Last Will and Testament of John Tracey of Baltimore Co.
Dated 21 May 1842, Proved 11 June 1842 

In the name of God Amen, I John Tracey of Baltimore County in the State of Maryland, 
being weak of body but of sound mind and memory, God be praised..... do make and 
ordain this my last Will and Testament. First, I commend by soul to the hands of God my 
Creator hoping and assuredly believing through the only merits of Jesus Christ my savour, 
to be made partaker of life everlasting; and my body to the earth whereof that was made. 

Item. It is my Will that my personal and real estate be sold at public sale at the expiration 
of one year after my death and after my funeral expenses is paid, the residue of the money 
to be divided as follows, that is to say, My daughters Chloe Lesourd and her son Nelson 
Tracey and Permilia Fitzgerald to have one equal share among them equally divided, that 
is the three to have no more than one of my other children hereafter named. Then the 
remaining sum of money to be equally divided share and share alike between Micajah 
Tracey, Cynthia Kelley, Owen Tracey, Ephraim Tracey, Roda Barnhart, Margaret Cooper 
and Elytha Bull, and it is my will that Micajah Tracey (my son) be my sole Executor to this 
my last Will and Testament. 

In witness whereof, I have hereunto set my hand and seal this twenty first day of May, 
anno domini Eighteen hundred and forty two.

Signed, sealed, published and declared by the said John Tracey as his last Will and 
Testament in the presence of us.
Joseph Cooper___________ Gilson Tracey ___________ Aquillar Wilson

Baltimore County, on the 11th day of June 1842, came Gilson Tracey and Aquillar Wilson 
and on the 22 day of the same month in the year aforesaid came Joseph Cooper, the three 
subscribing witnesses to the aforegoing last Will and Testament of John Tracey, late of 
said County, deceased and made Oath on the holy Evangely of Almighty God, that they 
did see the testator sign and seal the Will that they heard him publish, pronounce and 
declare the same to be his last Will and Testament, that at the time of his so doing, he was 
to the best of their apprehensions of sound and disposing mind, memory and 
understanding and that they subscribed their names as witnesses to this Will in his 
presence, at his request, and in the presence of each other.
