The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net *********************************************************************** Cecil County Land Record Book, Liber CK, Number 2, Folio 194 THIS DEED, Made and Executed this Eleventh day of April in the year Nineteen hundred and ten, by Philip R Arbuckle of Cecil County in the State of Maryland, in his own behalf and the said Philip R Arbuckle, attorney as hereinafter set forth, party of the first part hereto, and Harry T Grant, of Gloucester County in the State of New Jersey, party of the second part hereto. WHEREAS, John W Miller, late of Cecil County deceased, departed this life intestate, on or about the eighth day of May in the year Nineteen hundred and nine, and seized and possessed of certain real estate, situate, lying and being in Cecil County aforesaid, and leaving Elmer T Miller, whose wife is Eva C Miller, John K Miller, whose wife is Lillie Miller, and Annie M Arbuckle, nee Miller, wife of the said Philip R Arbuckle, his only children and heirs at law surviving him; to whom said real estate descended and in whom it vested, subject, however, to the lien of a certain mortgage from the said John W Miller to John Lungren, dated the twenty ninth day of January in the year Nineteen hundred, and which is now of record in Liber JGW No 7 Folio 197, one of the Land Record Books for Cecil County aforesaid, and given to secure the payment of the sum of Seven hundred dollars, together with interest thereon, according to the tenor and effect thereof. AND WHEREAS, the said Philip R Arbuckle, by virtue of the power and authority conferred upon him by the aforesaid heirs at law of the said John W Miller, in and by their certain letters of attorney dated the fourteenth day of October in the year Nineteen hundred and nine, and which is now of record in the Liber CK, No 2, folio 14, another of the Land Record Books for Cecil County aforesaid, has sold the real estate whereof the said John W Miller died seized and possessed to the said Harry T Grant at public auction, subject to the aforesaid mortgage, which he the said Harry T Grant agrees to assume and pay as part of the consideration hereof, he the said Philip R Arbuckle in further execution of the power conferred on him by said letters of attorney has agreed to execute these presents. NOW, THEREFORE, THIS DEED WITNESSTH that the said Philip R Arbuckle, for himself and as attorney as aforesaid, for the said heirs of the said John W Miller, for and in consideration of the sum of Eight hundred and forty dollars current money to him in hand well and truly paid, and his agreement to assume and pay unto the said John Lungren the further sum of Seven hundred dollars, the consideration of said mortgage, together with interest thereon from the twenty ninth day of January in the year Nineteen hundred and ten, HAS GRANTED and by these presents DOES GRANT unto the said Harry T Grant all that lot or parcel of land and premises, situate, lying and being at the village of Cherry Hill, in Cecil County aforesaid, whereof the said John W Miller died seized and possessed as aforesaid, and which is described by metes and bounds, courses and distances as follows: BEGINNING for the same at a stump of a whiteoak tree, being also the northwestern corner of lands formerly of Dr R C Carter, on the east side of the old plank road from Elkton to Fair Hill, and running thence South fifteen and one quarter degrees West, ten and three tenths perches to a stone, thence North eighty five degrees East, sixteen and nine tenths perches to a stone, thence South five degrees East, ten perches to a stone on Carter’s line, and thence by said Carter’s land South eighty five degrees West, fifteen and one tenth perches to the place of BEGINNING, Containing One Acre of Land, More or Less, being the same lot or parcel of land which was conveyed to the said John W Miller by Samuel K Miller and wife, by their deed bearing date the twenty eighth day of July Eighteen hundred and sixty nine, and recorded as aforesaid in Liber DS, No 2, Folio 299. TO HAVE and TO HOLD the aforesaid lot or parcel of land and premises, with its appurtenances, unto the said Harry T Grant, Forever In Fee Simple. And the said Harry T Grant, for and in consideration of the premises, for himself, his heirs, executors and administrators, does hereby covenant and agree to and with the said Philip R Arbuckle, attorney, and the aforesaid heirs of the said John W Miller, deceased, that he will assume and pay unto the said John Lungren, the said sum of Seven hundred dollars, together with interest thereon from the date hereinbefore mentioned, the same being the amount due upon the above recited mortgage. IN testimony Whereof the said Philip R Arbuckle and Philip R Arbuckle, attorney as aforesaid, has hereto set his hands and seals the day and year aforesaid. William T Boulden State of Maryland, Cecil County, to-wit: I Hereby Certify that on this eleventh day of April, in the year Nineteen hundred and ten, before me, the subscriber, a Justice of the Peace of the said State, in and for the County aforesaid, personally appeared Philip R Arbuckle and Philip R Arbuckle, attorney for the heirs of John W Miller, deceased, and acknowledged the aforegoing instrument of writing to be his act and deed and the act and deed of his principals, the aforesaid heirs at law of the said John W Miller.
