Whereas a certain Peter Hossinger lately died seized of an undivided third part of a tract or parcel of land situate lying and being in Cecil County in the State of Maryland, upon a Creek Called Octorara Creek in Octora Hundred containing by estimation twelve acres and one quarter of land more or less, which piece parcel of land the said Peter Hossinger held in common with a certain Henry W Physick, and a certain Charles J[?] Bunting. And whereas the said undivided third part of the said Tract or parcel of land whereof the said Peter Hossinger so died seized as aforesaid, hath descended to and vested in the above named Joseph Hossinger, Peter Hossinger, Barbary Egner, Mary Meteer & Susan Hossinger as his Heirs at law, and to the above named Mary Hossinger the widow of the said Peter as Tenant in Dower of her legal share or first proportion thereof, and they are all desirous and have agreed with the above named Jacob Richards to sell and Convey all their right and title to the same, unto him and his heirs in fee simple. Now this Indenture Witnesseth that the said Joseph Hossinger, Peter Hossinger, Peter Egner and Barbary his wife, Mary Mateer[sic], Susan Hossinger & Mary Hossinger for and in consideration of the premises, and also in further consideration of the sum of six hundred and sixty six dollars and sixty six cents current money of the United States to them in hand paid by the said Jacob Richards, at or before the sealing, and delivery of these presents, the receipt whereof they do hereby acknowledge, and thereof and there from do hereby acquit, exonerate and discharge the said Jacob Richards his Heirs and Assigns one full undivided third part, of the Tract or parcel of land aforesaid, being a part of two patented Tracts of land, the one called Hall’s Choice, and the other Halls[sic] Lott[sic], - Beginning for the whole, of which one third is hereby intent to be conveyed, at a large stone ste up, near the edge of the aforesaid Octorara Creek, where the great road leading from Rock Run to the Bald Frier Ferry, crosses the said Creek, and on the Easterly Side of the said Road, and running thence up the Said Road, and bounding on the Easterly side thereof, north twelve degrees and a half west eight perches, then north six degrees East seventeen perches, then north thirty degrees west five perches, then north seventy one degrees west sixteen perches, then north, sixty six Degrees, and a half west, eleven perches, then north fifty six degrees and a half west two perches still bounding on the Easterly side of the aforesaid great Road to a large stone, then north forty degrees, and a half East thirty perches, then north forty nine degrees East sixteen perches and a quarter of a perch to a marked black Oak tree standing on Octorara Creek side, about six perches above the Saw Mill Dam, then north sixty one degrees East, eleven perches and three quarters of a perch across the Creek to a large stone, on the Easterly side thereof, then south fifty two degrees and a half East four perches and three quarters of a perch down said Creek to a Rock Stone, then south thirty two degrees west, nine perches across the aforesaid Creek to a Rock Stone, on the Westerly side thereof, in the edge of the water, then down along said Creek, and bounding thereon South, forty four degrees East seven perches, then south eighteen degrees, and an[sic] half East twenty four perches, then south two degrees west eleven perches, then south twenty three degrees west six perches Still bounding on the westerly side of said Creek, then with a Straight line, still bounding on said Creek to the place of Beginning, containing and laid out for twelve acres and a quarter of an acre of land more or less, together with all and singular, the buildings improvements ways, waters, water courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining, and the reversions and remainders rents issues and profits thereof, and all the Estate right, title and interest whatsoever of them the said Joseph Hossinger, Peter Hossinger, Peter Egner and Barbary his wife, Mary Mateer[sic], Susan Hossinger and Mary Hossinger, both at law and in equity, of into and out of the said parcel of land, and premises hereby bargained and Sold, or meant, mentioned, or intended hereby So to be, and every, or any part, and parcel thereof. To have and to hold the said parcel of land so as aforesaid described or howsoever the same may be described, together with the buildings and appurtenances, and all and singular other the premises, hereby bargained and sold, or meant, mentioned or intended hereby So to be, and every part and parcel thereof with their and every of their appurtenances unto the said Jacob Richards his Heirs and Assigns forever, and to and for no other use intent or purpose whatsoever. And the said Joseph Hossinger, Peter Hossinger, Peter Egner and Barbary his wife, Mary Mateer[sic], Susan Hossinger and Mary Hossinger for themselves their Heirs, Executors and Administrators respectively do hereby covenant, grant, promise and agree to and with the said Jacob Richards, his Heirs Executors, Administrators and Assigns that they the said Joseph Hossinger, Peter Hossinger, Peter Egner, and Barbary his wife, Mary Mateer[sic], Susan Hossinger and Mary Hossinger, and their Heirs respectively the said parcel of land and premises, hereby granted, bargained and Sold and every part and parcel thereof; with their and every of their appurtenances to him the said Jacob Richards his Heirs and assigns against them the said Joseph Hossinger, Peter Hossinger, Peter Egner and Barbary his wife, Mary Mateer[sic], Susan Hossinger, and Mary Hossinger, and their Heirs and against all and every person or person whatsoever claiming or to claim, any right, title or interest in and to the same, or any part thereof, by from or under them or any of them shall and will warrant and forever defend by those presents. In Witness whereof the said Joseph Hossinger, Peter Hossinger, Peter Egner, and Barbary his wife, Mary Mateer[sic], Susan Hossinger, and Mary Hossinger have hereunto subscribed their names, and affixed their Seals the day and year first herein before written. And now at the same time also personally appears Jane Hossinger, the wife of the said Peter Hossinger before us Justices as aforesaid, and acknowledges the said Deed or instrument of writing to be her act and Deed, and the lands and premises therein mentioned, and thereby bargained and sold to be the right and Estate of the within named Jacob Richards his Heirs and Assigns forever, and the said Jane Hossinger, together with the above named Barbary Egner wife of the above named Peter Egnor, being by us privately examined apart from and out of the hearing of their husbands whether they do make their acknowledgement of the same willingly and freely without being induced thereto by fear or threats of or ill usage by their husbands or fear of their displeasure & severally acknowledge that they do make their acknowledgement of the same, willingly and freely, and without being induced thereto by fear or threats of, or ill usage by their husbands or fear of their displeasure.
