The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net *********************************************************************** Cecil County Land Record Book, Liber HHM, Number 8, Folio 188 Whereas a certain Philip A Ricard of Cecil County in the State of Maryland by his certain Bond or obligation of Even date herewith stands indebted unto a certain John R Richard Junr(?) in the just and full sum of seven Thousand six hundred and sixty three dollars and twenty Eight cents Current Money with a condition thereunder written for the payment of the sum of Three Thousand Eight hundred and thirty one dollars and sixty four cents, Current Money with legal interest for the same from the date hereof, on or before the sixth day of December in the year Eighteen hundred and sixty one, as by the said Bond and Condition may more fully appear. And Whereas the said Philip A Ricard and Eliza Ricard his wife for the better securing the payment of the aforesaid Sum, and interest thereon, are willing to convey the hereinafter described premises to Thomas A Ricard of the City of Philadelphia in Trust for the use and benefit of the said John R Ricard Junr(?) who desires the said Thomas A Ricard to act as his Trustee for the purpose aforesaid. Now This Mortgage Made this Sixth day of December in the year Eighteen hundred and fifty six by the said Philip A Ricard and Eliza his Wife Witnesseth that in consideration of the aforesaid debt of Three Thousand Eight hundred and Thirty one dollars and sixty four cents, with interest thereon from the date hereof now owing from the said Philip A Ricard to the said John R Ricard Junr(?) and also in consideration of the further sum of Five Dollars Current money to them the said Philip A Ricard and Eliza his Wife by the said Thomas A Ricard, in hand well and truly paid at and before the sealing and delivery of these presents, the receipt whereof they do hereby acknowledge, the said Philip A Ricard and Eliza his wife do grant in fee simple unto the said Thomas A Ricard in Trust for the said John R Ricard Junr(?) all the following described Tract piece or part of a Tract of land, called “Providence” lying and being in Cecil County aforesaid. To Wit, Beginning for the same at a point which is South Eight and a half degrees West four perches from a stone on the Road side at Gravelly Hill, and running thence across the whole Tract of “Providence” South Eighty one degrees East one hundred and forty perches to a stone, then North seventy six degrees East sixty perches to the East side of Big North East Creek near the base of a large Rock intersecting the outlines of the said Whole Tract then down said Creek by the original courses and distances of “Providence” until it intersects a certain other Tract called “Bell Air” thence with the several lines on the North side of “Bell Air” to the Public Road aforesaid, and thence up said Road to the Beginning. Being all of the said Tract called “Providence” Except that part heretofore, to wit, on the twenty seventh day of June in the Year Eighteen hundred and Forty six, conveyed by one George McCullough to one William Johnson – being a part of the Lands which were conveyed to the said Philip A Ricard by Robert M Walmsley Sheriff of Cecil County, by his Deed dated the 25th day of April in the Year Eighteen Hundred and Fifty five, and Recorded in Liber HHM No 5 Folio 63 etc one of the Land Record Books of Cecil County aforesaid, and also conveyed to the said Philip A Ricard by the above named George McCullough and Sybilla A his wife, by their Deed dated the Seventh day of March in the Year Eighteen hundred and Fifty six, and Recorded in Liber HHM No 6 Folio 257 etc another of said Land Record Books and which the said Philip A Ricard afterwards conveyed to one John A J Creswell, who on the same day conveyed the same to the aforesaid Eliza Ricard, wife of the said Philip A Ricard, Provided that if the said Philip A Ricard, or Eliza his wife shall pay on or before the Sixth day of December in the Year Eighteen hundred and sixty one, to the said Thomas A Ricard as Trustee aforesaid, the Said full sum of Three Thousand Eight hundred and thirty one dollars and sixty four cents, with interest thereon from the date hereof, according to the tenor of this Bond or obligation of Even date, herewith, and shall also pay said Interest annually – then this Mortgage shall be void. And the said Philip A Ricard covenants that he will pay the aforesaid Money. And he further covenants that in default of payment the said Thomas A Ricard may Enter. Witness our hands and seals. P A Ricard Eliza Ricard Test The word “Cecil” on first page, having been first interlined, and the word “Edge” on second page having been first Erased, and the word “base” interlined in lieu thereof. Wm Hanes Jno A J Creswell State of Maryland Cecil County Sch I hereby certify that on this sixth day of December in the Year Eighteen Hundred and fifty six, before the subscriber, a Justice of the peace of the said State in and for the County aforesaid, personally appeared Philip A Ricard and Eliza Ricard his wife, and did Each acknowledge the foregoing deed of Mortgage to be their Respective Act.
