I William Wilson of the City of Baltimore in Baltimore County and State of Maryland, Merchant, being of sound and disposing mind memory and understanding, do make and publish this my last Will and testament in manner and form following, that is to sway – I give and devise unto my son James Wilson, his heirs and assigns, All that part of a Lot, Piece or Parcel of ground situated lying and being at the North east corner or intersection of Lombard and Sharpe streets in the city of Baltimore, bounding on the former of those streets about one hundred and twenty feet, and on the latter sixty eight feet or thereabout, which was conveyed to me by Solomon Birckhead by deed or indenture bearing date on or about the twenty eight day of May one thousand eight hundred and twelve, and recorded among the land records of Baltimore County aforesaid, in Liber W.G. No. 119 folio 127 &c. Also the Wester most one of those two warehouses erected on the North side of Lovely Lane in the City of Baltimore aforesaid, upon the grounds which I purchased from Solomon Etting and which were assigned by him to me by Indentures bearing date respectively on the twenty second day of October one thousand eight hundred and two – and the Eleventh day of February one thousand eight hundred and five, the former of them recorded among the Land records of Baltimore County aforesaid in LIber W.G. No. 74 folio 30 &c – and the latter among the same records in Liber W.G. No. 83 folio 514 &c the reversion or fee whereof together with other property, was conveyed to me by Nicholas Rogers by deed dated on or about the thirty first day of August one thousand eight hundred and fifteen, and recorded among the Land records of the County aforesaid, together with the whole of those two parcels of ground described in the aforesaid assignments from the above named Solomon Etting to me (except that part of the parcel described in the said Indenture of the twenty second of October Eighteen hundred and two, which is covered by the easter most one of the aforesaid two Ware Houses, and the part thereof which lies in front of the said easter most Ware house between the same and the line of thereof the North side of Lovely Lane aforesaid, which parts parts or part so excepted bounds about twenty one feet on Lovely lane and extends Northerly for depth sixty feet, or thereabout: Also all that part of a Lot piece or parcel of ground situated on the South side of Baltimore Street in the City of Baltimore aforesaid bounding on the said street eighteen feet and extending Southerly for depth one hundred and three feet, six inches, which was conveyed in fee by Nicholas Rogers to me by Indenture bearing date on or about the fifth day of July one thousand seven hundred and eighty two and recorded among the Land records of Baltimore County aforesaid in Liber W.G. No. I., folio 94 &c. – Also all that part of a Lot piece or parcel of ground situated and lying on the North side of Baltimore street in the City of Baltimore aforesaid, bounding on the said street twenty one feet eleven inches and one half of an inch and extending Northerly for depth thirty three feet, which was assigned and transferred by the Commissioners of Baltimore Town to me, by Indenture bearing date on or about the third day of April one thousand seven hundred eighty seven, and recorded among the land records of Baltimore county aforesaid in Liber W.G. No. A.A. folio 272 &c the reversion and fee whereof was conveyed by Andrew Robinson to me by indenture dated on or about the twenty ninth day of April one thousand eight hundred and three and recorded among the Land records aforesaid in Liber W.G. No. 75 folio 655 &c – together with all and singular the improvements erected and made upon the grounds herein before devised to my said son jaames – to hold the same unto the said James Wilson his heirs and assigns forever. Item. I give and devise to my said son James Wilson his executors administrators and assigns, All that piece or parcel of Leasehold ground situated on the south side of an alley called Rogers’s Alley between Baltimore street and Lovely lane in the City of Baltimore aforesaid, bounding the said alley nineteen feet three inches and extending Southerly for depth thirty four feet nine inches which was assigned or underleased by Robert Moore to me by Indenture bearing date on or about the twenty seventh day of August seven teen hundred and eighty five and recorded among the land records of the County aforesaid in Liber W.G. No. X, folio 260 &c, subject to an annual rent of one shilling current money – Also all that piece or parcel of Leasehold ground situated to the Northward of Baltimore Street and to the westward of Gay street in the City of Baltimore aforesaid, which was assigned and transferred to me by John Talmon by Indenture dated on or about the seventeenth day of May in the year one thousand seven hundred and ninety one, and recorded among the Land records of Baltimore County aforesaid in LIber W.G. No. G.G. folio 4 &c, at and under the yearly rent of sixteen shillings and sixpence sterling money. The said piece or parcel of ground last described, being in rear of and immediately adjoining to the piece or parcel herein before mentioned to have been assigned and conveyed to me by the Commissioners of Baltimore Town and Andrew Robinson, and by me devised to my said son James in fee – To hold the said two pieces or parcels of Leasedhold ground with the improvements and appurtenances unto my said son James Wilson , his executors, administrators and assigns hence forth for an during all the rest and residue of the terms yet to come and unexpired therein with the benefit of renewal forever. – Whereas the piece or parcel of ground situated at the North East corner of Lombard and Sharpe streets purchased by me from Solomon Birckhead and herein before