Whereas on the Twenty Second day of February in the year of our Lord one thousand Eight hundred and fifty five a certain writ of the State of Maryland of Fieri Facias did issue forth out of the Circuit Court for Cecil County to the said Sheriff of Cecil County directed, reciting That Whereas at a Circuit Court begun and held at the Court House in Elkton in and for Cecil County aforesaid on the Third Monday of October in the year of Our Lord One thousand Eight hundred and fifty two a certain Charles S Boehme by the judgment of the same Court recovered against a certain George McCullough late of Cecil County aforesaid as wise the sum of four hundred and ninety six dollars and twenty five cents Current Money a certain debt as the Sum of Five hundred dollars for his damages which he had sustained as will by reason of the detention of the debt as for his Costs and charges by him about his suit in that behalf laid out and Expended whereof the said George McCullough is convict as it appears of Record, the said Sheriff was therefore commanded that of the goods and chattels lands and tenements of the said George McCullough being(?) in his Balwick he should cause to be made and levied the debt damages costs and charges aforesaid and that he should have those sums of Money before the said Court to be held at the Court House in Elkton in and for the County aforesaid on the first Monday of April then next, to render unto the said Charles L Boehme for the use of Hiram McCullough the debt damages costs and charges aforesaid and that the said Sheriff should also have then and there that writ. And Whereas also the writ came to the hand of the said Sheriff and in pursuance of the command therein contained the said Sheriff laid the same upon Two Tracts or parts of Tracts of Land of him the said George McCullough the one called and Known by the name of “Bellair” lying and being in Cecil County aforesaid and contained in them the courses and distances following. That is to say. Beginning for the same at a stump of a Chestnut Tree in the West side of the Public Road leading from Gravelly Hill to North East and running thence South ten degrees East Sixty Eight perches, then South Sixty and a half degrees East two hundred and two perches, then North Sixty and a half degrees East Eighty one perches, thence North nine degrees West fifteen perches, then North forty five degrees West ten perches, then North sixteen degrees West sixteen perches, then North forty Eight degrees West fourteen and a half perches, then North five degrees West forty four perches, then North thirty degrees West fourteen perches, then North Eighteen perches, then North thirty six and a half degrees West Eighteen perches, then South fifty seven and a half degrees West fifty two perches, and from thence by a straight line to the place of Beginning Containing one hundred and sixty seven and one fourth acre of Land more or less. the other of said Tracts or parts of Tracts of Land called “Providence” lying and being in Cecil County aforesaid and contained within the following courses and distances. To Wit, Beginning for the same at a point which is South Eight and a half degrees West four perches from a stone on the Road side at Gravelly Hill and running thence across the whole Tract of “Providence” South Eighty one degrees East one hundred and forty perches to a stone then North Seventy six degrees East Sixty perches to the East side Big North East Creek near the base of a large Rock intersecting the outlines of the said Whole Tract then down said Creek by the original courses and distances of “Providence” until it intersects the herein before mentioned and described tract called “Bellair” then with the several lines on the North side of “Bellair” to the Public Road aforesaid and from thence up said Road to the Beginning being all of the said Tract called “Providence” Except that part heretofore to wit on the twenty seventh day of June Eighteen hundred and forty six conveyed by the said George McCullough to one William Johnson. And Whereas also after due notice being given of the same the said Sheriff did on the nineteenth day of March in the year of Our Lord one thousand Eight hundred and fifty five Expose the said two Tracts or parts of Tracts of Land so as aforesaid taken in Execution on the said writ to public Sale to the highest bidder and the hereinbefore named Philip A Ricard became the highest bidder and purchaser of the said two Tracts or parts of Tracts of Land for the sum of Two Thousand dollars current Money, and hath since paid the purchase Money to the said Sheriff and is now desirous of obtaining title to the said two Tracts or parts of Tracts of Land in consequence thereof Now This Indenture Witnesseth, That for and in consideration of the premises and of the sum of five dollars current Money to the said Robert M Walmsley Sheriff as aforesaid in hand paid by the said Philip A Ricard at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged the said Robert M Walmsley Sheriff aforesaid hath granted bargained and sold and by these presents doth grant bargain and sell unto him the said Philip A Ricard his heirs and assigns the said two Tracts or parts of Tracts of Land so as aforesaid taken and Exposed to public Sale in virtue of the said Writ of Fieri Facias with the appurtenances thereunto belonging. To Have and To Hold the said two tracts or parts of Tracts of Land with the appurtenances to the said Philip A Ricard his heirs and assigns forever to the only proper use of the said Philip A Ricard his heirs and assigns forever. In Witness whereof the said Robert M Walmsley Sheriff as aforesaid hath hereunto set his hand and seal the day and year first herein before written. Robt M Walmsley Signed Sealed & delivered in presence of Edmund Brown Esq State of Maryland Cecil County Sch Be it remembered that on this Twenty fifth day of the April in the year of Our Lord one Thousand Eight hundred and fifty five before the subscriber a Justice of the peace of the State of Maryland in and for Cecil County, personally appeared Robert M Walmsley who I am satisfied of my own Knowledge is the identical person who is named and described as and professing to be the parties Grantors in the aforegoing deed or Instrument of writing and acknowledged the same to be his act and deed.
