All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Marilyn Webb wmarilyn45@yahoo.com January 29, 2010, 7:28 pm Written: March 26, 1846 Indenture between Joseph Pierson and Ruth Pierson, his wife, of Cecil County, Maryland and James Smith of Chester County, Pa Joseph Pierson and Ruth Pierson, his wife by thier bond or obligation duly executed bearing even date with this stands bound unto the said James Smith his executors and assignees in the sum of $3000.00 currant money with a condition or written for the payment of $1500.00 currant money with legal interest for the same on or before 26 March 1847. This indenture witnessth that the said Joseph and Ruth Pierson in consideration of said debt sum of $1500.00 owing to the said James Smith and for securing of payment thereof with interest to the said James Smith and his heirs according to the condition of said Bond and also in consideration of a further sum of $5.00 currant money to Joseph and Ruth Pierson by the said James Smith in hand and paid at and before sealing and delivery of these presents the receipt whereof is hereby acknowledged by the said Joseph and Ruth Pierson. Hath granted, bargained and sold, released and comfirmed and by these presents doth grant, bargain and sell, release and confirm unto James Smith, his hiers and assigns all that tract of land lying and being in Cecil County adjoining lands of James Trimble and others and described in the following courses and distances. Beginning at a stone on a line of James Trimbles land and running thence North 1/2 degree West 176 perches and 3/10ths to the Pennsylvania line thence along the same North 89 degrees West 151 perches to a stone heap thence South 1/2 degree East 97 perches to the beginning of Joseph Piersons tract thence North 85 1/2 degrees East 62? perches thence South 1/2 degree East 101 perches and thence North 85 1/2 degrees East 89 perches to the place of beginning. Containing 138 acres of land belonging to James Smith, his heirs and assigns forever to his and thier own use. It is the true intent and meaning of those present and of the said parties hereunto that if the said Amos Pierson his heirs will pay or cause to be paid the full sum $2000.00 with legal interest for the same on or before 26 March 1847 without any deduction or abatements or every matter and thing therein contained shall cease and be utterly void.