devised to my son James Wilson, was intended for the use of the First Baptist Congregation in the City of Baltimore now under the pastoral care of the Reverend Lewis Richards and the Reverend E. J. Reise for the purpose of building a House of Worship thereon; and as it is my wish that they should still have the offer of it for the purpose above mentioned, I do therefore will and direct that in case the said Congregation do within three years from the date of this my Will, pay to my said son James Wilson or his heirs, the amount of the consideration given by me for the said ground with interest on the same from the time of the purchase by me to the time of the payment by them, together with any incidental costs and charges, that may have accrued in relation thereto, he my said son James or his heirs, do and shall, convey the same ground to the said congregation for the use and purpose before expressed. – Item, I give and devise unto my son Thomas Wilson , his heirs and assigns, all that Lot or parcel of ground situated and lying on the East side of Sharpe street in the City of Baltimore aforesaid, bounding on the said street Four perches and one quarter of a perch, more or less, and extending Easterly for depth Nine perches, or thereabout, being the whole of the ground which was conveyed by Jacob Cromwell to me by Indenture bearing date on or about the twenty first day of April, one Thousand eight hundred and fifteen and recorded among the Land records of Baltimore County aforesaid in Liber W.G. No. 131 folio 2 &c. Also all that part of a Lot piece or parcel of ground situate and lying at the North East corner or intersection of Calvin Street and Lovely Lane in the City of Baltimore aforesaid, bounding on Calvert street twenty four feet and extending Easterly for depth one hundred feet which was assigned and transferred to me, by Solomon Etting, by Indenture bearing date on or about the thirty first day of May, one thousand eight hundred and eleven, and recorded among the Land records of the County aforesaid in Liber W.G. No. 114, folio 435 &c. – the reversion and fee whereof was together with and amongst other property granted and conveyed to me by Nicholas Rogers, by deed dated on or about the thirty first day of August one thousand eight hundred and fifteen, and recorded among the Land records of Baltimore County aforesaid – Also all that piece or parcel of ground situated and lying on the south side of Lovely Lane in the City of Baltimore aforesaid, bounding about twenty two feet on the said Lane and extending Southerly for depth eighty two feet six inches or thereabout, which was conveyed to me by Solomon Etting, by deed dated on or about the sixth day of April one thousand eight hundred and fifteen, and recorded among the Land records of Baltimore County aforesaid in Liber W.G. No. 131 folio 3, &c – Also the Ware House erected on the North side of Lovely Lane in the City of Baltimore aforesaid, upon a part of the ground assigned to me by Solomon Etting, by Indenture bearing date on or about the twenty second day of October, on ethousand eight hundred and two, and herein before referred to the reversion and fee where of was, to gether with and amongst other property , granted and conveyed by Nicholas Rogers to me, by deed dated on or about the thirty first day of August one thousand eight hundred and fifteen, and herein before also referred to, as also the ground covered by the said Ware house and the vacant space in front thereof, between the same and the line of the North side of Lovely lane the part hereby devised fronting on Lovely Lane about twenty one feet, and extending Northerly for depth to the north side of the Ware House sixty feet, or thereabout; (the ground in the rear, having been herein before devised to my son James, - Also all that Lot or parcel of ground situated lying and being on Dugans Wharf in the City of Baltimore aforesaid bounding on said Wharf thirty feet and extending Westerly for depth sixty five feet, which was granted and conveyed by Cumberland Dugan to me by deed dated on or about the fifteenth day of May, one thousand eight hundred and eleven, and recorded among the Land records of Baltimore County aforesaid in Liber W.G. No. 114, folio 429 &c, the Leasehold Estate wherein, which existed at the time of making the said deed, was merged by an assignment to me from Andrew Barge and others bearing date on or about the third day of July in the year one thousand eight hundred and eleven and recorded among the land records of Baltimore County aforesaid in Liber W.G. No. 114, folio 431 &c – Also three undivided fourth parts of that Lot or parcel of Land on ground situated and lying in Baltimore County aforesaid on the South side of the Basin on Northwest branch of Patapsco river, and in or near to the City of Baltimore, being part of a tract called “Gists Inspection” which was granted and conveyed by Moses Haslett to John Brown, Matthias Maris and myself by deed dated on or about the twelfth day of March one thousand seven hundred and eighty three, and recorded among the Land records of Baltimore County aforesaid in Liber W.G. No. L folio 488 &c, the said John Browns undivided fourth part whereof was conveyed together with and amongst other property, to me by his heirs by two several deeds, the one of them bearing date on or about the twelfth day of November in the year one Thousand eight hundred and two and recorded among the Land records of Baltimore County aforesaid, in Liber W.G. No. 74 folio 25 &c and the other one of them dated on or about the twenty second day of May, in the year one thousand eight hundred and four, and recorded among the same records in Liber W.G. No. 81 folio 65 &c. and also three undivided fourth parts of all that piece or parcel of Land or ground situated and lying in Baltimore County aforesaid, on the