All Rights Reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ********************************************************* Cecil County Land Record Book, Liber RCH, Number 1, Folio 2 This Indenture made and executed this twenty eighth day of March in the year of our Lord one thousand eight hundred and forty nine between John W Egnor and Matilda Egnor his wife of Cecil County in the State of Maryland of the one part and James Fulton of New Castle County in the State of Delaware of the other part. Witnesseth that for and in consideration of the sum of eleven hundred dollars current money by the said James Fulton to the said John W Egnor and Matilda Egnor in hand paid at and before the sealing and delivery of these presents the receipt of which they do hereby acknowledge, have given granted bargained sold aliened enfeoffed released conveyed and confirmed and by these presents do give grant bargain sell alien enfeoff release convey and confirm unto the said James Fulton his heirs and assigns all that farm or tract or part of a tract of land lying in Cecil County and State of Maryland and in New Castle County in the State of Delaware known as the Whitely or McIntyre farm and bounded as follows to wit on the North by the road leading from New Ark to Fair Hill on the South by lands of James Murray on the East by lands of Thomas Steele and others and on the West by lands of James Fulton and containing forty four acres of land more or less, being the same property which was conveyed to William T Scott by a certain Henry Whitely of New Castle County in the State of Delaware by deed duly executed acknowledged and recorded among the land records of said County of New Castle and in Liber JS No 41 folio 340 one of the land record books of Cecil County aforesaid except so much thereof as is conveyed by William T Scott and Mary Scott his wife to a certain James Fulton by deed duly executed acknowledged and recorded among the land records of New Castle County aforesaid and in Liber GMC No 3 folio 316 another of the land record books of the said County of Cecil. Together with all and singular the buildings improvements woods ways waters watercourses rights members privileges advantages and appurtenances thereto belonging or in any wise appertaining and all the estate right title and interest trust property and demand whatsoever at law and in equity of them the said John W Egnor and Matilda Egnor his wife of in and to the same. To Have and To Hold the the[sic] same herein described premises with the appurtenances thereunto belonging unto the said James Fulton his heirs and assigns to the only proper use of the said James Fulton his heirs and assigns forever. In testimony whereof the said John W Egnor and Matilda Egnor his wife have hereunto respectively set their hands and seals on the day and year first herein before written. Signed sealed and delivered in the presence of George McCullough, William M Henry John W Egner Matilda Egner Signed sealed and delivered in the presence of Thomas Steel W McCaulley Received from James Fulton part grantee named in the foregoing instrument of writing eleven hundred dollars being the consideration expressed to be paid in the foregoing indenture John W Egner Matilda Egner Witness Thomas Steel W McCaulley State of Delaware New Castle County Sct Be it remembered and it is hereby certified that on this twenty eighth day of March in the Year of our Lord one thousand eight hundred and forty nine before me the subscriber commissioned duly appointed to take acknowledgements in the State of Delaware of deeds passing real estate in Maryland personally appears John W Egnor and Matilda Egnor his wife they being satisfactorily proven by oral testimony under oath received by me to be the persons who are named and described as and professing to be the parties grantors to the foregoing deed or indenture and do generally acknowledge the same indenture or instrument of writing to be their respective act and deed, the said Matilda Egnor having signed and sealed said indenture before me out of the presence and hearing of her husband, and the said Matilda Egnor being by me examined out of the presence and hearing of her said husband whether she doth execute and acknowledge the same freely and voluntarily and without being in dread to do so by fear or threats of or ill usage by her husband or by fear of displeasure declareth and saith that she doth. In Testimony whereof I William McCaulley the Commissioner aforesaid have hereunto set my hand and official seal at the City of Wilmington in New Castle County aforesaid on the day and year last aforesaid. W McCaulley Commissioner for Maryland State of Delaware New Castle County SS Be it remembered that on this twenty eighth day of March in the Year of our Lord one thousand eight hundred and forty nine before me William McCaulley Notary Public of the State and County aforesaid John W Egner and Matilda Egner his wife named in this indenture personally appeared and acknowledged said indenture to be their act and deed respectively and desired that it might be recorded and that on the same day the said Matilda Egner wife of the said John W Egner being by me privately examined apart from her husband acknowledged that she executed said indenture willingly without compulsion thereto or fear of her husbands displeasure.
