I Elizabeth Bish of Carroll County in the State of Maryland, being old and weak in body but of sound mind, memory and understanding, considering the certainty of death, and the uncertainty of the time thereof, and being desirous to settle my worldly affairs, and thereby be the better prepared to leave this world when it shall please Almighty God to call me hence, do therefore make and publish this my last will and testament in manner and form following, (that is to say). After the payment of my debts and funeral charges, I give and bequeath as follows. To wit: First I order and direct that all my goods and chattles (sic) of every discription (sic) that I may be seized and possessed of at the time of my death, I order and direct the same to be sold at public sale, by my Executor hereafter named, and the collection of my outstanding debts due and owing unto me, on notes, accounts or otherwise after the payments of my debts and funeral charges the balance remaining in my Executors hands I give and bequeath the one half thereof, to my son Daniel Bish and his heirs, and the other one half thereof I give and bequeath unto my son William Bish and his heirs, that is, to be equally divided between them, the said Daniel Bish and William Bish, share and share alike; And lastly I do hereby nominate, constitute and appoint my son William Bish sole Executor of this my last will and Testament. In testimony whereof I have hereunto subscribed my name and affixed my seal, on the 28th day of October in the year of our Lord 1854. Elizabeth Bish (her mark and seal) Signed, sealed, published and declared by Elizabeth Bish as and for her last will and Testament in the presence of us, who at her request, and in her presence, and in the presence of each other have subscribed our names as witnesses hereunto as hereby appears. J. Henry Hoppe Ephraim S. Bish Maryland, Carroll County, to wit: On the 27th day of March 1860, before the Orphans Court for Carroll County, came William Bish, the person who exhibited the aforegoing instrument of writing, and in open Court, made oath on the Holy Evangely of Almighty God, that the same is the true and whole last will and Testament of Elizabeth Bish, late of Carroll County deceased: That the same was delivered by Susan Fowler, Sister of the Testatrix, after the death of the Testatrix in deponent’s presence, to Levi Yingling to be read; that said Levi Yingling then delivered the same to deponent; and that he does not know of any other will, or codicil, left by said deceased. Test. Jos. M. Parke, Register Maryland, Carroll County, To wit: On the 27th day of March 1860, before the Orphans’ Court for Carroll County, came J. Henry Hoppe and Ephraim S. Bish, the two subscribing witnesses to the aforegoing last will and Testament of Elizabeth Bish, late of Carroll County deceased, and in open Court, made oath on the Holy Evangely of Almighty God, that they did see Elizabeth Bish, the Testatrix in said will named, sign and seal said will, setting her mark thereto: That they heard her publish, pronounce and declare the same to be her last will and testament: That at the time of so doing she the said Elizabeth Bish, was, to the best of their apprehensions, knowledge and belief, of sound and disposing mind, memory and understanding: And that they subscribed their respective names, as witnesses to said will, at the request of the said Testatrix, in her presence, and in the presence of each other.