South side of the Basin, or North West branch of Patapsco river, and in or near to the City of Baltimore, being part of a Tract called Luns Lot, which by Indenture bearing date on or about the twenty fourth day of January seventeen hundred and eighty five, and recorded among the land records of Baltimore County aforesaid, in Liber W.G. No. 2, folio 421 &c, was granted and conveyed to John Brown Matthieas Maris and myself by Moses Haslet; the said John Browns undivided fourth part of which said last mentioned parcel of Land or ground was conveyed to me by his heirs by the two several deeds of the twelfth of November eighteen hundred and two, and twenty second of May Eighteen and four and herein before referred to – together with all and singular the buildings and improvements upon the said Lands and grounds erected made or being and all and every the appurtenances and advantages to them respectively belonging – To hold the same unto my said son Thomas Wilson his heirs and assigns forever. Whereas at the time I made the purchase from Jacob Cromwell of the ground situated on the East side of Sharpe Street and herein before devised to my son Thomas Wilson, it was my intention, that in case the First Baptist Congregation before named, in this my will, should become the purchasers of the Lot at the corner of Sharpe and Lombard streets, they should likewise have the offer of a part of the ground purchased from Cromwell, that is to say, a quantity not exceeding twelve feet front on Sharpe Street next adjoining the corner lot and extending easterly of equal depth therewith, to wit, about one hundred and twenty feet; Now it is my will and I do direct that my said son Thomas or his heirs shall convey to the said Congregation the said twelve feet of ground upon the like terms and conditions as are prescribed in relation to the said corner lot, provided they shall become the purchasers of that lot. – Item, I give and devise unto my daughter Hannah Levering, the wife of Peter Levering, of the City of Baltimore, Merchant, her heirs and assigns, All that part of a Lot, Piece or Parcel of ground situated, lying and being on the North side of Pratt street in the city of Baltimore, bounding on the said street, thirty six feet and extending Northerly for depth one hundred and thirty eight feet, which was assigned and transferred to me by Caleb Hall, by Indenture bearing date on or about the eighteenth day of February one thousand eight hundred and eleven, and recorded among the Land records of Baltimore County aforesaid, in Liber W.G. No. 112 folio 68 &c, the reversion and fee whereof was granted and conveyed by John Eager Howard to me by deed dated on or about the nineteenth day of February in the year eighteen hundred and eleven, and recorded among the Land records of Baltimore County aforesaid in Liber W.G. No. 112 folio 69 &c, also all that Piece or parcel of ground situated lying and being on the East side of Cheapside Dock or Canal, in the City of Baltimore aforesaid, fronting and bounding on the aforesaid Canal twenty feet, and extending Easterly for depth fifty feet which was granted and conveyed to me by Richard Lemmon by deed dated on or about the seventeenth day of August one thousand seven hundred and ninety one, an drecorded among the Land records of Baltimore County aforesaid, in Liber W.G. No. G.G. folio 296 &c. Also all that Piece or parcel of ground situated and lying on the west side of Franklin Lane in the City of Baltimore aforesaid which is contained within the metes and bounds, courses and distances following that is to say, Beginning for the same at the North east corner of the piece or parcel of ground last above described, and running thence Southerly bounding thereon and continuing the same direction to Pratt street then Easterly bounding on Pratt street Thirty five feet or thereabout to Franklin Lane, then Northerly bounding on the West side of Franklin Lane forty feet, and then Westerly to the beginning – being a part of the ground which was granted and conveyed to me by James Hutchings by deed dated on or about the fourth day of September one thousand seven hundred and ninety and recorded among the Land records of Baltimore County aforesaid, in Liber W.G. No. F.F. folio 74 &c. Also all that piece or parcel of ground situated lying and being on the east side of Calvert street in the City of Baltimore aforesaid, bounding on the said street twenty eight feet and extending Easterly for depth ninety feet which was granted and conveyed by Robert Courtenay and Elizabeth his wife and James A. Burland to me by deed dated on or about the tenth day of October in the year seventeen hundred and ninety eight and recorded among the Land records of Baltimore County aforesaid, in LIber W.G. No. 56 folio 206 &c. Also all those two parts or parcels of a tract of land called “Merrymans Lot” situated and lying in Baltimore County aforesaid, and near to the City of Baltimore containing together four Acres, three roods and thirty two perches and one half of a perch, or thereabout, bet the same more or less, which were granted and conveyed to me by Francis B. Brunelot by deed dated on or about the fourth day of May one thousand eight hundred and thirteen, and recorded among the Land records of Baltimore County aforesaid in Liber W.G. No. 123 folio 298 &c - Also three undivided fourth parts of all that Lot of ground number One situated and lying on Jones’s street in that part of the City of Baltimore aforesaid, called Old Town, which was granted and conveyed to John Brown Matthias Maris and myself by Thomas Yates, by Indenture bearing date on or about the twenty fourth day of December one thousand seven hundred and eighty three and recorded among the Land records of Baltimore County aforesaid in Liber W.G. R.R, folio 605 &c, which said Lot of ground number One has been