All Rights Reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ********************************************************* Cecil County Land Record Book, Liber RCH, Number 2, Folio 87 This Indenture made and executed this twenty fifth day of March in the Year of our Lord one thousand eight hundred and fifty between Henry Pritchard and Caroline Pritchard his wife of Cecil County in the State of Maryland of the one part and John Egnor of the same County and State of the other part. Whereas the said Henry Pritchard and Caroline his wife are seized in fee simple of one undivided fourth part of all that part of the real estate of John Egnor late of said County deceased, which was assigned to the said Caroline (then Caroline Egnor) and others as the heirs of Jacob Egnor deceased by certain commissioners appointed by the Court of Chancery to value and divide the said real estate and which said piece or parcel of said real estate so as aforesaid assigned to the said Caroline and others as the heirs of the said Jacob Egnor deceased is contained within the following metes and bounds courses and distances to wit. Beginning for the same at a stone set in the ground at the end of Eliza Kincaids lot and running thence South sixteen degrees East fifty perches, then South forty two and a half degrees West twelve perches, then South fourteen and a half degrees East thirty nine and a half perches then South one and a half degrees East twenty five and half perches then South three degrees East thirty nine and a half perches then North sixty eight degrees East twenty nine perches, then North three and a half degrees West one hundred and fifty one perches and four tenths of a perch and from thence to the place of beginning containing twenty eight acres and fourteen and a half perches of land more or less, from which there is to be deducted two roods used and occupied by the Philadelphia and Baltimore rail road leaving twenty seven acres two roods and fourteen and half perches of land more or less, it being that part of the real estate of said John Egnor deceased which is described in the return of the said commissioners appointed to divide the same as lot number three. And whereas the said Henry Pritchard and Caroline Pritchard his wife (formerly Caroline Egnor) for and in consideration of the sum of forty dollars have agreed to sell unto the said John Egnor all their right title and interest in and to the said division or lot number three being the undivided one fourth part thereof, and for the purpose of making to the said John Egnor a good and sufficient conveyance for the same this instrument of writing is executed. Now this Indenture Witnesseth that the said Henry Pritchard and Caroline Pritchard his wife for and in consideration of the said sum of forty dollars current to them in hand paid by the said John Egner at and before the sealing and delivery of these presents the receipt whereof they do hereby acknowledge the said Henry Pritchard and Caroline Pritchard his wife have granted bargained sold aliened enfeoffed released conveyed and confirmed and by these presents do give grant bargain sell alien enfeoff release convey and confirm unto the said John Egner his heirs and assigns the undivided one fourth part of the hereinbefore described division or lot number three of the real estate of the said John Egnor deceased. Together with all and singular the buildings improvements ways waters water courses rights members privileges advantages and appurtenances thereto belonging or in any wise appertaining and all the estate right title and interest trust property claim and demand whatsoever at law or in equity of them the said Henry Pritchard and Caroline his wife of in and to the same. To Have and To Hold the said herein described undivided fourth part of the said division piece parcel or lot of land with the appurtenances thereunto belonging unto the said John Egnor his heirs and assigns to the only proper use of the said John Egnor his heirs and assigns forever. In testimony whereof the said Henry Pritchard and Caroline Pritchard his wife have hereunto set their hands and seals on the day and year first herein before written. Henry Pritchard (his mark) Caroline Pritchard (her mark) Signed sealed and delivered in the presence of Geo H Joyce J E Brown State of Maryland Cecil County Sct: Be it remembered that on this twenty fifth day of March in the year of our Lord one thousand eight hundred and fifty before the subscribers two Justices of the Peace of the State of Maryland in and for Cecil County aforesaid personally appear Henry Pritchard and Caroline Pritchard his wife they being known to us to be the persons who are named and described as and professing to be the parties grantor to the foregoing deed or indenture and do severally acknowledge the said said[sic] indenture or instrument of writing to be their respective act and deed. The said Caroline Pritchard having signed and sealed said indenture before us out of the presence and hearing of her husband, and she being by us privately examined apart from and out of the presence and hearing of her husband; and the said Caroline Pritchard being by us examined out of the presence and hearing of her said husband “Whether she doth execute and acknowledge the same freely and voluntarily and without being induced to do so by fear or threats of or ill usage by her said husband or by fear of his displeasure” declareth and saith that she doth.
