BOND, of Baltimore City and the State of Maryland, being of sound and disposing mind, memory and understanding, do hereby make, publish and declare this my Last Will and Testament, hereby revoking all other Wills and codicils heretofore made by me. ITEM ONE: I direct my Executors hereinafter named to pay my just debts and funeral expenses as promptly as possible after my death. I authorize and empower my Executors to expend such sums for my funeral and interment as they may deem fitting and proper without regard to any limit that may be prescribed by law and without application to the Orphans' Court of Baltimore City or any other Court for authority in respect thereto. ITEM TWO: I direct my Executors to pay all Federal and Maryland estate taxes assessed by reason of my death whether on my estate, jointly held property, life insurance proceeds, or otherwise, and all Maryland inheritance taxes whether upon any legacy or devise hereunder, jointly held property, or otherwise, out of my estate at the time of my death. ITEM THREE: I give and bequeath to my dear cousin, Mary Etta Stewart, the sum of Two Hundred and Fifty Dollars ($250.00), if she is living at the time of my death. ITEM FOUR: I give and bequeath to my dear cousin, Eleanora Peaco, daughter of Mary Bell Peaco, the sum of Two Hundred and Fifty Dollars ($250.00), if she is living at the time of my death. ITEM FIVE: I give and bequeath to my dear cousin, Dora Presbury, wife of Kenton Presbury, in Darlington, Maryland, the sum of Two Hundred and Fifty Dollars ($250.00), if she is living at the timeof my death. ITEM SIX: I give and bequeath to my friend, Lloyd Peters, the sum of Two Hundred and Fifty Dollars ($250.00), if he is living at the time of my death. ITEM SEVEN: I give and bequeath to Monumental Lodge of Elks No. 3, Baltimore, Maryland, a body corporate, all my elks' heads, elks' pictures and paraphernalia, located at my office, home or elsewhere. ITEM EIGHT: (a) I give and bequeath to my faithful and trusted secretary, Loretta Wallace, for and during her natural life, my leasehold property, the improvements on which are known as 525 Sanford Place, Baltimore, Maryland, and I direct that she pay all expenses on said property including, but not by way of limitation, all taxes, fire and other proper insurance and the cost of all necessary and reasonable repairs. From and after the death of Loretta Wallace, I give and bequeath said leasehold property known as 525 Sanford Place, Baltimore, Maryland, to Howard University, a body coporate, situate in the City of Washington, District of Columbia, for the purposes more particularly set forth in ITEM THIRTEEN hereof with respect to the rest, residue and remainder of my estate. (b) I also give and bequeath to my secretary, Loretta Wallace, all of the stock which I may own at the time of my death in the Banneker Building Company, a body corporate, 14 E. Pleasant Street, Baltimore, Maryland, and all of my right, title and interest in said Banneker Building Company, for life, and after her death unto Howard University, a body corporate, situate in the City of Washington, District of Columbia, for the purposes set forth in ITEM THIRTEEN hereof with respect to the rest and residue of my estate. It is my intention that my said secretary, Loretta Wallace, shall be entitled to receive any and all dividends declared on said stock during her lifetime without power to sell the said stock or other right, title or interest of mine in said body corporate except with the consent of said Howard University, a body corporate, to which I have given said stock after the death of said Loretta Wallace. (c) I also give and bequeath to my secretary, Loretta Wallace, my diamond horsehoe stick pin, my diamond ring, the little Mosler safe which is now in my private office at 14 E. Pleasant Street, the electric I. B. M. typewriter, chair and desk which she is now using, the Burroughs Adding Machine and all furniture and articles located in Room No. 12 in the Banneker Building, 14 E. Pleasant Street, absolutely. ITEM NINE: I give and bequeath all of the hard-bottom chairs now in my office at 14 E. Pleasant Street, to the Trustees of Sharp Street Methodist Church, to be used in the room in which the Board of Trustees of said Church meets. ITEM TEN: I give and bequeth to the Fairview African Methodist Church, located near Forest Hill, Hartford County, Maryland, the sum of One Thousand Dollars ($1,000.00). ITEM ELEVEN: I give and bequeath all of my books of every kind or character to Howard University, a body corporate, situate in the City of Washington, District of Columbia, for the use of its library. It is my desire and I hereby request my Executors to arrange with my friend, Lloyd Peters, to deliver said books to Howard University and to compensate my said friend, Lloyd Peters, for this service, and the cost of transporting said books or other expenses incident thereto shall be paid by my Executors out of my estate. ITEM TWELVE: I direct my said Executors to sell at public sale to the highest bidder all other furniture and tangible personal property not hereinabove bequeathed which may be found at my home or my office in the Banneker Building, 14 E. Pleasant Street, Baltimore, Maryland, the proceeds of such sale or sales to fall into and become a part of the rest and residue of my estate. ITEM THIRTEEN: All the rest, residue and remainder of my property and estate of whatsoever kind or character and wheresoever situate, I give, devise and bequeath unto Howard University, a body corporate, situate in the City of Washington, District of Columbia, for the establishment of a "Loan Fund" as a memorial to myself and my deceased wife, Elvira M. Bond, to be known as the "Roy S. and Elvira M. Bond Memorial Fund" and