leased out to several persons, and produces in the whole an annual rent of one hundred and thirty five dollars and eighty five cents; John Brown’s interest wherein was purchased by me from his heirs and paid for, but as yet I have only obtained a conveyance for a portion of that interest, that is to say, from Enoch and Jesse Levering and their wives, their deed to me bears date the second day of January one thousand and eight hundred and sixteen, and is recorded among the Land records of Baltimore County aforesaid – And also three undivided fourth parts of All that House and Lot of ground situated lying and being on Walnut street near to front street in the City of Philadelphia, in the State of Pennsylvania which were granted and conveyed to Matthias Maris and myself by Peter Moss and Catharine his wife by deed or Indenture bearing date on or about the twenty third day of August, one thousand seven hundred and eighty eight and recorded in the Office for recording of deeds for the City and County of Philadelphia in Deed Book No. 20, page 417 &c – Together with all and singular the buildings and improvement upon the said grounds and Lands erected made or being, and all and every the appurtenances and advantages to the same belonging or in any wise appertaining. To hold the same unto my said daughter Hannah Levering, her heirs and assigns forever. Item, I give and devise unto my son William Wilson Junior his executors, administrators and assigns, all that part of a Leasehold Lot piece or parcel of ground situated lying and being at the North east corner or intersection of Hanover and Conway streets in the City of Baltimore aforesaid bounding on Hanover street five perches and extending easterly for depth one hundred and thirty feet, which was assigned and transferred by John M. A. Zollickoffer and Caroline Zollickoffer to me at and under the annual rent of nine dollars by Indenture bearing date on or about the twenty ninth day of March one thousand eight hundred and ten, and recorded among the land records of Baltimore County aforesaid, in Liber W.G. No. 107 folio 8 &c; and the yearly rent issuing thereout by virtue of the underlease thereof hereinafter referred to subject however to an underlease thereof by me made to Joseph Leonard, bearing date on or about the eighteenth day of April one thousand eight hundred and fifteen and recorded among the Land records of Baltimore County aforesaid, whereby a clear annual rent of seven hundred and twenty dollars is reserved on the same ground over and above and in addition to the rent reserved by the said assignment to me. - Also all that piece or parcel of ground, situated lying and being on the North side of Baltimore Street in the City of Baltimore aforesaid bounding on the said street twenty five feet and extending Northerly for depth ninety five feet or thereabout – which was assigned and transferred to me by William MacCreary and Samuel Walker by Indenture bearing date on or about the third day of November Eighteen hundred and four and recorded among the Land records of Baltimore County aforesaid in Liber W.G. No. 81 folio 652 &c under and subject to an annual rent of four pounds thirteen shillings and nine pence sterling. – Also all that part of a Lot piece or parcel of ground situated lying and being on the south side of East street in the City of Baltimore aforesaid bounding on the said street twenty feet and extending Southerly for depth one hundred and fifteen feet, which was assigned and transferred from Edward Ireland and William Cole to me, by Indenture bearing date on or about the twelfth day of June in the year one thousand eight hundred and six, and recorded among the land records of Baltimore County aforesaid in Liber W.G. No. 90 folio 248 &c – under and subject to an annual rent of one shilling sterling together with all and singular the buildings and improvements upon the said three pieces or parcels of Lease hold ground, erected made or being – To hold the same unto my said son William Wilson his executors, administrators and assigns for and during all the rest residue and remainder of the several terms yet to come and unexpired in them by virtue of the original leases of and for the said grounds, with the benefit of renewal forever. Item, I give and devise unto my said son William Wilson his heirs and assigns, Three undivided fourth parts of that piece or parcel of ground situated o the East side of Cheapside dock or Canal in the City of Baltimore aforesaid, fronting on the said Canal for breadth of thirty feet and extending Easterly for depth fify feet, which was granted and conveyed in fee by Richard Lemmon and others to John Brown, Matthias Maris and myself by Indenture bearing date on or about the twelfth day of May one thousand seven hundred and eighty four, and recorded among the land records of Baltimore County aforesaid, in Liber W.G. No. I, folio 198 &c, the said John Brown’s undivided fourth part whereof was granted and conveyed with other property, to me by his heirs, by the two several deeds of the twelfth of November eighteen hundred and two, and the twenty second day of May Eighteen hundred and four and referred to in the preceding devise to my son Thomas Wilson – Also three undivided fourth parts of all that Piece or parcel of Ground situated on the West side of Franklin lane aforesaid, and bounding thereon thirty feet the same being a part of the ground which was graned and conveyed to me by James Hutchings by deed dated on or about the fourth day of September One thousand seven hundred and ninety and recorded among the Land records of Baltimore County aforesaid in Liber W.G. No. F.F. folio 74 &c, the interest of John Brown Wherein acquired by purchase from me was conveyed to me, by his heirs, by the aforesaid two several deeds of the twelfth of November Eighteen hundred and