Witnesseth that whereas the said parties of the first part are indebted unto the party of the second part on and by their joint and several single Bill of Even Date herewith in the sum of seven Hundred Dollars payable one year after date with interest from date payable Semi annually and are desirous of securing the payment of the same unto the said party of the first part. Now this Mortgage Witnesseth, that in consideration of the premises and to secure the payment of said single Bill, according to the tenor and effect of the same, the said Phillip A Ricard, and Martha R Ricard, his wife have granted and by these presents to grant unto the said Jane Steel all that tract piece or parcel of land situate lying and being in the fifth Election District of said County on the road from Elkton to Turkey Point, which said farm or tract of land is described in a deed from William S Evans of said County Trustee, to said Martha R Ricard, dated on the fifth day of February AD Eighteen Hundred and Eighty one Duly executed and acknowledged and to be recorded among the land record books of said County in Liber JAD No 1 Folio 503 etc one of the land record Books of said County, to which deed and the deed and proceedings therein referred to reference is hereby made for a more full and particular Description of the same containing eighty-three acres and eleven square perches more or less, together with the appurtenances thereunto belonging, unto her the said Jane Steel in fee Simple. Provided, that if the parties of the first part, their heirs or assigns shall pay or cause to be paid unto the said party of the second part, her personal representatives or assigns, the full and just sum of Seven Hundred Dollars, together with all legal interest thereon semi-annually from the date hereof on or before the twenty third Day of March AD Eighteen Hundred and eighty two, and shall perform all and singular the covenants herein on their part contained then this Mortgage shall be void, and it is agreed that until default be made in the premises the said parties of the first part shall possess the aforesaid property paying meanwhile all taxes of every Kind levied or assess, or to be levied or assessed on said property and on said Mortgage debt, and interest hereby intended to be secured which taxes and assessments Mortgage debt and interest the said parties of the first part their heirs executors and administrators do hereby covenant to pay when legally demandable. But in case of any default being made in any covenant or condition of this Mortgage in whole or in part, then these premises are hereby declared to be made in trust and the said Jane Steel, her personal representatives or assigns, or her or their Attorney William S Evans, are hereby authorized and empowered to sell all property hereby conveyed and to grant and convey the same to the purchaser thereof, which said sale is to be made at the Court House Door, in the Town of Elkton, in said county after giving at least three weeks notice of the time, place, Manner and terms of sale which said terms shall be in cash, and to apply the purchase money as follows, first-to the payment of all expenses attending said sale including the same commissions, counsel and appearance fees that are allowed on sales made under decree of the Circuit Court for Cecil county in Equity for the sale of Mortgaged premises, and secondly, to the payment of all moneys owing hereunder whether the same shall have then matured or not, and as to the balance to pay it over to the said Martha R Ricard, her personal representatives heirs or assigns, and the said parties of the first part or themselves, their personal representatives and assigns do further covenant to insure and pending this Mortgage to Keep insured the improvements on the hereby Mortgaged land to the amount of Seven ___ Dollars and to assign the policy or policies of insurance effected thereon to the said party of the second part her personal representatives or assigns and it is hereby agreed that in case the said parties of the first part shall fail to pay the premiums on the policy or policies of insurance aforesaid and the said party of the second part in her pleasure or discretion Should pay the same, the sums so paid with interest shall become a lien on said tract as fully as though included in said debt. Phillip A Ricards Martha R Ricards Test James A Lewis State of Maryland Cecil County, to wit: On this twenty third day of March AD Eighteen Hundred and Eighty one before me the Subscriber a Justice of the Peace of said State in and for the County aforesaid personally appeared Phillip A Ricard and Martha R Ricard his wife, and did each acknowledge the within instrument of writing to be their respective act and deed and at the same time personally appeared William S Evans, who made oath in due form of law that he is the agent of said Jane Steel, and that said consideration named in said Mortgage is true and bona fide as therein set forth, and that he as said agent is authorized to make said affidavit. The Original Mortgage brought into the Office with the following Assignment thereon Viz: For value received I hereby assign the within Mortgage to Margaret R Steel without recourse.
