Number 20, Folio 291 This Indenture made this thirteenth day of September in the year of our Lord one thousand seven hundred and Ninety Seven Between Peter Egner of Cecil County in the State of Maryland Farmer of the one part and Jacob Casho of the same County and State Husbandman of the other part Whereas John Thomas Ricketts of the Town of Alexandria, County of Fairfax and Common Wealth of Virginia Surviving Executor of the last Will and Testament of David Barr late of Cecil County (deceased), by his certain Indenture of Bargain and Sale duly executed bearing date the twenty ninth day of July in the year one thousand seven hundred and Ninety seven did Convey and assure unto him the said Peter Egner in Fee Simple a certain Tract or parcel of Land situate in the said County of Cecil and bounded as follows to wit, Beginning for the same at a stone set up in the Ground at the End of a Line drawn South eighty three degrees west twenty two perches and an[sic] half from a large stone set up at the Place of the original beginning Boundary of the whole Tract of Land called Price’s Patent said Place of Beginning being a Boundary of Six Acres one Rood and eight perches of Land part of said Tract formerly sold by the said David Barr to a certain Henry Robinson in the year 1782 and running from thence south Eighty three degrees West ninety nine perches to a heap of Stones near the East side of a small Run of Water thence by Lands of Mr John Gilpin south Eighty three degrees west ninety five perches to a stone then North six degrees West two hundred and forty Eight Perches to a stone on this Line at Six perches passing over a stone set up formerly in the ground and at one hundred and forty five perches past three quarters of a perch to the eastward of an old marked Hickory Tree said to be at or very near the Corner of Mr John Gilpins, thence North Eighty five degrees and a quarter East two hundred and Nineteen perches & a quarter to a stone by a young marked Ash Tree then South four degrees East One hundred and forty nine Perches to a large White Oak Tree said to be the Beginning Boundary of a Tract of Land called Sandy Hill & from thence by a straight line drawn about south ten degrees West, Ninety Six perches to the Place of Beginning Containing by Survey lately made by William Humphreys Surveyor of Cecil County Three Hundred and twenty four Acres and an half acre of Land more or less and is a part of Price’s Original Patent of one thousand Acres of Land mentioned in an Indenture bearing date the Second day of September one thousand seven hundred and forty, Between William Monington and John Seacock of the one part and the said David Barr of the other part and in one other Indenture bearing date the twentieth day of May, one thousand seven hundred and forty five Between Philip Greimes and Mary his Wife and James Griemes of the one part and the said David Barr of the other Part by which two Indentures the above mentioned and described Tract or Parcel of Land are said to have been granted to the said David Barr and of which he died seized in his domin[?] as[?] of Fee together with the Part so sold by him to the said Henry Robinson and all the Buildings Improvements Woods Waters Water Courses Rights Liberties Priviledges[sic] Hereditaments and appurtenances whatsoever to the same belonging or in any wise appertaining as by the said herein recited Deed of Indenture relation being thereto had will more fully and at large appear Now this Indenture Witnesseth that the said Peter Egner for and in Consideration of the sum of Seven hundred and twenty five pounds to him in hand paid at the Ensealing and delivery of these presents by the said Jacob Casho the Receipt whereof is hereby acknowledged Hath granted bargained & sold aliened released enfeoffed and confirmed and by these Presents doth grant bargain and Sell alien release enfeoff and Confirm unto the said Jacob Casho his heirs and Assigns forever all and every the above and before mentioned and described Tract or Parcell[sic] of Land & premises Containing three hundred and twenty four Acres of Land be the same more or less with all and every the appurtenances thereto belonging or in any wise appertaining and the Reversion & Reversions Remainder & Remainders Rents Issues & Profits thereof and all the Estate Right [??] Interest Claim and demand of the said Peter Egner of in or to the same or any part or parcel thereof To have and to hold the above and before mentioned and described Tract or Parcels of Land Hereditaments and Premises herby granted or mentioned and intended to be granted with the appurtenances unto the said Jacob Casho his heirs and Assigns to the only proper use and behoof of the said Jacob Casho his heirs and Assigns forever and the said Peter Egner for himself his Heirs and Assigns doth covenant and agree to and with the said Jacob Casho his heirs and Assigns the above and before mentioned and described Tract of Land and Premises with the appurtenances unto the said Jacob Casho his heirs and Assigns against him the said Peter Egner his heirs and Assigns and against all Persons claiming under him or them shall and will warrant and forever defend by these presents In Witness whereof the said Parties to these presents have hereto set their hands and Seals the day and year first above written Peter Egner Sealed & delivered in presence of Tob’s Rudulph, Sam’l Hewitt Received the day of the date of the above Deed the sum of Seven hundred and twenty five pounds being the Consideration Money therein mentioned in full from the said Jacob Casho Peter Egner Witness Sam’l Hewitt State of Maryland Cecil County Sct Be it remembered that on the thirteenth day of September in the year of our Lord one thousand Seven hundred and Ninety Seven Before me the Subscriber one of the Associate Justices of Cecil County came Peter Egner in the above and foregoing Deed named and acknowledged the same to be his Act and Deed and the Lands and premises thereby bargained and Sold to be the Estate of the therein named Jacob Casho his heirs and Assigns forever And also Margaret Wife of the said Peter Egner being by him privately examined out of the hearing of her said Husband acknowledged the same according to the directions of the act of Assembly in such Case made and provided and declares she makes the said Acknowledgement willingly and freely without being induced thereto by Fear or threats of or ill usage by her Husband or Fear of his displeasure, Taken and Certified according to Law.