two, and twenty second of May Eighteen hundred and four – to hold the said three undivided fourth parts of the said two last described Pieces or parcels of ground with the ware house and other improvements upon the same, unto my said son William Wilson his heirs and assigns forever. – Item, I give and bequeath unto the Reverend Lewis Richards, if he should survive me, the sum of two hundred and fifty dollars. – Item, I give and bequeath unto Elizabeth Wilson, the daughter of my brother John of Limerick, the sum of seven hundred and fifty dollars. – Item, I give and bequeath unto the widow of my brother Thomas, late of Queens County in Ireland the sum of One thousand dollars. – Item. I give and bequeath to Maria Harden, the wife of Samuel Harden of Baltimore, the sum of one thousand dollars. – Item, I give and bequeath to Rachel Carson, the wife of Nehemiah Carson of Baltimore the sum of one thousand dollars. – Item, I give and bequeath to William Harden, of Baltimore, the sum of one thousand dollars. P Item, I give and bequeath to George Bull of Baltimore, the sum of Five hundred dollars. – Item, I give and bequeath unto the Reverend E.I. Reise of Baltimore, the sum of two h and fifty dollars; and in case any or either of the seven last named Legatees, should be now dead, or in the event of their dying, either before or after my decease, and before receiving the legacies to them given by this my will, then I will order and direct, that the legacy of the one or more of them, so dying, be paid to their respective heirs at law. – Item, I give and bequeath to my Niece Priscilla Stansbury, if she should survive me, eight shares of the joint stock or Capital of the Bank of Baltimore – Also a bed stead, bed and bedding – a bureau, side chairs and two looking glasses, being the furniture in her room, likewise two Mahogany tables, six silver Table Spoons, and six silver teaspoons. – Item, I give and bequeath my Gran daughter Jane Wilson Levering, Ten thousand dollars of United States Stock bearing interest of six per cent. – Item, I give and bequeath to my Gran daughter Lydia Levering,Ten thousand dollars of United States Stock, bearing an interest of six per cent: to be transferred and delivered to her upon her attaining the age of sixteen years; and I do will and direct that in the mean time the interest thereof be invested in Stock by her father Peter Levering, in her name, and for her use. – Item, I five and bequeath to the Committee of the First Baptist Church in the City of Baltimore, now under the pastoral care of the Reverend Lewis Richards and the Reverend E.I. Reise, Four shares of the joint Stock on Capital of the Bank of Baltimore. – to hold in trust, that the dividends thereof from time to time, be by the said Committee at their discretion, distributed amongst the widows belonging to and in full communion with the said Church and who in the opinion and judgement of the said Committee, may stand in need of the same. – Item, I give and bequeath to the Committee for building a new Church for the first Baptist Congregation in the City of Baltimore, now under the pastoral cares of the Reverend Lewis Richards and the Reverend E.I. Reise the sum of two thousand dollars to be applied towards the building of such Church for the said Congregation, Provided they commence the said Building within three years from the date of this my Will; which said sum hereby bequeathed is over and above and in addition to the sum of three thousand dollars already subscribed by me for the same purpose: And which said sum of Three thousand dollars, if unpaid at the time of my decease, I direct shall be paid by my executors out of my estate. And I direct that the foregoing Legacies be paid without interest, by my Executors at the end of six months after my decease. – Item, I hereby liberate and forever set free, my negro man named Stephen, his emancipation to take effect at the end of six years after my decease. - Item, Should I sell or in any manner dispose of any of the property herein before devised to any or either of my children, the one of them to whom the same is devised on his or her heirs, shall receive, in lieu thereof, the amount of the sale, with Interest thereon from the time the purchase money may have been paid; and if I should improve any of the said property, the costs of the improvements without interest shall be a charge against, and shall be paid by, the one of them my said children, to whom the said property so improved may have been devised. – Item, to each of my Grand children that may be living at the time of my decease, I give and bequeath the sum of two thousand dollars, which I direct may be invested by ttheir respective parents in stock for their benefit to tbe paid and transferred to them respectively as they attain their lawful ages; and if any of my said Grand Children shall depart this life under age and without issue, then I give the portion of the one or more of them so dying, to its or their surviving Brothers and Sisters equally. – Item. After the payment of my debts and of the legacies given by this my Will, I give devise and bequeath all the rest, residue and remainder of my estate and property real personal and mixed to my four children, namely, James Wilson, Thomas Wilson, Hannah Levering and William Wilson Junior., to be equally divided between them share and share alike, deducting however, from the portion of my daughter Hannah Levering, the two Legacies of Six per cent United States Stock amounting to twenty thousand dollars herein before bequeathed by me to her daughters Jane and Lydia; as it is my intention that her portion of the residue of my estate inclusive of the amount of those two legacies shall only equal that of either of my other children. To hold the said rest residue and remainder of my estate and property unto my said four