Witnesseth that the said Peter Egner for and in consideration of the Sum of three hundred and twelve pounds current lawful money of the United States to him in hand paid by the said Jacob Casho before the sealing and delivery of these presents the receipt whereof he the said Peter Egner doth hereby acknowledge and from every part and parcel thereof doth hereby acquit exonerate and discharge the said Jacob Casho his heirs executors and administrators he the said Peter Egner hath given granted bargained sold aliened enfeoffed and confirmed and by these presents doth give grant bargain sell alien enfeoff and confirm unto the said Jacob Casho his heirs and assigns the two following described tracts pieces or parcels of Land both lying and being in Cecil County and State of Maryland aforesaid to wit all that tract of land being part of a tract of land in Cecil County called Prices Patent, and which was formerly conveyed by the said Jacob Casho to the said Peter Egner as by deed recorded in Liber JB No 5 folio 180 [this reference appears to be the same as (no Liber) No 21, Folio 180 in modern Cecil County Land Records] a land record book of Cecil County will appear and which said land is included within the following metes and bounds viz beginning at a stone set up in the woods by a marked ash Saplin[sic] being the north East corner of said tract of land and running thence south four degrees and a quarter east eighty four perches to a large marked black Oak tree on the north side of the old road leading from Andrew Fishers Mill to Bell hill and running from thence along said old road North eighty seven degrees and a quarter west sixty eight perches and a half to a marked hickory tree on the south side of said old road then south eighty eight degrees and a quarter west thirteen perches still along by said road to a stone then north four degrees and a half west twenty four perches to a stone on the north eighty five degrees east line of said land being also the line of Samuel Wilsons[sic] land then with said line north eighty five degrees east eighty one perches to the place of beginning containing forty acres of Land more or less _ Also all that part of a tract of land in Cecil County called Prices patent situate lying and being in Cecil County on the south side of the Great road leading from Elkton by Bell Hill to new Ark [Newark, DE] it being that land which the said Peter Egner heretofore purchased of a certain Samuel Willson[sic] and joins the herebefore described land, begining[sic] for the courses and distances of the same at a Stone set in the ground by the south side of a young marked Ash tree about ten perches and three quarters South of the aforesaid great road and being on or very near a line of the whole tract of Land of which this is a part and running from thence North four degrees twenty minutes west ten perches, and three quarters perches to the south side of the aforesaid great road thence along the same towards Elkon south sixty six degrees twenty minutes west thirty three perches and three quarters of a perch to a Stone by said road on the north side of a blazed white Oak tree and from thence by a Straight line to the place of beginning containing one acre and twelve square perches of land, more or less together with all and singular the buildings improvements woods ways waters water courses rights liberties privileges hereditaments and Appurtenances whatsoever to the same aforesaid two tracts pieces or parcels of land belonging or in any wise appertaining and the reversions and remainders rents issues and profits thereof and all the estate right title and interest whatsoever of him the said Peter Egner of into and out of the said tracts or parcels of Land and premises both at law and in equity and which said tracts of land are hereby bargained and sold or meant mentioned or intended hereby so to be. To have and to hold the said two tracts or parcels of land and premises so as aforesaid described together with the buildings and appurtenances and all and singular other the premises hereby bargained and sold or meant mentioned or intended hereby so to be and every part and parcel thereof with their and every of their appurtenances unto the said Jacob Casho his heirs and assigns forever to the only proper use benefit and behoof of the said Jacob Casho his heirs and Assigns forever and to and for no other use intent or purpose whatsoever. And the said Peter Egner for himself his heirs Executors and Administrators doth covenant promise grant and agree to and with the said Jacob Casho his heirs and assigns by these presents that he the said Peter Egner and his heirs Executors and Administrators the said two herein before described and mentioned pieces or tracts of land hereditaments and premises and Appurtenances hereby granted or intended so to be unto him the said Jacob Casho his heirs and assigns against him the said Peter Egner and his heirs executors and Administrators and against all and any every other person and persons whomsoever lawfully claiming or to claim the same by from or under him them or any of them shall and will warrant & forever defend by these presents - In Testimony whereof I the said Peter Egner have hereto set my hand and seal the day and year first herein before written Peter Egner Signed sealed & delivered In presence of Jno King, Tho W Veazey Received on the day of the date of the within Deed the consideration therein mentioned in full Peter Egner Witness Jno King Maryland Cecil County Sct Be it remembered that on this tenth day of March Eighteen hundred and six personally appears Peter Egner the party grantor within named before us the subscribers two Justices of the peace in and for the County aforesaid and acknowledged the within and aforegoing deed or instrument of writing to be his act and Deed and the lands and premises therein mentioned and thereby bargained and sold to be the right and estate of the within named Jacob Casho party Grantee also therein named his heirs and Assigns forever according to the purport true intent and meaning of the said deed or instrument of writing and the Acts of Assembly in such case made and provided And now at the same time also personally appears Susanah Egner wife of the said Peter Egner before us Justices as aforesaid and Acknowledges the said Deed or instrument of writing to be her act and Deed and the lands and premises therein mentioned to be the right and estate of the within and therein named Jacob Casho his heirs and Assigns forever and the said Susanah being by us privately examined apart from and out of the hearing of her husband whether she doth make her acknowledgement of the same willingly and freely and without being induced thereto by fear or threats of or ill usage of her husband or fear of his displeasure acknowledges and declares that she doth make her acknowledgement of the same willingly and freely and without being induced thereto by fear or threats of or ill usage by her husband or fear of his displeasure Taken and certified the day and year above written Jno King Tho W Veazey Recorded the 10th day of March 1806 & Examined pr James Sewall Clk See the following Web site for more info on Peter Egner and relatives http://homepages.rootsweb.com/~pda
