constitute and appoint Jacob Bond and my Brother in Law Benjamin Green my whole and Sole Executors of this my Last Will and Testament Containing one Side and this piece of a side of paper as Witnefs my hand and Seal the Day and Year first written Signed Sealed Published and ) Declared to be his Last Will and ) David Thomas (Seal) Testament by the Testator in ) the Presence of us ) Jac: Bond ) Jac: Wheeler ) Abraham Whitacre ) At the foot of the aforegoing Will was thus Written Viz: February ye 16, 1769 Came Jacob Bond one of the people called Quakers and made his solemn affirmation that the foregoing Will he saw the Testator David Thomas Sign Seal Publish pronounce and Declare the same to be his Last Will and Testament at the same time Came Jac. Wheeler and Abraham Whitacre the other two Subscribing Witnefses to the said Will and being Solemnly Sworn on the Holy Evangelist of Almighty God Depose and Say that they saw the Testator David Thomas sign Seal publish pronounce and Declare the same to be his Last Will and Testament that at the Time of his so doing he was to the best of their apprehension of Sound and Disposing mind & memory and that they Subscribed their respective names as Witnefses to the said Will in the Presence of the said Testator and at his request.
