The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net *********************************************************************** Cecil County Land Record Book, Liber CK, Number 9, Folio 497 THIS DEED MADE this twelfth day of May in the year Nineteen hundred and fifteen, by Samuel J Arbuckle, Daniel T Arbuckle, Paul T Arbuckle, of Cecil County in the State of Maryland, and Philip R Arbuckle, of the City of Wilmington, in the State of Delaware, parties of the first part, and John Alexander Rutter, of Cecil County aforesaid, party of the second part hereto; WHEREAS, Mary S Arbuckle, late of Cecil County deceased, in and by her last will and testament, which was duly admitted to probate by the Orphans Court for Cecil County, aforesaid, and which is now of record among the Records of Wills of said County did nominate and appoint the parties of the first part hereto the executors thereof, and, WHEREAS, the said Mary S Arbuckle, in here lifetime, held and owned a certain mortgage from Charles F Sheppard and wife to Hiram McCullough, Executor and Trustee, dated the 27th of June, 1882, and now of record in Liber JAD, No 5, folio 15 etc, to secure the payment of Three hundred and twenty five dollars, which said mortgage was assigned on January 19th, 1892, to Lucy H Litzenburg and on the 24th of April 1894, was assigned to Mary S Arbuckle, and, WHEREAS, the above named parties of the first part did duly qualify as executors of the last will and testament of the said Mary S Arbuckle, and, WHEREAS, the real estate covered by said mortgage was afterwards conveyed, subject to the payment of said mortgage cost, to a certain Deleplaine McDaniel, by Charles F Sheppard and wife by deed dated the third day of November, in the year 1883, and which is now of record in Liber JAD, No 8, folio 31 etc, another of the said Land Record Books, and, WHEREAS, Joseph L McDaniel and others, Executors, afterwards to wit on the 26th day of March, 1889, by their deed of that date, and which is now of record in Liber JAD, No 18, folio 223 etc, another of said Land Record Books conveyed forty two acres of land, more or less, part of the real estate covered by said mortgage, and subject to the payment of the same, unto the said John Alexander Rutter, and, WHEREAS, the said John Alexander Rutter, party of the second part hereto, has paid unto the parties of the first part hereto, executors as aforesaid, the full consideration of said mortgage debt, together with the interest thereon; NOW, THEREFORE, the parties of the first part hereto have joined in the execution hereof for the purpose of releasing the said real estate from the lien of said mortgage. NOW, THIS DEED WITNESSTH, that the said Samuel J Arbuckle, Daniel T Arbuckle, Paul T Arbuckle, and Philip R Arbuckle, Executors as aforesaid, in consideration of the payment to them of the sum of Three hundred and twenty five dollars, principal of said mortgage, together with all interest thereon, DO GRANT unto the said John Alexander Rutter all the real estate and property which is described in the deed of mortgage from the said Charles F Sheppard and wife, to Hiram McCullough, Executor and Trustee, dated the 27th of June, 1882, and now of record in Liber JAD, No 5, folio 15 etc, the Mortgage Record book for Cecil County aforesaid, so far as may be necessary to release the said property from the mortgage thereby created.