to be administered separately by a committee or board of trustees to be appointed by the President of Howard University. It would be pleasing to me if my dear friend, Dr. Ralph J. Young, could be appointed by the President of Howard University to constitute one of the Board of Trustees to administer said fund, if he is living at the time of my death, but if he is then deceased, I suggest that his daughter Lois Young, be appointed a member of the Board of Trustees in place of her father, Dr. Ralph J. Young. My intention in establishing this fund is to authorize the Board of Trustees to make loans from time to time to worthy and needy students to be evidenced by their personal promissary notes, with interest at moderate rates. While I do not desire to restrict such loans absolutely to the income of this fund, it is my intention that the principal of the fund should be kept intact so far as possible and that such loans to any one student be reasonable in amount considering all the circumstances. With the above suggestions, I am quite satisfied to leave the administration of the fund to the discretion of the Board of Trustees to be appointed by the President of the University with permission, however, to the University, if at any time in the future the interests of the University seem to require it, to use this fund for such other purposes of the University as its Board of Trustees may deem right and proper. ITEM FOURTEEN: (a) I hereby appoint my secretary, Loretta Wallace, and The First National Bank of Baltimore, the Executors of this my Last Will and Testament, and I direct that my secretary, Loretta Wallace, shall be excused from the necessity of giving bond for the faithful performance of her duties as Executrix. (b) During the administration of my personal estate, I hereby confer upon my Executors full power and authority to sell, assign, transfer, convey, exchange, divide, invest, reinvest, mortage, lease, or otherwise deal with or dispose of any part of my estate, real, or personal, not herein specifically bequeathed, whenever they may deem such action advantageous to my estate, without application to the Orphans' Court of Baltimore City, or any other Court for authority in respect thereto. (c) I also confer upon my Executors full power to compromise any claims against or in favor of my estate for such sums and upon such terms and conditions as they may deem proper, without application to the Orphans' court of Baltimore City or any other Court for the approval thereof. (d) My secretary, Loretta Wallace, is thoroughly conversant with my business affairs and has been collecting the rents fom my leasehold properties and arranging for the necessary repairs thereto, and it is my desire that she be permitted to continue the collection of said rents and arranging for the necessary repairs to said leasehold properties, and that she receive for said services in addition to the commissions which may be allowed to her as co-Executor by the Orphans' Court the sum of ten per cent. (10%) of the gross amount of rents collected during the period of the administration of my personal estate and I hereby request and direct my Executors to make application to the Orphans' Court of Baltimore City for authority to employ my said secretary, Loretta Wallace, to collect said rents and arrange for the necessary repairs to said leashold properties at a commission of ten per cent. (10%) for such services and upon such other terms and conditions as the Orhans' Court of Baltimore City may by its order provide. After the administration of my personal estate shall have been completed, it is my desire and I hereby request Howard University, to which I have devised and bequeathed the rest and residue of my estate, to permit my said secretary, Loretta Wallace, to collect the rents and arrange for the necessary repairs to the leasehold properties as long as said properties or any of them may be held by said Howard University. Lafayette Ave. Truly Hatchett - residing at 2026 Druid Hill Ave. Additional Comments: BOND LEAVES SCHOOL FUND - Lawyer Sets Up Trust at Howard University Howard University, in Washington, will receive nearly all of the estimated $103,00 estate of Roy S. Bond, well-known Negro attorney, according to terms of the will which has been filed for probate in Orphans' Court. Mr. Bond because of his large physique and active practice particularly in the divorce field, was well known in courthouse circles. He died July 25. The will executed in January 1954, created the Roy S. and Elvira M. Bond Fund from which needy students at Howard University will be able to borrow educational funds at low interest rates. Mr. Bond also provided that the university trustees may use the legacy for other purposes. The attorney graduated from Howard University in 1914 and began practicing law here the next year. He was active in the school's alumi association. Mr. Bond also left $1,000 to the Fairview African Methodist Church, Forest Hill, Hartford county, and all the hard-bottomed chairs in his office in the first block East Pleasant street to the trustees of Sharp Street Methodist Church to be used in the room where the board of trustees meets. He bequeathed all his books to the Washington, D. C. university and certain fraternal paraphernalia to the Monumental Lodge of Elks. No. 3. Mr. Bond remembered his "faithful and trusted" secretary Loretta Wallace, leaving her life interest in property in the 500 Block Sanford place, and a similar interest in his stock in the Banneker Building Company. At her death, those assets will become a part of the bequest to Howard University. Four relatives or friends were left a total of $1,000. Mr. Bond's secretary and the First Natioanl Bank were named executors of the estate.
