This Indenture made this seventeenth day of April in the year Seventeen hundred and ninety five between James Evans and James Leiper Porter, Executors of Richard Gay of the one part and Doctor Robert McClellan of Lancaster County of the other part. Witnesseth that whereas by the last will and Testament of the afsd. Richd. Gay full power is delegate to his said Executors to Sell and make a Deed or Deeds of Conveyance. Reference to the said Will on the Cecil County Recording [sic] had will more fully appear [sic], therefore for and in consideration of the sum of Six Hundred and Seventy five pounds Maryland Currency to them in hand paid by the said Robert McClellan at or before the insealing [sic] and delivery of these presents the Receipt whereof they the said James Evans and James Leiper Porter doth hereby acknowledge hath bargained for granted and sold, released, confirmed and transferred and by these Presents doth bargain for grant and sell, release, confirm and transfer unto the said Robert McClellan all that Tract of Land Situate in Orctorah Hundred formerly the property of Richard Gay afsd. Deceased called the Levell and Levels Addition Beginning for the out lines of the Level at a bounded red oak standing on the south side of a small hill and running from thence North North West one Hundred and fifty Six perches thence North Sixty five degrees East one Hundred and Twenty five perches on Husbands division Line then South South East One Hundred Eighty Six perches thence north fifty Degrees East Eighty perches East twenty perches South thirty Six perches South Seventy three Degrees West One hundred and Seventy Six perches then North thirty three degrees West Sixteen perches then South Seventy Seven degrees West forty three perches from thence by a Straight line to the beginning thereby closing John Ewing’s Patent conveyed to Richd. Gay afsd. Beginning for the Levels addition at the end of the third and most southerly extremity of the south south East one Hundred and Eighty Six perch line of the Patent afsd. And running thence North East forty six perches to a branch of Water by some called Greens Branch thence up the branch North thirty Degrees West thirty four perches thence North thirteen degrees West forty perches thence North forty degrees west untill it intersects Husbands division line afsd. untill it intersects the afsd. Land called the Level thence to the beginning containing in the whole two hundred and nineteen acres more or less, together with the Appurtainances thereunto belonging or appertaining unto the said Robert McClellan his Heirs and Assigns to his and their only proper use and behoof for Ever, and the said James Evans and James Leiper Porter for themselves and their Heirs doth covenant and agree to and with the said Robert McClellan that they the said James Evans and James Leiper Porter and their Heirs the said bargained for and Sold Land and promised unto him the said Robert McClellan and his heirs and assigns well for Ever warrant and defend against the Heirs of the afsd. Richard Gay Deceased and against all persons claiming or to claim from buyer under them or any of them. In Testimony wherefore the said Gay Executors have hereunto severally set our hands and affixed our Seals the day and year first written. James Leiper Porter (Seal) Received this 17th day of April 1795 of the within named Doctor Robert McClellan the sum of Six Hundred and Seventy five pounds Maryland Currency being the full consideration money within mentioned by us. James Evans Witnesses present James Leiper Porter Samuel Miller, William Miller Rec. this 17th day of April 1795 of the within named Doctor Robert McClellan the sum of Two Hundred and Twenty five pounds Currency of Maryland being the Consideration money for which I have sold my right of Dower as Widow of the Decd. Richd. Gay for an to the within described Tracts of land and premises. Margaret Gay (Seal) Witnesses Present Samuel Miller, William Miller On this Seventeenth day of April Seventeen Hundred and ninety five came the within named James Evans and James Leiper Porter a party to the within Deed of Conveyance before us the Subscribers two of the Justices of the peace in and for Cecil County and Acknowledged the same to be their Joint Act of Deed and the Lands and premises therein mentioned to be the right Title and Estate of him the within named Robert McClellan according to the true intent and meaning thereof. At the same time came Margaret Gay and Acknowledged that she hath Recd. The sum of Two Hundred and Twenty five pounds mentioned in the above receipt in full of her Right of Dower to the within mentioned Land and premises and that she relinguishes all her Right to the same and acknowledges it to the Right & Estate of the within Robert McClellan and his Heirs forever.
