I Samuel Bixler of Frederick County and State of Maryland Farmer being weak in Body but of sound mind and memory thanks be given unto Almighty God calling to mind the mortality of my body do make and ordain this my last will and Testament in the following manner and form that is to say, First of all I Command my soul into the hands of Almighty god that gave it and my Body I recommand (sic) to the Earth to be buried in Decent Christian Burial at the discretion of my Executors and as for my Worldly Estate whosowith it has pleased god to bless me with in this life I give Devise and dispose of the Same in the following manner and form – It is my will and pleasure that my Wife Elizabeth shall have ninety pounds Specie out of my Moveable Estate and a Good bed and bedstead and furniture thereto belonging and her Spinning Wheel and a good Chest and all the Putor (sic) and Kitching Whear (sic) which she brought to me and my Son Peter shall Keep her a riding creature Suficient (sic) for her use and two Cows and two Sheep and them shall be used as his own and those during her natural life if she remains a widow but if not it shall fall to my Children again and is further my will that my wife Elizabeth shall have yearly as long as she remains a widow Twenty Bushels of wheat and ten Bushels of Rye and fifteen pounds of Hackelt flax and fifteen pounds of Toe (?) and one hundred pounds of Good Pork and fifty pounds of good beef and one pair of Shoes one bushel of Salt and she shall have suficient (sic) fire wood brought to the Door and cut suficient (sic) for her use and she shall have her Widow Seat in the house where I live in now and shall have the Old Gartain (sic) next to the house and room in the Spring house and three of the Largest apple Trees and two roos in the next orchard and two roos (sic) in the Ober (sic) orchard and the one third part of my Personal Estate and all the Linnon (sic) and Woolen Stuff which remains after my Decease and the remainder of my Personal Estate shall be praised after my Decease and Sold and the money shall be Equilly (sic) Divided amongst all my Children Excepting my son Samuel Shall have three Pounds over and above his Equil shear (sic) with the rest of my Children and further it is my will that my son Peter Bixler shall have my Plantation and all my land which I hold for the Sum of Four Hundred Pounds Specie out of the said four Hundred pounds my son Peter shall have his Equil Shear (sic) with the rest of my Children and my son Peter shall pay yearly Twenty Pounds until the four hundred pounds is paid his share Excepted that it is to say to my son Samuel Twenty Pounds one year after my Decease and so on yearly according to their age until the aforesaid four Hundred Pounds is paid Lastly I do hereby nominate ordain Constitute and appoint Samuel Flickinger of York County and the State of Pennsylvania Farmer and my Son Peter Bixler and my Wife Elizabeth both of Frederick County and the State of Maryland to be my Whole and Sole Executors and Executrix of this my last will and Testament and I do hereby revoke Disanul (sic) all former will and Wills Testament and Legacies by me made ratifying and confirming this and no other to be my last will and Testament In Witness whereof I have set hereunto my name and Seal this fifteenth day of may one thousand seven hundred and Ninety Seven. Signed Sealed Published Pronounced and Declared by him the Said Samuel Bixler as his last will and Testament in presence of George Mathias, Christian Bower, John Bower Samuel Bixler X his mark (Seal) Frederick County, June 14th 1803 There came Peter Bixler and made oath on the Holy Evangels of Almighty God that the aforegoing Instrument of writing is the True and whole will and Testement (sic) of Samuel Bixler late of Frederick County Deceased that hath come to his hands and posession (sic) and that he Doth not Know of any other. George Murdock Register Frederick County, June 14th 1803 There came Christian Bower and John Bower two of the Subscribing Witnesses to the aforegoing last will and Testament of Samuel Bixler late of Frederick County Deceased and made oath on the holy Evangels of Almighty God that they did see the Testator therein named Sign and Seal this will that they heard him Publish Pronounce and declare the same to be his last will and Testament that at the time of his so doing he was to the best of their Apprehensions of a Sound and Disposing mind memory and understanding that they respectively Subscribed their names as Witnesses to this will in the Presence and at the request of the Testator and that they did also see George Mathias the other Subscribing Witness Sign his name as a Witness to said Will in the Presence and at the request of the Testator and all in the Presence of each other. George Murdock Register We Samuel Flickinger and Elizabeth Bixler two of the appointed Executor and Executrix in the last Will and Testament of Samuel Bixler late of Frederick County Deceased do hereby refuse to Act as Executor and Executrix to said will by virtue of said appointment and do therefore renounce all our right Title and Claim to said Executor and Executrixship accordingly as witness our hands this Day of June 1803 – Samuel Flickinger Elizabeth Bixler