children, their heirs, executors, administrators and assigns, as tenants in common, forever. – And it is my particular request that my children make the division among themselves without any valuation or appraisement, by authority of law – for which purpose my executors may dispose of any part of the said rest and residue of my property that cannot be conveniently divided and I request my executors to proceed in the division thereof as early as may be practicable. – Item, It is my Will and desire that my Executors give bond for the payment of Debts and Legacies and for the due distribution of my Estate according to this my Will, and that there be an appraisement or Inventory of my personal Estate returned to the Orphans Court. And Lastly, I do hereby nominate, constitute and appoint my sons James Wilson and Thomas Wilson to be executors of this my last Will and Testament revoking and annulling former wills by me at any time heretofore made, ratifying and confirming this and none other, to be my last will and testament. – In testimony whereof I have hereunto subscribed my name, and affixed my seal, on this twenty eighth day of February in the year of our Lord one thousand eight hundred and sixteen. Alexander Yearly Zebn Waters, Charles Crook Junr Whereas, I William Wilson, of the City of Baltimore, Merchant, have made and duly executed my last will and Testament bearing date the twenty eight day of February one thousand eight hundred and sixteen, Now I do hereby declare this present writing to be as a Codical to my said Will and direct the same to taken as part thereof, hereby ratifying and confirming my said will in everything, except where the same is herby revoked and altered – Reflecting on the sudden and unexpected reverses of Fortune which are daily occurring in the Commercial World, and against which the greatest prudence and caution are not always sufficient safeguards, and being desirous of placing that part of my property which I intend for my daughter Hannah Levering beyond the control of these accidents, I hereby give, devise and bequeath to my sons James Wilson and Thomas Wilson, and the survivor of them, and the heirs, executors and administrators of such survivor, All and singular the houses, lots of ground, Stocks, monies and other Estate which are given and devised in and by my said Will to my aforesaid Daughter Hannah Levering,, In trust, that they the said James Wilson, and Thomas Wilson, and the survivor of them, and the heirs, executors, and administrators of such survivor shall hold and be possessed of all and singular the last mentioned houses, lots of ground, stocks, monies, and other estate, upon the several trusts, and to and for the several ends, intents and purposes, and under and subject to the several powers and provisos herein after expressed and declared of and concerning the same (first deducting therefrom the amount of my debt or sums of money which may be due or owing, or contracted by her husband Peter Levering to me in my individual right, or to the partnership of William Wilson and sons, for loans or advances of money, or for promissory notes or other securities given or endorsed for his use or accommodation, or in any other way) that is to say, Upon Trust that they do and shall during the natural life of my said daughter Hannah, pay to or permit and suffer my said daughter to receive or to take the interest, dividends, rents, issues and income of the said property and estate, to the interest that the same may be for her sole and separate use, and may not be subject to the debts, control or engagements of her husband; And further that all the said property and estate hereinbefore mentioned shall be held, taken and enjoyed by such person and persons, and for such use and uses, as she the said Hannah may at any time or times hereafter during her life, limit, devise, order or dispose of the same, either by her last Will and testament, or by any other writing whatsoever, signed with her hand, in the presence of two or more credible witnesses; and in case my said Daughter shall die without making such disposal or appointment of said property, either by last Will or by an instrument of writing executed as aforesaid, then upon Trust, that they my said Trustees, and the survivor of them, and the heirs executors and administrators of such survivor shall -----and be posses of all and singular the houses, lots of ground, stocks, monies and other estate herein before devised to my said daughter Hannah, for all and every the child and children of my said daughter, to be equally divided among them share and share alike; the share or shares of such of them as shall be a daughter or daughters to be transferred and delivered over to her or them respectively, on her or their attaining their respective ages of eighteen years, for their exclusive use and benefit, and without being subject to the debts, control or engagements of their respective husbands, with the like powers and authorities to dispose of the same by last Will and Testament or by any instrument of writing executed in the presence of two witnesses, as are reserved to my said daughter Hannah their mother; and the share or shares of such of them as shall be a son or sons, to become vested in him or them respectively on his or their attaining their respective ages of twenty one years: Provided Nevertheless and I do herby expressly declare, that in case any such Child or Children of my said daughter shall have left lawful issue, then my Will is that such issued shall have and be entitled to such share or shares of and in the said Lots, Houses, and personal estate aforesaid, as his, her or their deceased parent or parents would have been entitled to under this my Will, if living, such share or shares to be transferred to such issue at such age or time, and in such manner as is herein