All Rights Reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ********************************************************* Indenture between Jacob CASHO and Peter EGNER, Jr. (1799) Cecil County Land Record Book, Number 21, Folio 180 This Indenture made the fifth day of February in the year of our Lord one thousand Seven hundred and Ninety Nine Between Jacob Casho of Cecil County in the State of Maryland of the one part, And Peter Egner Jun’r of the same County and State of the other part Witnesseth that the said Jacob Casho for and in Consideration of the sum of one hundred and fifty pounds Current Lawful money of Maryland to him in hand paid by the said Peter Egner Jun’r at and before the Ensealing and delivery of these presents, the Receipt and payment whereof is hereby acknowledged he the said Jacob Casho hath Granted Bargained and sold, Aliened Released and Confirmed, And by these presents doth Grant Bargain & Sell, Alienn[sic], Release and confirm unto the said Peter Egner Jun’r his heirs and Assigns forever, All that part of a Tract of Land in Cecil County called Prices Patent as included within the following Metes and bounds Viz Beginning at a stone set up in the woods, by a marked Ash Sapling, being at the North East corner of said Tract of land and running thence south four degrees and a quarter East Eighty four perches, to a large marked Black oak tree on the North side of the old Road leading from Andrew Fisher’s Mill to Bell hill, and running from thence along said old Road North Eighty seven degrees and a quarter west Sixty eight perches, and a half to a Marked Hickory tree on the South side of said old Road, then south Eighty eight degrees, and a quarter west thirteen perches still along by said Road to a stone, then North four degrees and a half west Twenty four perches to a stone on the North Eight five degrees East line of said Land being also the line of Samuel Wilsons[sic] Land, then with said Line North Eighty five degrees East Eighty one perches to the place of beginning Containing Forty Acres of Land more or less, Together with all, the Improvements; fences woods, ways waters, Profits Commodities, Advantages and Appurtenances thereunto belonging, or in any wise appertaining; And also all the Estate, Right, title, Interest property claim and Demand whatsoever of him the said Jacob Casho, either in Law or Equity of in, or unto the said hereby Granted bargained and sold Land and premises, and of, in and unto every part and parcel thereof with the appurtenances To have and to hold, the said Land and premises, with the appurtenances unto him the said Peter Egner Jun’r his heirs and Assigns, to the only proper use and behoof of them the said Peter Egner his heirs and Assigns, forever, And the said Jacob Casho for himself his heirs Executors and Administrators doth hereby Covenant and agree to and with the said Peter Egner Jun’r his heirs and Assigns that he the said Jacob Casho, his heirs Executors and Administrators, the said hereby Granted bargained and sold Land and premises, with the appurtenances unto him the said Peter Egner Jun’r his heirs and Assigns; Against him the said Jacob Casho, his heirs, Executors and Administrators, and against all and every other person and persons whatsoever Claiming or, to claim by from or under him them or any of them, shall and will forever warrant and defend by these presents, In Testimony whereof the said Jacob Casho hath hereunto set his hand and seal the day and year first above written Jacob Casho Signed Sealed & delivered in presence of Tob’s Rudulph, Jno D Thompson Received February the fifth Seventeen hundred and Ninety Nine of the within named Peter Egner Jun’r the sum of one hundred and fifty pounds, Current Lawful money of Maryland being in full of the consideration money mentioned in the within Deed Jacob Casho Being present Jno D Thompson Maryland Cecil County Sct Be it remembered that on the fifth day of February, Seventeen hundred and Ninety eight personally appeared before me the subscriber one of the Associate Justices of Cecil County the within named Jacob Casho, and acknowledged the within Instrument of writing to be his Act and Deed, and the Land and premises within mentioned to be Granted Bargained and sold with the appurtenances to be the only right and Estate of the within mentioned Peter Egner Jun’r his heirs and Assigns forever according to the true intent and meaning of the within Deed.
