All Rights Reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ********************************************************* Deed from John and Mary Ann CORNISH to Matthew BORLAND (1854) Cecil County Land Record Book, Liber HHM, Number 2, Folio 609 This Indenture made this Twenty-Eighth day of February in the year of Our Lord one thousand Eight hundred and fifty-four between John Cornish and Mary Ann Cornish his wife of the County Cecil in the State of Maryland of the first part and Matthew Borland of the County and State aforesaid of the second part. Witnesseth that the said party of the first part for and in considerations of the sum of Three hundred and ninety dollars money of the United States to them in hand paid by the said party of the Second part, at and before the Sealing and delivery of these presents the receipt whereby is hereby acknowledged, and the said parties of the first part therewith fully satisfied content and paid, have given granted bargained Sold aliened enfeoffed conveyed and confirmed and by these presents do give grant bargain sell alien enfeoff convey and confirm to the said party of the second part his heirs and assigns forever, All that certain tract or parcel of land and premises lying and being in the County and State aforesaid. Beginning at a stone in the line of lands of John Mackey and is a corner of land of the said Borland, thence as the needle now points with the line of said Borland South three quarters of a degree West thirty three perches to a stone in the Christiana Road, thence with said Road North Eighty Eight and a quarter degrees East fourteen perches to a stone and corner of land formerly of Jane McCreary thence with her line North ten degrees West thirty six perches and sixteen hundth[sic] of a perch to a stake in the line of said Mackey thence with his line South sixty seven and a quarter degrees West Eight perches to the place of Beginning. Containing two acres and thirty seven hundredths more or less. Together with all and Singular the profits privileges and advantages with the appurtenances to the Same belonging or in any wise appertaining. Also all the estate right title interest property claim and demand whatsoever of the said party of the first part of in and to the same and of in and to every part and parcel thereof - To Have and To Hold all and Singular the herein described tract or lot of land and premises with the appurtenances unto the said party of the second part his heirs and assigns to the only proper use benefit and behoof of the said party of the second part his heirs and assigns forever. And the said John Cornish and Mary Ann Cornish his wife doth for themselves, heirs Executors Covenant and grant to and with the said party of the second part his heirs and assigns, that they the said John Cornish and Mary Ann Cornish his wife now are the true and lawful owners of all and singular the herein described land and premises and every part and parcel thereof with the appurtenances thereunto belonging and that the said land and premises or any part thereof at the time of Sealing and delivery of these presents are not incumbered by and[sic] Mortgage judgment or limitation or by any incumbrance Whatsoever by which the title of the said party of the second part hereby made or intended to be made for the above described land and premises can or may be changed changed[sic] returned or defeated in any way whatsoever excepting a certain judgment given to Richard Brookings[?] of Two hundred and ninety seven dollars which the said Matthew Borland agrees to assume and pay with the interest that may accrue on the same John Cornish and Mary Ann Cornish his wife agree to accept as a part of the consideration money. And also that the said party of the first part now have good right free power and lawful authority to grant bargain sell and convey the said land and premises, in manner ofs[?]. And the said John Cornish and Mary Ann Cornish his wife will warrant and forever defend the said land and premises unto the said Matthew Borland his heirs and assigns forever against the lawful claims and demands of all and every person and person[sic] freely and clearly freed and discharged of and from all manner of incumbrances Whatsoever. In Witness whereof the said John Cornish and Mary Ann Cornish his wife have hereunto set their hands and seals the day and year first above written. John Cornish Mary Ann Cornish Signed sealed and delivered in the presence of David Mackey Thomas Alexander State of Maryland Cecil County Sct Be it remembered that on this twenty Eighth day of February in the year of Our Lord One thousand Eight hundred and fifty four personally appeared John Cornish and Mary Ann Cornish his wife of Cecil County ofs[?] the within named Grantors, before us the subscribers two Justices of the peace of the State of Maryland in and for Cecil County and severally acknowledged the with[sic] deed or Instrument of Writing to be their act and deed respectively. And the said Mary Ann Cornish wife of the said John Cornish did Sign Seal and Execute the said within deed or instrument of writing before us out of the presence and hearing of her husband. And being by us privately Examined, she did acknowledge that she Executed the same Willingly and peaceably and without being induced to do so by fear or threats of, or ill usage, or by fear of his displeasure. And we do further certify that we are Satisfied of our own Knowledge that the said John Cornish and Mary Ann Cornish his Wife acknowledging as aforesaid are the persons who are named and described as and professing to be parties to the said Within deed or instrument of writing.