before declared with respect to the transfer and delivery of their parents shares. Whereas since the making of my aforesaid Will my Gran daughter Jane W. Levering has intermarried with Mr. Leonard Matthiews and I have since the making of my Will aforesaid conveyed and settled upon my said Gran daughter, to her exclusive use and benefit certain real property in the City of Baltimore amounting in value to Twelve thousand Dollars; Now I do hereby revoke and annul the said Legacy of Ten thousand dollars given and devised to my said Gran daughter, as also the Legacy of two Thousand dollars given to the said Jane as one of my Grand Children that might be living at the time of my death, both the said Legacies having been paid and satisfied in the manner above stated; But it is to be understood that the revocation of the said Legacies, as also the Legacy of Ten thousand dollars, herin after given to my said two sons James and Thomas, in trust for my two Gran daughters, Lydia and Louisa, shall not in any way operate to prevent my daughter Hannah from being charged with the sum of Twenty thousand dollars as provided for in my said Will precisely as if the aforesaid Legacies had not been revoked. – Whereas have given and bequeathed in my aforesaid Will, Ten Thousand dollars in six percent United States Stock, to my Gran daughter Lydia Levering Now I hereby revoke and annul the said Legacy, and do by this my Codicil give and bequeath to my sons James and Thomas, and the survivor of them, the sum of Ten thousand dollars in six per cent United States Stock, to be held by them, and the survivor of the, In trust for my two Gran daughters Lydia and Louisa Levering in equal shares for their exclusive use and benefit, and without being subject to the Control engagements, debts or contracts of any future husbands they may respectively have, the Capital or principal, and the interest whereof to be paid to them respectively on their attaining the ages of eighteen years. – I give and devise to the Reverend John Healy one hundred dollars. – I hereby revoke and annul the Legacy heretofore given by my said will to George Bull. – I give and devise to my niece Catharine Jones of Limerick in Ireland the sum of Five hundred dollars. – In all cases where Legacies are given by my said Will or Codicil, it is to be understood that if any sums shall be charged on my books as advanced to any of the Legatees, the same shall be deducted from the amount of their respective Legacies, and be considered as a payment by anticipation. In Testimony whereof I hereunto subscribe my name, and affix my seal, on this Tenth day of July in the year of our Lord one thousand eight hundred and nineteen. Wm. Wilson Whereas, I William Wilson of the City of Baltimore, Merchant, have made and executed my last will and testament, bearing date the twenty eighth day of February one Thousand eight hundred and sixteen, and afterwards on the tenth day of July one thousand eight hundred and nineteen executed and annexed a Codicil to my said Will, Now I do hereby declare this present writing to be a second Codicil to my said Will, and direct the same to be taken as part thereof, hereby ratifying and confirming my said Will and first Codicil thereto, in everything except where the same are hereby revoked and altered. And Whereas since the making of said Will and former Codicil, circumstances have occurred in relation to the affairs of my son William Wilson which make it necessary that I should change and modify the disposition of the property and Estate by my said will devised to him – And therefore I do hereby revoke annul and make void the several devises and bequests contained in my aforesaid Will and former Codicil to my said son William; and in lieu thereof do now proceed to make the following limitation and settlement, that is to say, I give and devise unto my sons James Wilson and Thomas Wilson and their heirs forever, All that part of a Leasehold Lot, piece or parcel of ground situate lying and being at the North East corner or intersection of Hanover and Conway Streets in the City of Baltimore, bounding on Hanover Street five perches, and extending Easterly for depth one hundred and thirty feet, which as assigned and transferred by John M.A. Zollickoffer and Caroline Zollickoffer to me at and under the annual rent of Nine dollars by Indenture bearing date on or about the twenty ninth day of March one thousand eight hundred and ten, and recorded among the Land records of Baltimore County aforesaid in Liber W.G. No. 107 folio 8 &c, and the yearly rent issuing thereout by virtue of the underlease thereof herin after referred to: Subject however to an underlease thereof by me made to Joseph Leonard bearing date on or about the eighteenth day of April one thousand deight hundred and fifteen, and recorded among the Land records of Baltimore County aforesaid, whereby a clear annual rent of Seven hundred and twenty dollars is reserved on the same ground over and above and in addition to the rent reserved by the said assignment to me. Also all that piece or parcel of ground situate and lying on the North side of Baltimore street, in the City of Baltimore aforesaid, bounding on the said Street Twenty five feet and extending Northerly for a depth Ninety five feet, or thereabout, which was assigned and transferred to me by William MacCreery and Samuel Walker by Indenture bearing date on or about the third day of November Eighteen Hundred and four, and recorded among the Land records of Baltimore County aforesaid in Liber W.G. No. 81, folio 652 &c – under and subject to an annual rent of four pounds thirteen shillings and nine pence Sterling. – Also all that part of a Lot, Piece or parcel of ground situate, lying and being on the South side of East Street I the City of Baltimore aforesaid, bounding on the said Street twenty