Witnesseth that in consideration of the sum of Fifteen hundred dollars owing and now due on a certain promissory note made by the said Martha R Ricards, and Phillip A Ricards, March the twenty fifth, Eighteen hundred and eighty, due in twelve months from the date thereof and payable to R L Thomas of the county and State aforesaid or his order with interest from date, the said Martha R Ricards, and Phillip A Ricards, her husband do grant in fee Simple unto the said R L Thomas, as security for the payment of the aforesaid note, all that farm or tract of land situate lying and being in the Fifth Election District of Cecil County aforesaid it being the same tract or parcel of land which was conveyed unto the said Martha R Ricards by William S Evans, Trustee, by his Deed, dated February fifth Eighteen hundred and eighty one and recorded in Liber JAD No 1 folio 503 etc one of the Land Record Books of Cecil County aforesaid containing Eighty three acres and Eleven square perches of land more or less, to which said Deed and all other deeds and papers mentioned therein reference is hereby made for a more complete description of the same. Provided however that if the said Mortgagors shall make the payments and perform the covenants herein on their part contained then this Mortgage shall be Void. And the said Martha R Ricards, and Phillip A Ricards for themselves their heirs executors, administrators and assigns covenant promise and agree with and to the said R L Thomas, to pay and perform as follows that is to say, to Pay the said R L Thomas the fifteen hundred dollars now past due according to the tenor of the aforesaid promissory note in two years from the date of these presents with interest in the mean time payable annually, to pay all taxes and assessment which may be levied according to law upon the mortgage debt hereby created, as also upon the property hereby mortgaged, when payable. And the Mortgagee, or his attorney is hereby authorized by the said Mortgagors to sell the said mortgaged property in case of default in any of the conditions and covenants of this mortgage, as aforesaid for the space of thirty days for cash to the highest bidder at Public auction, upon giving thirty days notice of the time terms and place of sale by advertisement every week in some newspaper published in Cecil County aforesaid prior to the day of sale and to apply the proceeds of such sale to the payment, in the first instance, of the expenses attending said sale together with the usual commissions allowed to Trustees in Chancery to the party making said sale then to the said Mortgagee all arrears of principal and interest unpaid on the aforesaid promissory note, then the surplus, if any remains to pay to the said Mortgagors, their personal representatives or assigns. P A Ricards Test I W Benjamin State of Maryland Cecil County, to wit: I hereby certify that on this twenty six day of April in the year Eighteen hundred and Eighty one before me the subscriber a Justice of the Peace of the State of Maryland, in and for Cecil County aforesaid personally appeared Martha R Ricards, and Phillip A Ricards, and acknowledged the aforegoing Mortgage to be their respective act, at the same time also appeared R L Thomas, and made Oath in due form of law that the consideration in said Mortgage is true and bona fide as therein set forth.
