The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net *********************************************************************** Cecil County Land Record Book, Liber HWL, Number 10, Folio 172 THIS DEED, Made this Thirtieth day of June, AD, 1923, by and between Harry D Henry, widower, of Cecil County, State of Maryland, and Mollie D Arbuckle, Mortgagee, as hereinafter set forth, of Kanawha County, State of West Virginia, parties of the first part, and Thomas C Major, of said Cecil County and State of Maryland, party of the second part. WHEREAS the said Harry D Henry is the owner, in fee simple, subject to the lien of the Mortgage hereinafter mentioned, of the Lot or Parcel of Land hereinafter particularly described and conveyed. AND WHEREAS the said Mollie D Arbuckle owns and holds a Mortgage covering as well the Lot or Parcel of Land aforesaid as a certain other Lot or Parcel of Land owned by the said Harry D Henry, which said Mortgage was given by the said Harry D Henry to the said Mollie D Arbuckle, to secure the payment of the Principal Amount of One Thousand Dollars ($1,000.00), on the 18th day of July, AD, 1916, and is recorded among the Land Record Books of said Cecil County in Liber CK No 11, folio 520, etc. AND WHEREAS the said Mollie D Arbuckle is willing to join in the execution of these presents, at the request of the said Harry D Henry, for the purpose of releasing the Lot or Parcel of Land hereinafter particularly described and conveyed from the lien of her Mortgage aforesaid, while holding and retaining the lien of her said Mortgage upon said other Lot or Parcel of Land covered thereby, as security for the money remaining due thereon. NOW, THEREFORE, THIS DEED WITNESSTH, That the said Harry D Henry, for and in consideration of the sum of Sixteen Hundred and Fifty Dollars ($1,650.00) to him in hand paid by the said party of the second part, and the said Mollie D Arbuckle, Mortgagee as aforesaid, in consideration of the premises and the sum of One Dollar ($1.00) to her in hand paid by the said Harry D Henry, have granted, bargained and sold, released and quit-claimed and by these presents do grant, bargain and sell, release and quit-claim unto the said Thomas C Major, his heirs and assigns, all that certain Lot or Parcel of Land, situate on the South side of East Main Street, in the Town of Elkton, in said Cecil County, which is particularly described as follows, that is to say:- BEGINNING for the same at a point on the South side of said East Main Street, at the North-West Corner of the Lot of Land whereon the said Harry D Henry now resides, and running thence with and beyond the same South 22 Degrees East Twenty-Six Perches to an embankment on the Marsh; thence with the same South 74 Degrees West Nineteen and One-Quarter Feet; thence North 22 Degrees West Twenty- Six Perches, passing through the middle of an Alley, to the South side of East Main Street; and from thence North 66 1/2 Degrees East Nineteen and One-Quarter Feet with the South side of said East Main Street, to the Place of Beginning. IT BEING the same Lot or Parcel of Land which a certain Benjamin F Wells, et ux, by their Deed bearing date the 1st day of May, AD, 1866, and recorded among the Land Records of said Cecil County in Liber HRT, No 1, Folio 261, conveyed unto Anna Maria Henry, later by a second marriage Anna M R Price, who by her Last Will and Testament, bearing date the 22nd day of May, AD, 1885, and now duly admitted to probate in the Orphans’ Court of Cecil County, and of record among the Will Records of said Cecil County in Liber N, No 21, folio 181, etc, devised said Lot or Parcel of Land, inter alia, unto her two sons, the said Harry D Henry and a certain Frank J Henry; the said Frank J Henry, by his Deed bearing date the 18th day of July, AD, 1916, and recorded among the Land Records aforesaid in Liber CSP, No 1, Folio 116, etc, having conveyed his undivided one- half interest therein, inter alia, unto the said Harry D Henry. TOGETHER with the buildings and improvements thereon erected and all the rights, privileges and appurtenances thereto belonging or in any wise appertaining. TO HAVE AND TO HOLD the above granted property, subject to the Right of Way hereinafter mentioned, unto the said Thomas C Major, his heirs and assigns, forever, in fee simple, free, clear and discharged of and from the lien of the Mortgage aforesaid. IT IS EXPRESSLY AGREED by and between the said Harry D Henry and the said Thomas C Major that the said Harry D Henry, in making this conveyance, reserves for himself and his heirs and assigns, as the owner and owners of the Lot or Land whereon he, the said Harry D Henry, now resides, a Right of Way Ten Feet Wide over the rear of the Lot of Land hereby conveyed and running from the South-East corner thereof along the East side thereof in a Northerly direction a distance of Two Hundred and Eighty-Nine Feet, but no further. AND the said Harry D Henry does hereby covenant that he will warrant specially the property hereby conveyed; and that he will execute such further assurances of said land as may be requisite. IN TESTIMONY WHEREOF the said Harry D Henry and the said Mollie D Arbuckle, Mortgagee as aforesaid, have hereunto set their hands and seals, the day and year first herein written.