five feet, and extending Southerly for depth one hundred and fifteen feet, which was assigned and transpferred by Edward Ireland and William Cole to me by Indenture bearing date on or about the twelfth day of June in the year one thousand eight hundred and six, and recorded among the Land records of Baltimore County aforesaid in Liber W.G. No. 90 folio 248 &c under and subject to an annual rent of one shilling Sterling. – Also, all that piece or parcel of ground situate on the East side of Cheapside street formerly Cheapside Dock or Canal I the City of Baltimore aforesaid, fronting on the said street for breadth thirty feet and extending Easterly for depth fifty feet, which was granted and conveyed in fee by Richard Lemmon and others to John Brown, Matthias Maris and myself, by Indenture bearing date on or about the twelfth day of May one thousand seven hundred and eighty four and recorded among the Land records of Baltimore County aforesaid in Liber W.G. No. I. folio 198 &c, the said John Brown’s undivided fourth part whereof was granted and conveyed with other property to me, by his heirs, by two several Deeds of the twelfth of November Eighteen hundred and two, and the twenty second of May eighteen hundred and four, and referred to in the devise contained in my aforesaid Will, to my son Thomas Wilson. Also all that piece or parcel of ground situate o the West side of Franklin Lane in the City of Baltimore aforesaid immediately to the Eastward of and adjoining the parcel last above described being of equal breadth therewith and extending thererfrom about thirty five feet to Franklin lane aforesaid and bounding thereon thirty feet, the same being a part of the ground which was granted and conveyed to me by James Hutchings by Deed dated on or about the fourth day of September one thousand seven hundred and ninety and recorded among the Land records of Baltimore County aforesaid in Liber W.G. No. F.F. folio 74 &c the interest of John Brown wherein acquired by purchase from me, was conveyed to me by his heirs by the aforesaid two several deeds of the twelfth of November eighteen hundred and two, and twenty second of May Eighteen hundred and four – the former interest of the above named Matthias Maris in which said two last described parcels of ground was conveyed to me subsequently to the making of my aforesaid Will – by George Maris by Deed recorded among the records of the County aforesaid. And also the one fourth part devised by my aforesaid Will to my said son William of and in the rest, residue and remainder of my Estate and property real, personal and mixed thereby mentioned to be devised to and amongst my four Children equally after the payment of my debts and the legacies given by said Will – to hold all and singular the Estate and property herein before by this Codicil devised – In trust to pay and apply the clear annual income and interest of the same to the support and maintenance of my said son William Wilson and his family during his life time: without being subject to the payment or performance of the debts, contracts or engagements of my said son William or liable in any manner to the control of his Creditors, either in his individual or partnership character or capacity; and at his death then In trust, to divide the same in equal proportions among all the children of my said son William; their respective shares to be paid and delivered over that is to say, to the sons of my said son William when they shall severally have attained the age of Twenty one years, and to his daughters when they shall severally have attained the age of Eighteen years – the shares of such of them as shall die before the period above assigned for payment an delivery over as aforesaid, and without leaving issue, to belong to the survivors – But subject to the payment thereout, that is to say, out of the whole estate and property herein before devised in trust, of one fourth part of the clear income of the same, to the wife of my said son William, if she shall survive him, such payment to continue during her widowhood only. – Whereas, the House and Lot on East street so as before devised in trust, is at present Mortgaged to the Bank of Baltimore, to secure the payment of a debt or sum of money due and owing by the firm of Wilson, Mullikin and Company – Now my will and desire is, that if the said property should not be redeemed by the payment by the firm of Wilson Mullikin and Company, of the debt so as aforesaid due to the Bank of Baltimore, my Executors shall purchase the said property at what may be deemed by them its fair value; and if this shall be found impracticable, then it is my will and desire that my said Executors shall purchase other property I nthe City of Baltimore of equal value, and shall hold the same for the use and benefit of my son William and his family under the like Trusts and subject to the same Conditions as are herein before limited and expressed: And I expressly charge and direct that what ever sum of money may be applied by my Executors in the purchase of the property in manner above said shall be deducted and taken from the amount of the undivided interest in the residuary part of my estate which is herein before devised for the benefit of my son William and his family. It is also my will and desire, and so I expressly direct, that whatever sums of money may be due or owing, or contracted for by my said son William either in his individual right, or as a partner of the firm of Wilson Mullikin and Company, or of any other Copartnership, to me in my individual right, or to the firm of William Wilson and Sons, for loans or advances of money, or for promissory notes, or any other securities given, indorsed or entered into for the use or benefit of the said William Wilson Junior, in his individual or Copartnership (pages 30 and 31 are missing.)
