All Rights Reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ********************************************************* Cecil County Land Record Book, Liber JS, Number 1, Folio 419 This Indenture made the day of [day & month missing] in the year of our Lord one thousand eight hundred and [four/five?] between Samuel Wilson Sen’r of Cecil County and State of Maryland of the one part and Peter Egner of the same County and State of the other part - Witnesseth that the said Samuel Wilson Sen’r for and in consideration of the Sum of Ten pounds fifteen shillings current lawful money of Maryland to him in hand paid by the said Peter Egner at and before the ensealing and delivery of these presents, the Receipt and payment whereof is hereby acknowledged he the said Samuel Wilson hath granted bargained and sold aliened released enfeoffed and confirmed and by these presents doth grant bargain and sell alien release enfeoff and confirm unto him the said Peter Egner and to his heirs and assigns forever all that part of a tract of Land in Cecil County called Price’s Patent situate lying and being on the South side of the Great Road leading from Elkton by Bell hill to Newark. Beginning for the same at a stone set in the ground by the South Side of a young marked ash tree about Ten perches and three quarters South of the aforesaid Great Road and being on very near a Line of the whole tract of land of which this is a part and running from thence North four degrees twenty minutes West ten perches and three quarters of a perch to the South Side of the aforesaid Great road thence along the same towards Elkton South Sixty Six degrees twenty minutes west thirty three perches and three quarters of a perch to a stone by said Road on the north side of a blazed White Oak tree and from thence by a straight line to the place of beginning containing one acre and twelve square perches of land more or less, Together with all and singular the improvements woods ways waters priviledges[sic] advantages and appurtenances thereunto belonging or in any wise appertaining and all the Estate Right Title Interest property claim and demand whatsoever of him the said Samuel Wilson Sen’r his Heirs Executors and Administrators of in or unto the said hereby granted bargained and Sold Land and premises and of in and unto every part and parcel thereof with the appurtenances. To have and to hold the said Land and Premises with the appurtenances unto him the said Peter Egner his heirs & assigns To the only proper use and behoof of him the said Peter Egner his heirs and assigns forever and the said Samuel Wilson Sen’r for himself his heirs executors and administrators doth hereby covenant and agree to and with the said Peter Egner his heirs & assigns that he the Said Samuel Wilson Sen’r his heirs executors and administrators the said Land and premises with the appurtenances unto him the said Peter Egner his heirs and assigns shall and will forever warrant and defend against the lawful claims and demands of him them or any of them - In witness whereof the said Samuel Wilson Sen’r hath hereunto set his hand and affixed his seal the day and year first above written Samuel Wilson Signed Sealed and Delivered in presence of Jno King, Tho W Veazey Received this tenth March one thousand eight hundred and six of the within named Peter Egner the Sum of Ten pounds fifteen shillings Current lawful Money of Maryland being in full of the Consideration Money within mentioned Samuel Wilson being present Jno King Maryland Cecil County Sct Be it remembered that on the tenth day of March one thousand eight hundred and six personally appeared before us the Subscribers two of the Justices of the peace for Cecil County the within mentioned Samuel Wilson Sen’r and acknowledged the within instrument of writing to be his act and deed and the Land and premises within mentioned to be Granted bargained and sold with the appurtenances to be the only right and estate of the within named Peter Egner his heirs and assigns forever according to the true intent and meaning of the within deed We further certify that at the same time appeared before us Mary Wilson wife of the said Samuel Wilson Sen’r who being by us privately examined apart and from her said Husband and asked whether she acknowledged the same freely and willingly of her own free will and accord without being induced thereto by threats of her said Husband and fear of his ill will or fear of incurring his displeasure ? when she answered that she made the same acknowledgement freely and willingly Without being induced thereto by fear or threats of her said Husband or fear of incurring his displeasure, but that she did the same of her own free will and accord – acknowledged before us this 10th March 1806 acknowledged before Jno King Tho W Veazey Recorded the 10th March 1806 & examined per James Sewall Clk See the following Web site for more info on Peter Egner and relatives http://homepages.rootsweb.com/~pda
