The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net *********************************************************************** Cecil County Land Record Book, Liber CK, Number 2, Folio 14 POWER OF ATTORNEY KNOW ALL MEN BY THESE PRESENTS, That Whereas, John W Miller, late of Cecil County, State of Maryland, deceased, was seized and possessed of a certain lot or parcel of land, with improvements, situate at Cherry Hill, in said County, and BEGINNING for the same at a stump of a white oak tree, being also the Northwestern corner of land formerly of Dr R C Carter, on the East side of the old Plank Road from Elkton to Fair Hill, and running thence South fifteen and one quarter degrees West, ten and three tenths perches to a stone, thence North eighty five degrees East, sixteen and nine tenths perches to a stone, thence South five degrees East, ten perches to a stone on Carter’s line, and thence by said Carter’s land, South eighty five degrees West, fifteen and one tenth perches to the place of beginning. Containing One Acre of Land, more or less. BEING the same lot or parcel of land which was conveyed to the said John W Miller by Samuel K Miller and wife, by their deed dated the Twenty Eighth day of July, Eighteen Hundred and Sixty Nine, and recorded among the Land Records of Cecil County aforesaid, in Liber DS No 2 Folio 299, etc. AND WHEREAS, The said John W Miller being seized and possessed as aforesaid, departed this life intestate, on or about (the) May 8th, (day of) 1909, (Nineteen Hundred and Nine), leaving as next of kin and only heirs-atlaw, his sons, Elmer Miller and John K Miller, both of the City of Wilmington, State of Delaware, and his daughter, Annie M Arbuckle, wife of Philip R Arbuckle, of Cecil County aforesaid. AND WHEREAS, The said real estate is subject to a Mortgage, made by the said John W Miller to one John Lungren, of said Cecil County, dated the Twenty Ninth day of January, Nineteen Hundred, and recorded as aforesaid, in Liber JGW No 7 Folio 197, etc. AND WHEREAS, All of the said heirs-at-law have agreed that the said Philip R Arbuckle may sell the said real estate, as hereinafter provided. NOW THEREFORE, IN CONSIDERATION of the premises and for the purposes aforesaid, we, the said Elmer T Miller and Eva C Miller, his wife, John K Miller and Lillie Miller, his wife, Annie M Arbuckle and Philip R Arbuckle, her husband, do hereby constitute, nominate and appoint the said Philip R Arbuckle to be our true, sufficient and lawful Attorney, for us and in our name, place and stead to sell the aforesaid and above described real estate, with the buildings and improvements thereon, of which the said John W Miller, died, seized and possessed as aforesaid, at public or private sale, and for the best price that he can reasonably obtain, and to convey the same unto the purchaser or purchasers thereof, their heirs, personal representatives or assigns, in fee simple, as full as we ourselves might or could do, and to dispose of the proceeds of said sale as follows: (1)—To pay all the costs, expenses and charges incident to the making of said sale, allowing no commission to the said Philip R Arbuckle. (2)—To the payment of all sums due under the provisions of the aforesaid Mortgage to the said John Lungren. (3)—To the payment of all other debts due and owing by the said John W Miller at the time of his death, all debts due for the funeral expenses of the said John W Miller and all taxes unpaid on said real estate. And (4)—To pay the balance of said proceeds of said sale over to the said heirs-at- law according to their respective interests in said property.
