I Adam Bish of Carroll County in the state of Maryland, being weak and sick in body but of sound and disposing mind, memory and understanding, considering the certainty of death and the uncertainty of the time thereof and thereby be the better prepared to leave this world when it shall please Almighty God to call me hence, Do therefore make and publish this Instrument of writing to be my last will and Testament in manner and form following, that is to say, First and principally I commit my soul into the hands of Almighty God and my body to the earth to be decently buried at the discretion of my Executor hereinafter named, and after my just debts, funeral charges and insitental (sic) expenses are paid I give and bequeath unto my beloved wife Elizabeth Bish, all my goods, chattels and personal estate of every discription (sic) that I may be seized and possessed of at the time of my death, except so much thereof as may be necessary for the payment of my just debts, funeral charges and all insidental (sic) expenses. And I also authorize and empower my said Executor herein after named to sell at public sale (without an order from the Orphans Court) so much as may be necessary of my outstanding debts due and becoming due to me, on Bonds, notes, Book accounts, or otherwise, for the payment of my said debts, funeral charges, and expences (sic) with full power and authority to carry out the true intent and meaning of this my last will and Testament. And lastly I do hereby constitute and appoint my Son William Bish to be sole Executor of this my last will and Testament revoking and annulling all former wills by me made ratifying and confirming this and none other to be my last will and Testament. In testimony whereof I the said Adam Bish have hereunto set my hand and affixed my seal, on this Second day of April Eighteen hundred and fifty. Adam Bish (his signature and seal) Signed, sealed, published and Declared by Adam Bish the above named Testator as and for his last will and Testament in the presence of us, who at his request, in his presence, and in the presence of each other have subscribed our names as witnesses thereto. Henry Hoppe State of Maryland, Carroll County, to wit: On the 9th of September 1854, before the Orphans Court for Carroll County came William Bish, the person who exhibited the aforegoing instrument of writing, and in open Court made oath on the Holy Evangely of Almighty God, that the same is the true, whole, and last will and Testament of Adam Bish, late of Carroll County deceased: That the same came to his hands and possession by receiving it since Testator’s death, from J. Henry Hoppe, to whom Testator had delivered it for safe keeping: And that he does not know of any other will or codicil, left by said deceased. Test. Jos. M. Parke, Register Maryland, Carroll County, To wit: On the 9th day of September 1854, before the Orphans’ Court for Carroll County, came Joshua Wisner and J. Henry Hoppe two of he subscribing witnesses in and to the aforegoing last will and Testament of Adam Bish, late of Carroll County deceased, and in open Court, made oath on the Holy Evangely of Almighty God, that they did see Adam Bish, the Testator in said Will named, sign and seal said Will: That they heard him publish, pronounce and declare the same to be his last will and Testament: That at the time of so doing he the said Adam Bish, was, to the best of their apprehensions, knowledge and belief, of sound and disposing mind, memory and understanding: And that they, together with Alfred W. Bish, the other subscribing witness to said will, subscribed their respective names, as witnesses to said will, at the request of the said Testator, in his presence, and in the presence of each other.
