The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net *********************************************************************** Cecil County Land Record Book, Liber HHM, Number 5, Folio 324 Whereas there stands a judgment upon the Docket of Cecil County Court at October Term 1849, in favor of Jacob Tome (or Forne?) which has been assigned to Hiram McCullough of Cecil County against George McCullough William McCullough and the said Hiram McCullough for the sum of Five Thousand dollars which said Judgment is a lien upon all the lands of the said George McCullough and William McCullough. And Whereas a Tract or parcel of land called “BellAir” and part of a Tract called “Providence” which belonged to the said George McCullough one of the defendants in said Judgment was sold by one Robert M Walmsley Sheriff of Cecil County to one Philip A Ricard, on which the said Judgment is a lien all which will more fully appear by reference to a deed from the said Robert M Walmsley to the said Philip A Ricard, bearing date on the 25th day of April in the year 1855 and the said Hiram McCullough is willing to Release the said land so sold by the said Robert M Walmsley Sheriff as aforesaid to the said Philip A Ricard from the lien and operation of the said Judgment with the understanding and upon condition that the said Judgment shall be and remain a lien upon the other lands of the said George McCullough and upon the lands of the said William McCullough, and that this Release shall in no manner operate to Release or discharge the lien of the said Judgment upon the other lands of the said George McCullough and the lands of the said William McCullough. Now Therefore Know all men by these presents that I Hiram McCullough for and consideration of one dollar to me in hand paid at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, do by these presents Release acquit Exonerate and forever discharge the said Tract of land called “BellAir” and part of a Tract called “Providence” so as aforesaid sold and conveyed by the said Robert M Walmsley, as sheriff aforesaid to the said Philip A Ricard from all lien and incumbrance for and in account of the said Judgment, or which may and does Exist against the same in my favor by virtue of said Judgment Upon the Express understanding however, that this Release is not to operate or to be construed to operate, as an Extinguishment of the lien Which Exists in its favor by virtue thereof, against the other lands of the said George McCullough and the lands of the said William McCullough or to release the said George and William from the payment of the said Judgment or any part thereof. In Witness whereof I the said Hiram McCullough have hereunto set my hand and seal on this 23rd day of August in the year Eighteen hundred and fifty five.
