WHEREAS, a certain David T Devlin, Sr, late of Cecil County aforesaid, departed this life in the month of January, in the year aforesaid, intestate, leaving surviving him as his only children and heirs at law the aforesaid Rebecca D Harter and David T Devlin, parties grantors and grantee as aforesaid, and Mary E Devlin, his widow: and whereas in the settlement of his estate (which is solvent) it has been agreed between the said heirs at law and widow that the said David T Devlin, party grantee aforesaid, shall become the purchaser of the undivided half interest of the said Rebecca D Harter in and to the real estate of which the said David T Devlin, Sr, died seized and possessed and which is hereinafter described, subject to the dower interest of the said Mary E Devlin therein, and to that end the said real estate has, by said parties grantors and widow and party grantee, been valued at the sum of Twenty-five Hundred Dollars. NOW THESE PRESENTS WITNESSTH, that for and in consideration of the sum of Twelve Hundred and Fifty Dollars unto them the said Rebecca D Harter and Eugene W Harter, paid by the said David T Devlin, at and before the sealing and delivery hereof, the receipt whereof is hereby acknowledged, they the said Rebecca D Harter and Eugene W Harter, her husband, do hereby grant, convey, release and confirm unto the said David T Devlin, Jr, all of the right, title, interest and claim both at law and in equity, of them, the said parties grantors and each of them, in and to all of that farm or tract of land, situated in the Fourth Election District of Cecil County aforesaid, on the road leading from Cherry Hill to Cowantown, the said farm or land having been conveyed unto the said David T Devlin, Sr, by two deeds: the first a deed from William J Jones and L Marshall Haines, Trustees, dated on the Fifth day of April, in the year eighteen hundred and seventy seven, and recorded among the Land Records of said County in Liber AWM No 7 folio 110, by which deed there was conveyed unto the said David T Devlin, Sr, forty three acres, three roods and twenty seven perches of land more or less, and to which deed and the deeds, papers and proceedings therein referred to reference is hereby made for a more full and particular description of the portion of land conveyed by said deed; the second of said deeds being from John T Egner and wife to said David T Devlin, Sr, dated on the Third day of May, in the year eighteen hundred and ninety, and recorded among the said land records in Liber JAD No 21 folio 43, by which deed there was conveyed unto said David T Devlin, Sr, eight acres and sixteen perches of land more or less, which in said last mentioned deed is described as follows: BEGINNING for the same at a stone, a corner of the said David T Devlin and John T Egner’s land, and running thence North fifty five degrees East thirty eight perches, down a ravine to the middle of the road, thence South, fifty three and one half degrees East, twenty nine and four tenths perches along the middle of said road to the Cherry Hill road, thence South forty three degrees West, forty three perches along the middle of the Cherry Hill road to the said David T Devlin, Sr, land and thence North forty four and a half degrees West thirty seven and a half perches with the said David T Devlin, Sr’s, land to the place of beginning. TO HAVE and TO HOLD the said real estate, now constituting one entire farm or tract of land whereof the said David T Devlin, Sr, died seized and possessed, subject to the dower interest aforesaid; together with the buildings and improvements thereon and appurtenances thereto belonging or in any wise appertaining, in fee simple. IN TESTIMONY WHEREOF we have hereunto set our hands and seals the day and year first herein written.
