Below is my transcript of the original will: Source Citation: Maryland State Archives, Annapolis, Maryland Liber 24, folio 197 28 May 1745 In the name of God Amen. I John Powell of Annarundel County near Herring Bay being sick & weak but of perfect mind & memory, Do make this my last will & Testament in manner & form as followeth. First I give my soul to God who gave it me & my body to be Decently Buryed at the Discretion of my Executrix hereafter named. 2dly-- my will & pleasure is that all my just Debts be honestly & punctually paid. 3dly-- I give & bequeath unto my Daughter Elizabeth Powell all of the Land that my brother William Powell possest and the Land where I now live so far as a branch that runs between where I now live & that plantation that I now Rent to James Trott containing Two Hundred acres more or less & Known by the name of Gory Banks to her & her heirs Lawfully begotten for Ever. 4thly--- I give & bequeath to my Daughter Wilhelmina all the other part of Land Called Gory Banks that is on the north Side of the branch aforesaid to her & her heirs lawfully begotten for Ever, But if Either of my Daugh =ters Should Dye without heir Lawfully begotten, then She that Survives Shall Injoy all my Lands & her heirs for Ever as aforesaid. 5thly-- My will is that my wife take her whole Third of lands out of that part which I give to my daughter Elizabeth & have no part of third in that part of land which I give to my Daughter Wilhelmina. 6thly I give & bequeath to my Loving wife all my personal Estate During her widdowhood, but if she marrys then to have but a Third of my Estate, and I do hearby appoint her to be whole & sole Executrix of this my last will & Testament, Revoking all other wills & Testaments heretofore made by me, in Testimony where of I hereto sett my hand & Seal this 28 Day of May 1745 Signed Seal'd & acknowledged in the presence of us {memorandm my will is that my wife have my Dwelling house & third of Land adjoining. his mark James X Trott his mark his mark John Powell William X Stone X his mark William X Tanqueray On the 8th Day of July 1745 came Amos Trott and Abraham Tanqueray two of the subscribing Witnesses to the within Will who being duly and solemnly sworn on the Holy Evangels of Almighty God Depose and Say that they Saw the Testator John Powell ---- Sign & Seal the within will and heard him Publish and Declare the Same to be his Last Will and Testament that at the time of his so Doing he was to the both of their Judgment and apprehension of Sound & disposing Mind & memory and that the said signed that made his mark & the said Abraham Tanqueray Subscribed his name as witnesses to the Said will in the presence of the said Testator and at his request and they further Depose and say that they saw william Stone the other witness make his mark as a witness of the Said Will in the Presence of the Said Testator & at his request---.
