All Rights Reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ********************************************************* Cecil County Land Record Book, Number 20, Folio 287 This Indenture made this twenty-ninth day of July in the year of our Lord one thousand Seven hundred and Ninety Seven Between John Thomas Ricketts of Alexandria County of Fairfax and Common Wealth of Virginia Surviving Executor of the last Will and Testament of David Barr deceased of the one part, and Peter Egner of Cecil County in the State of Maryland of the other part. Whereas the said David Barr in and by his last Will and Testament bearing date the eighth day of April in the year of our Lord one thousand Seven hundred and eighty Seven did devise that his real and personal Estate should be sold as soon as convenient after his decease at the discretion of his Executors, and did appoint and Constitute his sons in Law Joseph Watson and I the said John Thomas Ricketts to be his sole Executors to his last Will and Testament, and the said Joseph Watson having since departed this life and his survivor finding it Necessary and proper to make sale of the Real Estate of his Testator to make the Distributions agreeable to his Will This Indenture therefore Witnesseth that the said John Thomas Ricketts for in Consideration of the sum of Seven hundred Pounds Maryland Currency to him in hand paid by the said Peter Egner the receipt whereof the said John Thomas Ricketts doth hereby acknowledge, and thereof doth Exonerate and discharge the said Peter Egner his heirs Executors, Administrators, Assigns Hath granted bargained and sold, Aliened and Confirmed and by these presents Doth grant bargain and Sell, alien and Confirm unto the said Peter Egner his heirs and Assigns forever, a certain Tract or parcel of Land, situate in the said County of Cecil and bounded as followeth to wit Beginning for the same at a stone set up in the ground at the end of a Line drawn South eighty three degrees West twenty two perches and a half from a large stone set up at the place of the original beginning boundary of the whole Tract of Land called prices patent, said place of beginning being a boundary of Six Acres one rood and eight perches of Land part of the said Tract, formerly sold by the said David Barr to a certain Henry Robinson on[sic] the year 1782, and running from thence South eighty three degrees west ninety nine perches to a heap of Stones near the East side of a small run of Water thence by Land of Mr John Gilpin, South eighty three degrees west ninety five perches to a stone, then North Six degrees West two hundred and Forty eight to a stone on this line at Six perches, passing over a Stone set up formerly (in the Ground and at one hundred and forty five perches past three quarters of a perch to the eastward of an old marked hicory[sic] tree said to be at or very near the Corner of Mr John Gilpin’s Land) thence North eighty five degrees & a quarter East two hundred and Nineteen perches and a quarter to a Stone by a young marked ash tree, then South four degrees east one hundred and forty nine perches to a large white oak tree said to be the beginning boundary of a Tract of Land called Sandy hill and from thence by a straight Line drawn about South ten degrees West Ninety Six perches to the place of Beginning Containing by Survey lately made by William Humphreys Surveyor of Cecil County three hundred and twenty four Acres and a half of Land more or less; and is a part of prices Original Patent of one thousand Acres of Land mentioned in an Indenture bearing date the Second day of September one thousand seven hundred and forty Between William Munnington and John Seacock of the one part and the said David Barr of the other part and in one other Indenture bearing date the twentieth day of May, one thousand seven Hundred and Forty five, Between Philip Greims[?] and Mary his wife and James Griems[?] of the one part and the said David Barr of the other part, by which two Indentures the Lands hereby intended to be conveyed, are said to have been granted to the said David Barr of which he died Seized together with the part so sold by him to the said Henry Robinson, and all the houses, outhouses, Woods underwoods ways, waters Water Courses, Commodities Hereditaments and Appurtenances whatsoever to the said hereby granted and Conveyed Lands and premises belonging or in anywise appertaining and the Reversion and Reversions; and Remainder and Remainders, Rents & Issues thereof, To have and to hold the said Tract or parcel of Land as herein described and bounded and intended to be conveyed and premises with the appurtenances unto the said Peter Egner his heirs and Assigns to his and their own proper use and behoof forever In Witness whereof the said John Thomas Ricketts hath hereunto set his hand and Seal the day month and year first herein mentioned. Jno Thos Ricketts Sealed & delivered in the presence of, Before Signing or Sealing were Interlined above, the words in the tenth line having since departed this life and his Survivor” also the words of which he died Seized” in the fortieth line also the words every in the twenty Eighth line from the Top Lloyd Beall, Thos Corcoran Received the day of the date of the above Indenture of the above named Peter Egner the sum of Seven Hundred Pounds Current Money of Maryland in and for full Consideration for the within mentioned Lands premises with their appurtenances Jno Thos Ricketts Witness Lloyd Beall, Thos Corcoran Montgomery Sct Personally appeared before the Subscribers Two of the Justices of the peace for County aforesaid, John Thomas Ricketts party to the within mentioned Deed and acknowledged the same to be his act and Deed and the within mentioned Land an[sic] premises to be the right Title and Estate of the within named Peter Egner his Heirs and Assigns forever according to the Meaning Spirit and intent of the said Deed. Acknowledged before Lloyd Beall, Thos Corcoran Maryland Montgomery County Sct I hereby certify that Lloyd Beall and Thomas Corcoran Gent were on the twenty ninth day of July last two of the Justices of the peace in and for Montgomery County duly Commissioned and qualified and to all whose acts as such due faith and credit is and Should be given as well in Courts of Justice as therout.
