Witnessth that for and in consideration of the amount of Ten Hundred and fifty-dollars ($1050) now due from the said John Smith to David T Develine of the same county and state aforesaid, as will as for and in consideration of the sum of one dollar well and truly paid by the said David T Develine to the said John Smith at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged He the said John Smith doth grant unto the said David T Develine, all those two pieces parcels or parts of tracts of land lying and being in Cecil County and State of Maryland, which were conveyed to the said John Smith by a certain Jethro J(?) McCullough and wife by Deed dated on the fourth day of April in the year Eighteen hundred and fifty – and recorded in Liber RCH, No 2, Folio 105 in one of the Land Record Books of Cecil County aforesaid and containing in all sixty five acres two roods and fifty-seven(?) perches of land or the same more or less. To have to To Hold the aforesaid two pieces or parcels of land, unto the said David T Develine his heirs and assigns in fee simple. Provided that if the said John Smith his heirs executors administrators or assigns shall and do well and truly pay or cause to paid unto the said David T Develine his heirs or assigns on or before the Fourth day of January in the year Eighteen hundred and Seventy three the full sum of Ten Hundred and fifty-dollars ($1050.00) and shall and do well and truly pay or cause to be paid unto the said David T Develine the legal interest upon the said sum of Ten hundred and fifty-dollars ($1050.00) annually in the meanwhile, and shall also well and truly pay or cause to be paid all taxes assessments public dues or charges, levied or to be levied by law, upon this mortgage or the debt hereby secured then this mortgage shall be void, and the said John Smith for himself his heirs executors administrators and assigns doth hereby covenant promise and agree that he will pay or cause to be paid the aforesaid sum of ten hundred and fifty dollars ($1050.00) with the interest and taxes aforesaid upon the day and in the manner hereinbefore provided. In witness whereof the said John Smith hath hereunto set his hand and seal upon the day hereinbefore first written.
